About New London County
New London County is Connecticut’s southeastern maritime corner – a county whose history, economy, and identity are inseparable from the sea, the submarine, and one of the most impressive concentrations of federal military and educational institutions in New England.
Naval Submarine Base New London – in Groton, directly across the Thames River from New London – is the US Navy’s primary submarine base on the East Coast and home of the Submarine School (where all US submarine officers and enlisted are trained). The base is home to approximately 15,000 military and civilian personnel. General Dynamics Electric Boat – headquartered in Groton, with primary manufacturing at Groton and Quonset Point, Rhode Island – is the primary contractor for US Navy submarines and one of the largest defense employers in New England.
The United States Coast Guard Academy – in New London – is one of the five US federal service academies and the only one whose cadets are selected entirely by academic competition (no congressional nominations required). The Academy’s position on the Thames River and its role in training the officers of the Coast Guard give it a distinctive character among the service academies.
Mystic Seaport Museum – in Mystic – is the largest maritime museum in the United States, preserving a 19th-century seafaring village, historic vessels including the Charles W. Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Step 1: figure out which path applies
Connecticut probate law is set by the state legislature and applies uniformly everywhere – there is no county-by-county variation in thresholds, fees, or procedure, only in which of the 54 district offices you file with.
Small Estate Settlement (Affidavit in Lieu of Probate) – available when the decedent’s solely-owned personal property (not counting jointly-held or beneficiary-designated assets) totals $40,000 or less, and the decedent owned no Connecticut real estate outright (survivorship real estate is allowed). Filed using Form PC-212 (Affidavit in Lieu of Probate of Will/Administration), plus Form PC-212CI (confidential SSN information) and, if there are assets left to distribute after debts, Form PC-212A (Request for Order of Distribution). Unlike many states, this still requires filing with the probate court – Connecticut has no pure out-of-court affidavit process.
Full (Regular) Probate – required for estates above $40,000 in personal property, or that include solely-owned real estate.
If using the small estate process
Gather a certified death certificate and a list of the decedent’s solely-owned assets.
Complete Form PC-212, listing assets and confirming the decedent owned no solely-held Connecticut real estate.
File it with the probate district office for the town where the decedent lived, along with Form PC-212CI.
The court cannot act on the affidavit until at least 30 days have passed since it was received – there’s no minimum wait tied to the date of death itself, only to the filing date.
If the estate’s assets exceed its debts and there’s something left to distribute, file Form PC-212A as well, listing heirs and any beneficiaries under a will.
The court determines who inherits and issues its order. Small estate settlement typically takes just a few weeks from filing, versus 9+ months for regular probate.
If full probate is required
Connecticut law requires that any will be filed with the probate court in the decedent’s district within 30 days of death – this is mandatory even if you don’t plan to open probate right away, and failing to file it is a misdemeanor.
File a petition to open the estate with the probate district for the decedent’s town.
The court appoints an executor (if there’s a will) or administrator (if not) and issues a fiduciary certificate.
The fiduciary inventories assets, notifies creditors, pays valid debts and taxes, and files an accounting with the court.
Once approved, the estate is closed and assets are distributed to heirs and beneficiaries.
What it costs
Small estate settlement: court fees are based on estate value and can be as low as $25 for estates under $40,000.
Regular probate: fees scale with estate value under the statutory fee schedule (Conn. Gen. Stat. § 45a-107 et seq.).
No fixed statutory fiduciary compensation percentage – courts typically approve “reasonable” compensation.
Connecticut is one of the few states with BOTH a state estate tax and a state gift tax. The estate tax applies above roughly $13.61 million (2025 figure, adjusted periodically) at a 12% rate on the excess; Form CT-706/709 is due 9 months after death regardless of whether the estate owes tax.
