Idaho County
Cassia County, Idaho
City of Rocks National Reserve and the California Trail - from the City of Rocks National Reserve (the extraordinary granite spire landscape near Oakley - where 2.5-billion-year-old granite monoliths rise from the high desert floor in a labyrinthine city of stone - was one of the most described landmarks on the California Trail, where emigrants scratched their names in axle grease on the Register Rock and marveled at the stone city they passed through on their way to California) and Cassia County's significant potato and dairy production in the Magic Valley's eastern agricultural corridor.

ROADS & TRANSPORTATION
Roads: I-84 serves Burley, the county seat and largest city, next to the Snake River, part of the “Mini-Cassia” area with neighboring Minidoka County and the third-largest city in Idaho’s Magic Valley region.
Notes: Cassia County was created from Owyhee County on February 20, 1879, originally seated at Albion; an eastern portion split off to form Power County in 1913, and the county seat moved to Burley in 1918. The county is named for Cassia Creek, itself named either for John Cazier, a Mormon Battalion member and emigrant train captain, or for a native plant. Burley was founded in 1905, named for David Ellsworth Burley, a passenger agent for the Oregon Short Line Railroad who conceived the town’s development.
Business & Permits
BUILDING & PERMITS
Office: Cassia County Courthouse – Burley, ID.
Notes: Cassia County holds genuine national significance in Oregon Trail and geological history. The Oregon Trail ran along the county’s northern border, while the California Trail split off nearby at the “parting of the ways” where the Raft and Snake Rivers converge; approximately 230 miles of authentic emigrant wagon-train routes cross the county. The City of Rocks National Reserve (also called the “Silent City of Rocks”), a National Historic Landmark since 1964 and National Natural Landmark since 1974, protects granite spires and exposed granitic batholith rock as old as 2.5 billion years – among the oldest exposed rock formations in North America – and was a well-documented resting point for thousands of 1860s pioneers heading to Oregon or California. Nearby Castle Rocks State Park (1,692 acres) offers additional dramatic rock-climbing terrain. The historic Albion State Normal School campus, the original county seat’s centerpiece, remains a local landmark and now houses a museum.

About Cassia County
Cassia County is the City of Rocks and California Trail country – the extraordinary granite spire landscape that California-bound emigrants described in their journals and the Snake River Plain’s potato and dairy production define a south-central Idaho county of natural and historical distinction.
Burley (the county seat, population ~10,000) is the Magic Valley’s southeastern hub – the Snake River, potato processing, and dairy operations anchor a community between Twin Falls and the Utah border.

Step 1: figure out which path applies
Idaho has adopted the Uniform Probate Code (Idaho Code Title 15). Idaho is also a community property state. Idaho recognizes four main paths:
Small Estate Affidavit – a non-court process for estates with a total value of $100,000 or less (excluding liens and encumbrances) and no real property. Available 30 days after death. No court filing required (Idaho Code § 15-3-1201).
Summary Administration – available when the value of all the decedent’s property is less than the homestead allowance, exempt property, and last-illness medical expenses combined, or when a surviving spouse is sole beneficiary (Idaho Code §§ 15-3-1203, 15-3-1205).
Informal Probate – the most common track for uncontested estates, handled through the court registrar.
Formal Probate – court-supervised proceedings required when disputes arise or the will is contested.
Step 2: filing
For informal probate with a will, file an Application for Informal Probate of Will and Appointment of Personal Representative with the Magistrate Division.
For formal probate, file a Petition for Probate of Will and Appointment of Personal Representative (or the equivalent for intestate estates).
Idaho does not have a statutory fee schedule for attorneys or personal representatives – fees must be reasonable given the services rendered and complexity.
If formal or informal probate is needed
Determine whether small estate affidavit, summary administration, or full probate applies.
File the appropriate application or petition with the Cassia County Magistrate Court.
Under informal proceedings, the registrar reviews the application without a hearing. Under formal proceedings, a judge holds a hearing.
The personal representative accepts the appointment and may need to post a bond.
Once appointed, the court issues Letters Testamentary or Letters of Administration. Obtain several certified copies.
Publish notice to creditors as required.
Mail notice to all heirs, beneficiaries, and interested parties.
Marshal assets, obtain an EIN, open an estate account, pay valid debts and expenses, and prepare any required inventory.
Distribute remaining assets per the will or Idaho’s intestacy statutes, then close the estate.
What it costs
Idaho does not impose its own state estate or inheritance tax.
Idaho does not have a statutory fee schedule for attorneys or personal representatives.
Court filing fees and publication costs are separate – confirm current amounts with the Cassia County Magistrate Court.
Probate in Idaho typically takes 6-12 months for uncontested estates.
