Illinois County
Franklin County, Illinois
The Centralia Mine Disaster and southern Illinois coal heritage - from Franklin County's deep coal mining heritage (the county was one of Illinois's most productive bituminous coal counties for over a century - the mines employed thousands and shaped a working-class community culture of union solidarity and industrial danger) to the proximity to the 1947 Centralia Mine Disaster (the explosion that killed 111 miners became a landmark in American mine safety legislation) and Rend Lake's exceptional recreation in the Saline River watershed.

Notes: Franklin County was established January 2, 1818, formed from parts of Gallatin and White counties, named for Benjamin Franklin; Williamson County’s 1839 creation reduced Franklin to its present borders. The county seat moved north to Benton in 1841, named for Missouri Senator Thomas Hart Benton, on land donated by John Ewing and War of 1812 veteran Walter S. Akin.
Business & Permits
BUILDING & PERMITS
Office: Franklin County Courthouse – Benton, IL (current building 1875, $25,000, brick from the local “Boneyard Woods”; a new courthouse has more recently been built, per county announcements). The historic Franklin County Jail (209 W. Main Street, Benton, built 1905-1906, Classical Revival brick with limestone trim, architects J.R. Royer and R.Z. Gill; National Register of Historic Places since 1999) included an attached sheriff’s residence, allowing continuous prisoner supervision; it operated until 1990 and now serves as a historic museum via the Franklin County Historic Preservation Society.
Notes: Franklin County has a genuinely significant and, at times, tragic coal-mining history. Commercial coal mining began around 1889 (King Coal Mine); the industry drove a dramatic population boom between 1910 and 1920, from roughly 26,000 to 57,000 residents, with over 65% of the county’s population at its peak made up of immigrants drawn by mining work. The county’s coal seams’ high gas content led to a series of documented mining disasters between 1905 and 1968, including the 1905 Zeigler No. 1 explosion (about 50 deaths), the 1917 Old Ben Mine No. 11 explosion in Christopher (17 deaths), and the 1951 Orient No. 2 Mine explosion in West Frankfort, the deadliest in county history at 119 deaths. Active mining continues today at the M-Class Mining MC #1 Mine.

About Franklin County
Franklin County is southern Illinois’s coal heritage county – a bituminous mining community whose underground industry shaped generations of working-class families in Illinois’s Little Egypt region.
Benton (the county seat, population ~7,000) is a coal country courthouse town. The county’s underground mines produced enormous quantities of bituminous coal from the late 19th century through the 20th century, making Franklin County one of Illinois’s most economically significant coal producers.
Rend Lake – a 19,000-acre reservoir on the Big Muddy River – provides boating, fishing, and camping that have become economic assets as the coal economy declined.
West Frankfort (population ~8,000) was one of Illinois’s most active coal mining communities – the Old King Coal Festival celebrates this heritage annually.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Franklin County Circuit Clerk (Second Judicial Circuit) 100 Public Square, Benton, IL 62812 (618) 435-9800 Franklin County is in southern Illinois’ historic coal-mining region.
Step 1: figure out which path applies
Illinois has NOT adopted the Uniform Probate Code and is not a community property state – it follows common law property principles. Illinois probate is governed by the Probate Act of 1975 (755 ILCS 5/). Two main paths:
Small Estate Affidavit – for estates where personal property (excluding real estate) is valued at $150,000 or less (raised from $100,000 effective August 15, 2025), with no unresolved debts or claims and no real estate involved. No formal court probate is required.
Formal Probate (Independent or Supervised Administration) – required when the estate doesn’t qualify for the small estate affidavit. Most Illinois probate cases proceed under Independent Administration, letting the estate representative act without prior court approval for most routine actions.
Step 2: filing for formal probate
File the decedent’s original will (if one exists) with the Franklin County Circuit Clerk, where the decedent resided at death.
Petition the court to open the estate and appoint an executor (if there’s a will) or an administrator (if intestate).
The court issues Letters of Office (Letters Testamentary or Letters of Administration) appointing the representative.
Publish notice to creditors and unknown heirs as required by Illinois law.
Under Independent Administration, the representative marshals assets, pays valid debts and taxes, and distributes the remaining estate without needing court approval for each step.
File a final accounting or closing documents to formally close the estate.
What it costs
Illinois imposes its own state estate tax on estates valued above $4 million, with rates up to 16%. There is no Illinois inheritance tax.
Filing fees vary by county – confirm current amounts with the Franklin County Circuit Clerk.
Most uncontested probate proceedings in Illinois can be completed within about a year.
