Roads & Utilities
ROADS & TRANSPORTATION
Roads: I-69 and SR-37/45/46 serve Bloomington, the county seat, about 50 miles south of Indianapolis in south-central Indiana’s rolling hills.
Notes: Monroe County was created by the Indiana General Assembly in 1818, named for President James Monroe, who was sitting president at the time. Bloomington was founded the same year by settlers from Kentucky, Tennessee, the Carolinas, and Virginia, who named it for its abundant “haven of blooms.”
Business & Permits
BUILDING & PERMITS
Office: Monroe County Courthouse – Bloomington, IN (current building dating from 1906, the third courthouse on the site, built of Indiana limestone).
Notes: Bloomington is genuinely home to Indiana University, one of the oldest and largest state universities in America, founded in 1820 as the State Seminary and opened in 1825; most university buildings, like the courthouse, are built of Indiana limestone quarried locally, the same stone used in the Empire State Building, the Smithsonian Institution, and the Pentagon. Monroe County also has a documented Underground Railroad history: the Covenanters, Scotch-Irish Presbyterians who settled outside Bloomington by 1821 and believed slavery a moral evil, provided a way station for people escaping enslavement during the Civil War era. During the 1870s, African American families settled in neighborhoods between 7th and 10th Streets and Lincoln and Grant Streets; well into the 20th century, Black IU students – barred from campus dormitories until the late 1930s – lodged with residents of this same neighborhood, a history now marked at the Monroe County History Center site.

About Monroe County
Monroe County is Indiana’s university and limestone county – Indiana University’s Jacobs School of Music making Bloomington one of America’s most musical small cities and the Bedford-Bloomington limestone that built the Empire State Building and the Pentagon define a county of cultural and geological distinction in Indiana’s rolling unglaciated south.
Bloomington (the county seat, population ~84,000) is Monroe County’s governmental hub on IN-37, a south-central Indiana university city whose IU campus, Lake Monroe recreation, limestone heritage, Hoosier National Forest access, and progressive college town character anchor its identity.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Monroe Circuit Court 301 North College Avenue, Suite 302, Bloomington, IN 47404 (812) 349-2615
Monroe County is home to Bloomington and Indiana University, the state’s flagship public university. The Monroe Circuit Court is a unified court with nine divisions, managed with one budget, an Office of Court Services, and a Probation Department.
Step 1: figure out which path applies
Indiana has NOT adopted the Uniform Probate Code – probate is governed by Indiana Code Title 29. Indiana offers several tracks depending on estate size and complexity:
Small Estate Affidavit – for estates where the gross probate estate (less liens, encumbrances, and funeral expenses) is $100,000 or less. Available 45 days after death. The affidavit must be signed and recorded with the county recorder’s office before a personal representative is appointed. No court filing is required.
Devolution of Real Estate Affidavit – a separate affidavit specifically for transferring real property, available 7 months after death, with no value limit on the real estate, recorded with the county recorder.
Unsupervised Administration – a simplified probate track available when the estate is solvent and all inheritors agree; fewer court appearances and filings than supervised administration.
Supervised Administration – full court oversight, used for contested, complex, or insolvent estates.
Step 2: filing for formal probate
File a Petition for Probate of Will and for Issuance of Letters (if there’s a will) or a Petition for Appointment of Personal Representative (if intestate) with the Monroe Circuit Court.
The court reviews the will for compliance with Indiana Code § 29-1-5-3 (in writing, signed by the testator, witnessed by at least 2 credible witnesses).
The court issues Letters Testamentary (with a will) or Letters of Administration (intestate) appointing the personal representative.
Publish notice to creditors; creditors generally have a limited window (commonly 3 months from first publication) to file claims.
The personal representative marshals assets, pays valid debts and expenses, and distributes the estate.
File a closing statement or final accounting to formally close the estate.
What it costs
Indiana does not have a state estate or inheritance tax.
Filing fees vary by county – confirm current amounts with the Monroe Circuit Court.
Indiana has no statutory fee schedule for attorneys or personal representatives – fees must be “reasonable” and are subject to court approval.
Typical timelines: Small Estate Affidavit – a minimum 45-day wait; Unsupervised Administration – roughly 6-9 months if uncontested; Supervised Administration – 9-12+ months.
