Notes: Nevada County’s Gold Rush heritage is extraordinary – the Empire Mine operated for over 100 years and was California’s most productive hard rock gold mine (producing 5.8 million ounces of gold); the Malakoff Diggins hydraulic mining controversy led to America’s first major environmental court decision, setting a precedent that industrial activities cannot damage downstream property rights; the Donner Party’s terrible winter of 1846-47 at Donner Lake is one of America’s most poignant historical stories; Nevada City’s Victorian downtown and arts community make it one of California’s most charming historic towns; Truckee’s ski resort culture and outdoor recreation draw crowds year-round

Environmental: California SWRCB; Central Valley RWQCB (for Yuba/Bear draining to the Sacramento); Lahontan RWQCB (for Truckee River draining to Reno/Nevada); USFS (Tahoe NF); Empire Mine and Malakoff Diggins legacy mining contamination; mercury from Gold Rush-era hydraulic and hard rock mining; PG&E equipment (Kincade, Dixie, Camp fires started by PG&E equipment – Nevada County has been intensely engaged in PG&E accountability)
Notes: Mercury contamination from Gold Rush-era gold mining is Nevada County’s most significant legacy environmental issue; hydraulic mining debris (slickens – tens of millions of cubic yards of gravel and clay) was deposited in the Sacramento River system from 1853 to 1884 – it raised river beds, buried farmlands, flooded Sacramento, and is still present in Bay sediments; the 1884 Sawyer Decision that ended hydraulic mining was the first major environmental court ruling in American history; hard rock gold mines like Empire Mine used mercury extensively and legacy contamination in stream sediments requires ongoing monitoring; PG&E’s role in igniting wildfires through inadequate equipment maintenance has made Nevada County one of the most engaged counties in California on utility accountability; Truckee’s rapid growth creates stormwater management challenges in a sensitive Lake Tahoe tributary watershed
About Nevada County
Nevada County is a Sierra Nevada foothill and mountain county and the 563rd most populous in the United States, covering 974 square miles from the Gold Country foothills east to the Sierra Nevada crest near Donner Pass.
Nevada City (the county seat, population ~3,000) is one of California’s most remarkably preserved Gold Rush-era communities – a small city of Victorian commercial buildings, gas street lamps, and a downtown that has barely changed in a century. Nevada City’s Broad Street is a designated National Historic Landmark district. The city has long attracted artists, writers, and progressive professionals seeking an alternative to California’s coastal urban centers – a creative class culture that coexists with the Gold Rush heritage in an unusual blend.
Grass Valley (population ~13,000) is Nevada County’s largest city – a working Gold Country city with a Cornish mining heritage (tin miners from Cornwall, England settled in large numbers, bringing their mining expertise to the hard-rock gold mines). The Empire Mine State Historic Park preserves the most productive hard-rock gold mine in California history – operating from 1850 to 1956 and producing 5.8 million ounces of gold. The park’s mine buildings, gardens, and underground tour are exceptional.
Truckee (population ~16,000) is an entirely different environment – a high-altitude (5,820 feet) mountain community on I-80 near Donner Pass, adjacent to Lake Tahoe’s northern shore and surrounded by ski resorts (Palisades Tahoe, formerly Squaw Valley/Alpine Meadows, and Northstar California). Truckee’s character as a mountain resort and year-round outdoor recreation community has driven extraordinary appreciation since 2020.
Donner Lake – where the Donner Party was trapped in 1846-47 in one of American history’s most tragic episodes of survival cannibalism – is near Truckee, with Donner Memorial State Park preserving the site.
Nevada County is a Sierra Nevada foothills county with beautifully preserved Gold Rush towns. Nevada City is one of the best-maintained Victorian-era mining towns in California. Grass Valley was the site of the Empire Mine — one of the richest gold mines in California history. Malakoff Diggins State Historic Park preserves the scars and history of hydraulic mining. The county has attracted remote workers, artists, and tech sector refugees from the Bay Area, giving it an unusual mix of rural character and tech-educated residents.

Step 1: figure out which path applies
California recently increased its small-estate thresholds substantially, so check this first – more estates now qualify to skip full probate than in past years.
Small Estate Affidavit (personal property) – for estates with personal property valued at $208,850 or less (for deaths on or after April 1, 2025; holds through March 31, 2028). No court filing needed – present the signed affidavit directly to the bank or institution holding the property. Must wait at least 40 days after the death, and no probate proceeding can already be pending.
Petition to Determine Succession to Real Property, Primary Residence – for a decedent’s primary California residence valued at $750,000 or less (Judicial Council Form DE-310). Requires a 40-day wait, notice to heirs, and a probate referee appraisal.
Affidavit for Real Property of Small Value – for other (non-primary-residence) California real property valued at $69,625 or less (Form DE-305). Requires a 6-month wait.
Formal Probate – required when the estate exceeds these thresholds. California typically uses the Independent Administration of Estates Act (IAEA), letting the personal representative handle most matters without a court hearing for each step.
California is a community property state – a surviving spouse already owns their half of community property, and can often use a simplified Spousal Property Petition (Form DE-221) instead.
If using the small estate affidavit (personal property)
Wait at least 40 days after the death.
Confirm total qualifying California personal property (excluding trust assets, joint tenancy, POD/TOD accounts, and beneficiary-designated accounts) is $208,850 or less, using date-of-death values.
Complete the affidavit under Probate Code § 13100.
Present it with a certified death certificate directly to the bank or institution – no court filing required. Collecting property this way makes you personally liable for the decedent’s unsecured debts up to the value received (Prob. Code § 13109).
IF USING THE PRIMARY RESIDENCE PETITION OR SMALL REAL PROPERTY AFFIDAVIT
Confirm the property qualifies and the applicable waiting period has passed (40 days for the primary-residence petition; 6 months for the small real property affidavit).
File the petition (Form DE-310) or affidavit (Form DE-305) with the Nevada County Superior Court, at either location.
A probate referee appraises the property; heirs receive notice.
Once approved, the property transfers without full probate administration.
If formal probate is required
Deliver the original will (if any) to the court clerk within 30 days of learning of the death (Prob. Code § 8200).
File a Petition for Probate (Form DE-111) to admit the will and request appointment as personal representative.
The court issues Letters Testamentary (Form DE-150) or Letters of Administration.
If Independent Administration authority is granted, the personal representative can act on most matters without separate court hearings.
Notice to creditors and an inventory/appraisal (with a probate referee) follow, along with payment of debts and taxes.
The estate closes with a final petition for distribution.
What it costs
Small estate affidavit / real property affidavits: no court filing fee for the personal-property affidavit; filing fees apply to the DE-310 primary-residence petition and DE-305 small real property affidavit.
Formal probate filing fee: several hundred dollars, varying somewhat by county.
Personal representative and attorney compensation: statutory fee schedule based on estate size (Prob. Code §§ 10800–10810) – a percentage that declines as the estate grows.
No California state estate tax or inheritance tax.
