Kansas County
Sumner County, Kansas
Caldwell - the Border Queen of the Chisholm Trail - from Caldwell's history as the last Kansas cattle town on the Chisholm Trail (from 1880-1885, Caldwell was the southernmost Kansas cattle shipping point - so close to the Oklahoma border that Texas longhorns barely crossed into Kansas - and its violent, wide-open character earned it the nickname "Border Queen" and "The Wickedest City in the West") to Wellington's Chisholm Trail Museum and Sumner County's position as one of the great wheat-producing counties of the Kansas plains.

BUILDING & PERMITS
Office: Sumner County Courthouse – 501 N. Washington Avenue, Wellington, KS.
Notes: Wellington and Sumner County genuinely hold the title “Wheat Capital of the World,” a designation dating to a bumper wheat harvest celebration in 1900. Mennonite immigrants who arrived from Europe in the 1870s planted the region’s first significant wheat crops, and Sumner County has since regularly produced more hard red winter wheat than any other county in the United States. The Kansas Wheat Festival, held annually in downtown Wellington the second week of July since that first 1900 celebration, was designated the state’s official Kansas Wheat Festival in 2012 and now draws crowds for a parade, carnival, car show, agricultural fair with wheat threshing and dairy cow milking demonstrations, and nightly free concerts. Sumner County’s proximity to Wichita – the “Air Capital of the World” – has also brought a growing aerospace and precision-machining manufacturing presence to Wellington in recent decades, alongside its enduring agricultural identity.

About Sumner County
Sumner County is south-central Kansas’s Chisholm Trail cattle town and wheat county – Caldwell’s reign as the Border Queen of the cattle trails and the county’s winter wheat production define a community at the heart of Kansas’s agricultural and frontier heritage.
Caldwell (population ~1,000) was the southernmost Kansas cattle shipping point during the Chisholm Trail era – its proximity to the Oklahoma border made it a haven for outlaws and gunfighters. The Caldwell Heritage Museum documents this turbulent period.
Wellington (the county seat, population ~8,000) is the county’s commercial hub and one of Kansas’s most productive wheat marketing communities.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Sumner County District Court, 30th Judicial District 500 North Washington Avenue, P.O. Box 399, Wellington, KS 67152 (620) 326-5936 Sumner County is on the Oklahoma border in south-central Kansas, seated in Wellington.
Step 1: figure out which path applies
Kansas has NOT adopted the Uniform Probate Code, maintaining its own statutory framework under the Kansas Probate Code (K.S.A. Chapter 59). Kansas offers several tracks depending on estate size and complexity:
Small Estate Affidavit – for estates where the total value of probate property, less liens and encumbrances, does not exceed $75,000 (raised from $40,000 effective July 1, 2023), available under K.S.A. 59-1507b. This transfers personal property only. If the decedent left a will, it must still be filed with the probate court even though it isn’t being formally probated.
Simplified Administration – under the Kansas Simplified Estates Act (K.S.A. 59-3201 et seq.), the most common route for straightforward estates.
Formal Probate – supervised or unsupervised administration through the District Court for larger or more complex estates.
A will must be filed for probate within 6 months of death, or it may not be admitted, forcing the estate into intestate distribution.
Step 2: filing for formal probate
File a Petition for Probate of Will and Appointment of Executor (if there’s a will) or a Petition for Administration (if intestate) with the Sumner County District Court.
The court admits the will (if any) and appoints the personal representative.
Notice to creditors is published per court order; creditors have a defined window to file claims.
The personal representative inventories assets, pays valid debts and expenses, and – under unsupervised administration – acts with reduced court check-ins.
Without a surviving spouse or children, Kansas intestate succession law (K.S.A. 59-501 et seq.) determines which blood relatives inherit.
After debts are paid, the personal representative distributes assets and files a final accounting; the court closes the estate upon approval.
What it costs
Court costs may be remitted for small estates under recent statutory changes.
Executor/administrator and attorney fees are generally reasonable-fee based rather than a fixed statutory percentage.
Typical timelines: Small Estate Affidavit can proceed relatively quickly; formal probate commonly takes several months to over a year.
