About Santa Barbara County
Santa Barbara County stretches along the California coast from Carpinteria in the south to the San Luis Obispo County line in the north, encompassing one of the most scenically dramatic and economically diverse counties in the United States. The county’s geography – Mediterranean climate, mountains meeting the Pacific, mission architecture, wine country, and agricultural valleys – has made it a perennial destination for both high-net-worth residents and the film industry.
Santa Barbara (the county seat, population ~90,000) is known as the “American Riviera” – a city of Spanish Colonial Revival architecture (largely rebuilt after the 1925 earthquake in a unified Mission Revival style), red tile roofs, white stucco walls, and a State Street commercial corridor that descends to a working harbor and East Beach. The University of California, Santa Barbara (UCSB) in Goleta – adjacent to Santa Barbara – is a major research university with particular strengths in physics (four Nobel laureates on faculty), materials science, and marine biology, and drives a significant tech and startup ecosystem in the county.
Montecito – a small unincorporated community between Santa Barbara and Carpinteria – is one of the wealthiest communities in the United States, home to celebrities, tech executives, and inherited wealth families drawn by the combination of climate, privacy, architectural estates, and proximity to Los Angeles (90 minutes). The destructive Thomas Fire (December 2017) and the Montecito mudslides (January 2018, which killed 23 people) remain the defining disasters of the community’s recent memory.
Vandenberg Space Force Base (formerly Vandenberg Air Force Base, redesignated 2021) occupies a massive stretch of the county’s western coastline and serves as the primary West Coast launch facility for polar orbit missions – SpaceX, United Launch Alliance, and government agencies regularly launch from Vandenberg. California property taxes are governed by Proposition 13 (1978). Your property’s assessed value is set at the purchase price (the “base year value”) and can increase by no more than 2% per year (or the California CPI, whichever is less) until the property is sold again. In Santa Barbara County, where coastal and wine country properties have appreciated dramatically over decades, the gap between longtime owners’ Prop 13 assessed values and current market values can be enormous.

Supplemental Assessment: When you purchase a property in Santa Barbara County, expect a supplemental tax bill reflecting the jump from the prior owner’s low Prop 13 base to your new base year (purchase price). This bill arrives 3–6 months after closing and often catches buyers off guard – plan for it.
Decline in Value (Prop 8) appeal: If your property’s current market value has fallen below your Prop 13 assessed value, file a Decline in Value appeal with the Santa Barbara County Assessment Appeals Board (105 E. Anapamu Street, Room 407, Santa Barbara, 805-568-2190). The filing window is July 2 through November 30 each year. The board compares comparable sales as of the January 1 lien date.
Prop 19 – Parent-to-Child Transfers: Since February 16, 2021, the rules for transferring California real property between parents and children with preserved Prop 13 base year values have changed significantly. The child must occupy the inherited property as their primary residence within one year, and the transfer benefit is capped at $1 million above the parent’s assessed value. Investment properties, vacation homes, and second homes now reassess to full market value at transfer. In Montecito and other high-value Santa Barbara areas, where a parent’s Prop 13 assessed value might be $500,000 on a property now worth $8 million, the Prop 19 change means a child who doesn’t live there will inherit a tax bill based on $8 million. This is among the most significant estate planning issues in high-value California real estate markets.
California has no state estate tax and no state inheritance tax. Federal estate tax applies above approximately $13.9 million (2025).

California probate for estates with real property or assets over $184,500 (2025 threshold) requires formal court probate. California community property rules mean assets acquired during marriage are jointly owned and receive a full stepped-up basis at the first spouse’s death – a significant capital gains planning tool. Revocable living trusts are extremely common in California to avoid probate, particularly for real estate.
Montecito and high-value estate planning: Santa Barbara County has a disproportionate concentration of ultra-high-net-worth estates – Montecito alone is home to dozens of individuals with net worth above $50 million. The combination of California’s Prop 19 changes, federal estate tax exposure, charitable foundation structures, conservation easement planning (the Los Padres National Forest interface creates opportunities), and international trust planning makes Santa Barbara County one of the more complex estate planning markets in California.

Step 1: figure out which path applies
California recently increased its small-estate thresholds substantially, so check this first – more estates now qualify to skip full probate than in past years.
Small Estate Affidavit (personal property) – for estates with personal property valued at $208,850 or less (for deaths on or after April 1, 2025; holds through March 31, 2028). No court filing needed – present the signed affidavit directly to the bank or institution holding the property. Must wait at least 40 days after the death, and no probate proceeding can already be pending.
Petition to Determine Succession to Real Property, Primary Residence – for a decedent’s primary California residence valued at $750,000 or less (Judicial Council Form DE-310). Requires a 40-day wait, notice to heirs, and a probate referee appraisal.
Affidavit for Real Property of Small Value – for other (non-primary-residence) California real property valued at $69,625 or less (Form DE-305). Requires a 6-month wait.
Formal Probate – required when the estate exceeds these thresholds. California typically uses the Independent Administration of Estates Act (IAEA), letting the personal representative handle most matters without a court hearing for each step.
California is a community property state – a surviving spouse already owns their half of community property, and can often use a simplified Spousal Property Petition (Form DE-221) instead.
If using the small estate affidavit (personal property)
Wait at least 40 days after the death.
Confirm total qualifying California personal property (excluding trust assets, joint tenancy, POD/TOD accounts, and beneficiary-designated accounts) is $208,850 or less, using date-of-death values.
Complete the affidavit under Probate Code § 13100.
Present it with a certified death certificate directly to the bank or institution – no court filing required. Collecting property this way makes you personally liable for the decedent’s unsecured debts up to the value received (Prob. Code § 13109).
IF USING THE PRIMARY RESIDENCE PETITION OR SMALL REAL PROPERTY AFFIDAVIT
Confirm the property qualifies and the applicable waiting period has passed (40 days for the primary-residence petition; 6 months for the small real property affidavit).
File the petition (Form DE-310) or affidavit (Form DE-305) with the Santa Barbara County Superior Court.
A probate referee appraises the property; heirs receive notice.
Once approved, the property transfers without full probate administration.
If formal probate is required
Deliver the original will (if any) to the court clerk within 30 days of learning of the death (Prob. Code § 8200).
File a Petition for Probate (Form DE-111) to admit the will and request appointment as personal representative.
The court issues Letters Testamentary (Form DE-150) or Letters of Administration.
If Independent Administration authority is granted, the personal representative can act on most matters without separate court hearings.
Notice to creditors and an inventory/appraisal (with a probate referee) follow, along with payment of debts and taxes.
The estate closes with a final petition for distribution.
