How do I get a business license?

Ohio Secretary of State (entity formation) / Ohio Department of Taxation (tax registration) / Local jurisdiction for local licenses
Step by Step

How to do it

  1. Determine your business structure: sole proprietor, LLC, corporation, partnership
  2. Register your business entity with the Ohio Secretary of State (for LLCs, corporations, and LPs) - file online at OhioSOSBusinessSearch.gov or through the Ohio Business Gateway (OBG) at business.ohio.gov; Ohio offers streamlined online filing
  3. Obtain an EIN (Employer Identification Number) from the IRS at irs.gov
  4. Register with the Ohio Department of Taxation for applicable state taxes through the Ohio Business Gateway (business.ohio.gov):
  5. - Ohio Vendor's License (Sales Tax Permit) - required if selling taxable goods/services
  6. - Withholding Tax Account (if hiring employees)
  7. - Other applicable Ohio taxes (Commercial Activity Tax/CAT for gross receipts over $150,000 annually)
  8. Check with your city or municipality for LOCAL BUSINESS LICENSES: Ohio municipalities have HOME RULE authority and independently decide licensing requirements; larger Ohio cities (Columbus, Cleveland, Cincinnati, Toledo, Akron, Dayton) require local business licenses and may have local income taxes requiring registration; contact your city
  9. Check for industry-specific state licenses: contractors (Ohio Construction Industry Licensing Board - cib.ohio.gov for plumbers, electricians, HVAC); health professionals, real estate, cosmetologists through the Ohio Department of Commerce or respective licensing boards; professional licenses through the Ohio State Medical Board, Ohio Board of Nursing, etc.
  10. Renew entity biennial report (every 2 years) with Ohio SOS; renew local licenses; renew professional licenses per board schedule

County-specific variations apply

Ohio's cities independently administer local business licensing. Columbus, Cleveland, Cincinnati, Toledo, Akron, Dayton, and virtually all Ohio municipalities with income taxes require local business registration and may require local licensing. Ohio has a MUNICIPAL INCOME TAX system - businesses operating in Ohio cities pay city income tax to those cities; the Regional Income Tax Agency (RITA) and Central Collection Agency (CCA) collect for many Ohio municipalities. Verify requirements for every city where you operate.
