In 1867, the county was the site of a confrontation between the Cheyenne, Sioux, and General Winfield Scott Hancock’s forces at the Indian Village on Pawnee Fork, fighting later cited as having informed George Armstrong Custer’s tactics. The county was first organized in 1873, disestablished the following year, and permanently reorganized on April 14, 1880.

BUILDING & PERMITS
Office: Ness County Courthouse – Ness City, KS.
Notes: Ness City is home to a genuinely striking piece of Kansas architecture: the Ness County Bank Building, completed in 1890 and nicknamed the “Skyscraper of the Plains.” Designed by Topeka architect James Clinton Holland in the Richardsonian Romanesque style – echoing H.H. Richardson’s Marshall Field Warehouse in Chicago – the four-story, 18,700-square-foot limestone building was called “the finest and most imposing structure west of Topeka” upon completion, built largely by Civil War veterans who had migrated west and hand-carved and chiseled its stone. Distinctive features include four bank vaults (one finished in 22-karat gold leaf), brass fixtures with a sunflower motif, and a rare-for-its-time elevator shaft. Listed on the National Register of Historic Places in 1972 and rescued from a decade of vacancy by a dedicated preservation foundation in 1984, the building today houses the Ness County Chamber of Commerce and a local history exhibit, and is recognized as one of the official “8 Wonders of Kansas Architecture.”

About Ness County County
Ness County is west-central Kansas’s Skyscraper of the Plains and High Plains wheat county – the 1890 four-story limestone bank building rising incongruously from the flat treeless prairie and the winter wheat horizon define a remote community where Ness City serves the county’s farming families in the open west Kansas interior.
Ness City (the county seat, population ~1,300) is Ness County’s governmental hub on US 283, a west-central Kansas agricultural community whose Skyscraper of the Plains landmark, wheat economy, and courthouse anchor its identity.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Ness County District Court, 24th Judicial District 100 South Kansas Avenue (courthouse: 202 W Sycamore Street), P.O. Box 445, Ness City, KS 67560 (785) 798-3693
Ness County was founded February 26, 1867, named for Corporal Noah V. Ness of the 7th Kansas Cavalry. The 1917 Ness County Courthouse (Classical Revival) sits at 202 West Sycamore Street.
Step 1: figure out which path applies
Kansas has NOT adopted the Uniform Probate Code, maintaining its own statutory framework under the Kansas Probate Code (K.S.A. Chapter 59). Kansas offers several tracks depending on estate size and complexity:
Small Estate Affidavit – for estates where the total value of probate property, less liens and encumbrances, does not exceed $75,000 (raised from $40,000 effective July 1, 2023), available under K.S.A. 59-1507b. This transfers personal property only. If the decedent left a will, it must still be filed with the probate court even though it isn’t being formally probated.
Simplified Administration – under the Kansas Simplified Estates Act (K.S.A. 59-3201 et seq.), the most common route for straightforward estates.
Formal Probate – supervised or unsupervised administration through the District Court for larger or more complex estates.
A will must be filed for probate within 6 months of death, or it may not be admitted, forcing the estate into intestate distribution.
Step 2: filing for formal probate
File a Petition for Probate of Will and Appointment of Executor (if there’s a will) or a Petition for Administration (if intestate) with the Ness County District Court.
The court admits the will (if any) and appoints the personal representative.
Notice to creditors is published per court order; creditors have a defined window to file claims.
The personal representative inventories assets, pays valid debts and expenses, and – under unsupervised administration – acts with reduced court check-ins.
Without a surviving spouse or children, Kansas intestate succession law (K.S.A. 59-501 et seq.) determines which blood relatives inherit.
After debts are paid, the personal representative distributes assets and files a final accounting; the court closes the estate upon approval.
What it costs
Court costs may be remitted for small estates under recent statutory changes.
Executor/administrator and attorney fees are generally reasonable-fee based rather than a fixed statutory percentage.
Typical timelines: Small Estate Affidavit can proceed relatively quickly; formal probate commonly takes several months to over a year.
