About Winnebago County
Winnebago County is Illinois’s fourth most populous county outside the Chicago metro and the 238th most populous in the United States, covering 513 square miles of northern Illinois along the Rock River.
Rockford (population ~147,000, the county seat) is Illinois’s third largest city and one of the Midwest’s most complex post-industrial cities – a former manufacturing powerhouse whose economic decline since the 1970s and partial resurgence define its contemporary identity. Rockford was historically the screw capital of the world and a major producer of machine tools, furniture, and fasteners. The Schwinn bicycle company manufactured its iconic American bicycles here, and the city’s connection to BMX racing – through the Rockford-based BMX circuit development in the 1970s and 1980s – is a point of local pride.
Anderson Japanese Gardens – a 12-acre traditional Japanese garden in Rockford – is widely considered one of the finest Japanese gardens in North America outside of Japan, regularly ranked first in North America by the Journal of Japanese Gardening. Its presence is a remarkable cultural asset for a mid-sized Midwestern city.
The Burpee Museum of Natural History holds one of the most significant dinosaur fossil collections in the Midwest, including “Jane” – one of the most complete juvenile *Tyrannosaurus rex* specimens ever discovered.
Rockford’s aerospace and defense manufacturing sector has provided economic stability in the post-furniture and machine tool era – United Technologies (now Raytheon Technologies) and Woodward (aerospace fuel systems) are major employers.
Loves Park (population ~24,000) and Machesney Park (population ~24,000) are northern suburbs of Rockford along the Rock River with significant residential and commercial development.
OSF HealthCare Saint Anthony Medical Center and Mercyhealth provide the county’s two major hospital systems.
Heritage | Rockford is the third-largest city in Illinois and a major manufacturing center; Rockford has a deep Scandinavian heritage — Swedish and Norwegian immigrants built the city’s furniture and machine tool industries; the Midway Village Museum (exceptional living history museum); the Coronado Theatre (1927 — a stunning Spanish Baroque movie palace; a National Historic Landmark); Rock Cut State Park; Klehm Arboretum; the Ethnic Heritage Museum Outdoors | Rock Cut State Park (Rockford — outstanding fishing, swimming, camping, and mountain biking; two large lakes; one of the best urban state parks in Illinois); Kishwaukee River; Pecatonica River; Pierce Lake; Atwood Park; the 53-mile Pecatonica Prairie Path trail; Forest Preserves of Winnebago County (extensive system) Notable | Rockford is a gritty, resilient city that was once the “Screw Capital of the World” (fastener manufacturing) and later a major machine tool and furniture producer; it has faced significant economic challenge since manufacturing declined; the city has active revitalization efforts in the arts and downtown; the Discovery Center Museum (one of the finest children’s museums in the country); Burpee Museum of Natural History (excellent dinosaur exhibits — Jane, a juvenile T. rex, is a highlight); Tinker Swiss Cottage (a remarkable 1865 Swiss chalet-style home — National Historic Landmark); the Rockford Peaches (AAGPBL — immortalized in “A League of Their Own”); Rockford IceHogs (AHL — Blackhawks affiliate); University of Illinois College of Medicine at Rockford; Rockford University Library | Rockford Public Library — (815) 965-9511 | rockfordpubliclibrary.org

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Winnebago County Circuit Clerk 400 West State Street, Room 108, Rockford, IL 61101 (815) 319-4500
Winnebago County is home to Rockford, Illinois’ 3rd-largest city, on the Rock River in the state’s north.
Step 1: figure out which path applies
Illinois has NOT adopted the Uniform Probate Code and is not a community property state – it follows common law property principles. Illinois probate is governed by the Probate Act of 1975 (755 ILCS 5/). Two main paths:
Small Estate Affidavit – for estates where personal property (excluding real estate) is valued at $150,000 or less (raised from $100,000 effective August 15, 2025), with no unresolved debts or claims and no real estate involved. No formal court probate is required.
Formal Probate (Independent or Supervised Administration) – required when the estate doesn’t qualify for the small estate affidavit. Most Illinois probate cases proceed under Independent Administration, letting the estate representative act without prior court approval for most routine actions.
Step 2: filing for formal probate
File the decedent’s original will (if one exists) with the Winnebago County Circuit Clerk, where the decedent resided at death.
Petition the court to open the estate and appoint an executor (if there’s a will) or an administrator (if intestate).
The court issues Letters of Office (Letters Testamentary or Letters of Administration) appointing the representative.
Publish notice to creditors and unknown heirs as required by Illinois law.
Under Independent Administration, the representative marshals assets, pays valid debts and taxes, and distributes the remaining estate without needing court approval for each step.
File a final accounting or closing documents to formally close the estate.
What it costs
Illinois imposes its own state estate tax on estates valued above $4 million, with rates up to 16%. There is no Illinois inheritance tax.
Filing fees vary by county – confirm current amounts with the Winnebago County Circuit Clerk.
Most uncontested probate proceedings in Illinois can be completed within about a year.
