About Berkshire County
Berkshire County is the Berkshires – and the Berkshires are one of the most extraordinary concentrations of performing arts institutions per capita in the world, set in the rolling Appalachian landscape of western Massachusetts.
Tanglewood – the summer home of the Boston Symphony Orchestra (BSO), located on a hillside estate in Lenox – is the centerpiece of the Berkshire cultural landscape. The BSO has performed at Tanglewood since 1937; the venue draws hundreds of thousands of visitors annually for concerts under the iconic Koussevitzky Music Shed, open-air lawn concerts, and the Tanglewood Music Center (one of the world’s most prestigious summer music education programs for advanced students). Tanglewood’s opening weekend traditionally marks the Berkshires’ summer season.
MASS MoCA (Massachusetts Museum of Contemporary Art) in North Adams is one of the largest contemporary art museums in the world – occupying a vast 19th-century textile mill complex, with exhibition spaces capable of mounting the largest contemporary art installations on earth. Artists including James Turrell, Sol LeWitt, and Laurie Anderson have created major works for MASS MoCA. The museum’s transformation of North Adams from a declining mill town to an international arts destination is one of the most successful examples of arts-based economic development in American history.
Shakespeare & Company in Lenox, the Jacob’s Pillow Dance Festival in Becket (the oldest dance festival in America, a National Historic Landmark), the Williamstown Theatre Festival (one of the most respected summer theater programs in the country), the Clark Art Institute in Williamstown (with an extraordinary collection of French Impressionist paintings), and dozens of other galleries, theater companies, and music venues make the Berkshires an arts environment without parallel in rural America.
Pittsfield (the county seat, population ~42,000) is the county’s largest city – a post-industrial city built around General Electric’s former transformer manufacturing operations, which left significant PCB contamination in the Housatonic River and surrounding areas that has been a defining environmental and economic issue for decades.
Massachusetts counties have limited governmental functions. The county provides courts and the Registry of Deeds; most services are provided by municipalities or the state.

Massachusetts requires municipalities to assess property at 100% of full and fair cash value. Each of Berkshire County’s municipalities has its own assessors. Municipalities may adopt split tax rates (different rates for residential vs. commercial property).
Berkshire real estate dynamics: The Berkshires’ real estate market has two distinct components – the Pittsfield urban market (more modest values, traditional residential) and the southern Berkshire “cultural” market (Lenox, Stockbridge, Great Barrington, Williamstown – where summer home and arts-community demand has driven significant appreciation). Seasonal second homes in the southern tier have seen strong appreciation particularly post-2020.
The abatement process:
File an abatement application with your local board of assessors by February 1 of the fiscal year (Massachusetts fiscal years run July 1–June 30; the February 1 deadline applies to the current fiscal year). If denied, appeal to the Massachusetts Appellate Tax Board (ATB) in Boston within 3 months.
Massachusetts estate tax: Massachusetts imposes a state estate tax on estates above $2 million at rates up to 16%. For Berkshire County summer home owners – many of them Boston-area or New York professionals – the combination of a Berkshire property worth $1.5-3 million plus retirement accounts and investment portfolios can easily push an estate above the $2 million threshold.
Senior exemptions: Massachusetts offers several senior exemptions (Clauses 41, 41B, 41C, 17D) – apply through your local assessor.
OWNWELL CTA: Berkshire County’s February 1 abatement deadline is firm. Southern Berkshire summer home values have risen substantially – verify assessed values reflect comparable seasonal sales. Massachusetts estate tax at $2M affects most homeowners with meaningful retirement savings. Ownwell manages the abatement with no upfront cost.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Berkshire Probate and Family Court 44 Bank Row, Pittsfield, MA 01201 (413) 442-6941 Berkshire County is in western Massachusetts, seated in Pittsfield.
Step 1: figure out which path applies
Massachusetts adopted a version of the Uniform Probate Code (the Massachusetts Uniform Probate Code, or MUPC), codified largely at Mass. Gen. Laws c. 190B.
Voluntary Administration – the simplest path, for estates consisting entirely of personal property valued at $25,000 or less (not counting one motor vehicle). The decedent must have been a Massachusetts resident with no real estate solely in their name, at least 30 days must have passed since death, and no formal or informal probate petition can be pending. Filed using the Voluntary Administration Statement (Form MPC 170) – the filer becomes the Voluntary Personal Representative with no court hearing required. Filing fee is $115.
Informal Probate – the standard track for most straightforward estates, whether the estate has a will or not. A Magistrate reviews the petition administratively; an informal probate order can issue within about 7 days of filing, though the full case (including the required waiting and notice periods) typically closes in roughly 9 to 14 months.
Formal Probate – required when the will is contested, there’s uncertainty about who should serve as personal representative, or other disputes require a judge’s decision after a hearing.
Summary Administration – under c. 190B §3-1203, available when the estate’s value doesn’t exceed the family allowance, exempt property, funeral expenses, and expenses of the last illness – allows the personal representative to distribute the estate immediately without notifying creditors.
Step 2: filing for probate
Determine which track fits: gather the death certificate, will (if any), and a rough inventory of assets to see whether Voluntary Administration, Informal, or Formal Probate applies.
File the appropriate petition with the Probate and Family Court in the county where the decedent resided.
For informal proceedings, the Magistrate reviews and, if in order, appoints the personal representative and issues Letters without a hearing.
The personal representative gathers assets, provides required notices, pays valid debts and taxes, and distributes what remains to the heirs or beneficiaries – Massachusetts generally requires estates be probated within 3 years of death.
What it costs
Voluntary Administration filing fee: $115.
Informal and formal probate filing fees vary by estate type and are set by the Trial Court’s fee schedule.
Massachusetts does not require an attorney for probate, though many families use one for anything beyond a small, simple estate.
