About St. Joseph County
St. Joseph County is defined by two stories that seem at first contradictory but are in fact deeply connected: the global reach of the University of Notre Dame and the local tragedy of the Studebaker Corporation’s collapse.
The University of Notre Dame (enrollment ~13,000 undergraduates, with substantial graduate and professional schools) is one of the most recognized universities in the world – its Fighting Irish football program is one of the most storied in college football history, and the Notre Dame Stadium (capacity 80,795, “The House That Rockne Built”) remains one of college sports’ most hallowed venues. Notre Dame’s academic reputation – particularly in business (Mendoza College of Business), law, and engineering – draws students from across the globe. The university is St. Joseph County’s largest employer and most powerful economic and civic force. Its endowment (~$22 billion) makes it one of the wealthiest universities in the United States.
The Studebaker Corporation – once one of America’s great automobile manufacturers, whose history stretched from horse-drawn wagons in South Bend in the 1850s to automobiles in the early 20th century – closed its South Bend plant in December 1963, putting 7,000 workers out of work nearly overnight. The closure was one of the most significant industrial shutdowns of the postwar era, sending South Bend into decades of economic decline. The Studebaker National Museum on the former factory site preserves an extraordinary collection of vehicles and corporate history. The sprawling former Studebaker factory complex – the Ignition Park – has been partially redeveloped as a technology and innovation hub.
South Bend’s recent reinvention attracted national attention during the 2020 presidential campaign of its former mayor, Pete Buttigieg, who served as South Bend’s mayor from 2012 to 2020 and became the first openly gay major-party presidential candidate. His tenure is credited with catalyzing significant downtown investment, the Smart Streets road diet project on downtown corridors, and the beginnings of a technology startup ecosystem anchored by Notre Dame’s commercialization pipeline.
Mishawaka – South Bend’s twin city on the St. Joseph River’s south bank – is the county’s second city and home to significant retail development along the University Park Mall corridor and manufacturing operations. The region is sometimes called Michiana – combining Michigan and Indiana – reflecting its position straddling the state border and drawing from both states’ economies.
County government is a Board of Commissioners (three members) and County Council with separately elected offices for the Assessor, Auditor, Circuit Court Clerk, Coroner, Recorder, Sheriff, and Treasurer.

The Indiana appeal process – Form 130:
File Form 130 – Taxpayer’s Notice to Initiate an Appeal with your local assessing official within 45 days of the tax bill mailing – typically a June 15 deadline. The appeal proceeds through three levels:
Level 1 – Informal conference with assessor: The assessor reviews property record card errors and market data comparisons. If resolved, both parties sign a Form 134 Joint Agreement.
Level 2 – Property Tax Assessment Board of Appeals (PTABOA): If unresolved, the PTABOA holds a formal hearing. Receive at least 30 days’ notice. Bring comparable sales data, an independent appraisal, or property condition documentation.
Level 3 – Indiana Board of Tax Review (IBTR): File Form 131 within 45 days of PTABOA determination. After IBTR, appeal to the Indiana Tax Court.

Notre Dame and academic estate planning: Notre Dame’s faculty, administrators, and research staff participate in TIAA and other private retirement plan providers through Notre Dame’s Optional Retirement Plan. The university’s extraordinary endowment supports a significant gift planning / planned giving program – Notre Dame receives substantial charitable bequests, charitable remainder trusts, and endowed scholarship gifts each year. Donors considering planned gifts to Notre Dame should engage both their personal estate planning attorney and Notre Dame’s gift planning office.
Studebaker legacy and manufacturing community: St. Joseph County’s older generation of retirees – many from the Studebaker era and subsequent manufacturing employers – may hold pension assets from the Studebaker-Packard pension plan, which famously failed when the company closed in 1963, leaving thousands of workers with reduced or eliminated pension benefits. This failure directly led to the passage of ERISA (Employee Retirement Income Security Act, 1974) – the federal law governing private pension plans. Studebaker’s failure is literally why ERISA exists.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
St. Joseph Circuit Court (includes a dedicated Probate Court) 101 South Main Street, South Bend, IN 46601 (574) 235-9551
St. Joseph County, founded 1830, is Indiana’s 5th-most-populous county, home to South Bend and the University of Notre Dame. The county’s court system includes a dedicated St. Joseph County Probate Court in addition to Circuit and Superior Courts.
Step 1: figure out which path applies
Indiana has NOT adopted the Uniform Probate Code – probate is governed by Indiana Code Title 29. Indiana offers several tracks depending on estate size and complexity:
Small Estate Affidavit – for estates where the gross probate estate (less liens, encumbrances, and funeral expenses) is $100,000 or less. Available 45 days after death. The affidavit must be signed and recorded with the county recorder’s office before a personal representative is appointed. No court filing is required.
Devolution of Real Estate Affidavit – a separate affidavit specifically for transferring real property, available 7 months after death, with no value limit on the real estate, recorded with the county recorder.
Unsupervised Administration – a simplified probate track available when the estate is solvent and all inheritors agree; fewer court appearances and filings than supervised administration.
Supervised Administration – full court oversight, used for contested, complex, or insolvent estates.
Step 2: filing for formal probate
File a Petition for Probate of Will and for Issuance of Letters (if there’s a will) or a Petition for Appointment of Personal Representative (if intestate) with the St. Joseph County Probate Court.
The court reviews the will for compliance with Indiana Code § 29-1-5-3 (in writing, signed by the testator, witnessed by at least 2 credible witnesses).
The court issues Letters Testamentary (with a will) or Letters of Administration (intestate) appointing the personal representative.
Publish notice to creditors; creditors generally have a limited window (commonly 3 months from first publication) to file claims.
The personal representative marshals assets, pays valid debts and expenses, and distributes the estate.
File a closing statement or final accounting to formally close the estate.
What it costs
Indiana does not have a state estate or inheritance tax.
Filing fees vary by county – confirm current amounts with the St. Joseph County Probate Court.
Indiana has no statutory fee schedule for attorneys or personal representatives – fees must be “reasonable” and are subject to court approval.
Typical timelines: Small Estate Affidavit – a minimum 45-day wait; Unsupervised Administration – roughly 6-9 months if uncontested; Supervised Administration – 9-12+ months.
