Mississippi County
Marshall County, Mississippi
Holly Springs - antebellum mansions, 59 Civil War raids, and Ida B. Wells - from Holly Springs's extraordinary Civil War raid record (Holly Springs changed hands 59 times during the Civil War - more than any other city in the conflict - as Union and Confederate forces repeatedly swept through the north Mississippi railroad hub, and the town's antebellum mansions survived the constant military occupation largely intact) to Ida B. Wells's Holly Springs birthplace (the journalist, anti-lynching crusader, and civil rights pioneer was born enslaved in Holly Springs in 1862 - Wells's investigative journalism exposing the epidemic of lynching in the South made her one of the most courageous and consequential journalists in American history).

Notes: Marshall County is genuinely, significantly the birthplace of Ida B. Wells (born July 16, 1862), pioneering investigative journalist, anti-lynching crusader, women’s rights advocate, and co-founder of the NAACP – often called a founding figure of the modern civil rights movement. Her birth home, built by her father James Wells (a formerly enslaved carpenter), still stands and now houses the Ida B. Wells-Barnett Museum and Cultural Center of African American History; a U.S. post office in Holly Springs is named in her honor. Hiram Revels, the first African American elected to the U.S. Senate, settled in Holly Springs during Reconstruction, preaching and teaching at Shaw College (now Rust College, where Wells also studied), and is buried there. Holly Springs is also nationally recognized as a center of hill country blues, with a Mississippi Blues Trail marker honoring artists including Junior Kimbrough, Syl and Jimmy Johnson, and Big Daddy Kinsey; live hill country blues performances continue at venues like the FoxFire Ranch. The Marshall County Correctional Center, opened 1996, is a state-operated minimum/medium-security prison in Holly Springs with capacity for 1,076 inmates.

About Marshall County
Marshall County is north Mississippi’s most-raided Civil War city and Ida B. Wells birthplace county – Holly Springs changed hands 59 times during the Civil War and was the birthplace of America’s most courageous anti-lynching journalist, making it one of the most historically layered small cities in the South.
Holly Springs (the county seat, population ~7,500) preserves both legacies – the antebellum mansion pilgrimage and the Ida B. Wells Museum honor the city’s contradictory but essential historical heritage.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Marshall County Chancery Court P.O. Box 219, Holly Springs, MS 38635 (662) 252-4431 Marshall County is in northern Mississippi on the Tennessee border, seated in Holly Springs.
Step 1: figure out which path applies
Mississippi has not adopted the Uniform Probate Code and instead follows its own statutory framework under Miss. Code Ann. Title 91, Chapter 7. Mississippi’s small-estate threshold, at $75,000, is one of the lowest in the country, so most estates end up needing at least some court involvement.
Small Estate Affidavit (Miss. Code Ann. § 91-7-322) – personal property only, up to $75,000 (excluding liens and encumbrances). A 30-day waiting period after death applies. The affidavit is presented directly to whoever holds the property (a bank, for instance); that party is not required to investigate the truth of the affidavit and is protected from liability once it complies.
Muniment of Title (Miss. Code Ann. § 91-5-35) – a limited proceeding to transfer real property named in a will, without full administration, when the estate’s non-real-estate assets are $75,000 or less and all debts (including taxes) have been paid. A petition is still filed with the Chancery Court to declare the will valid; the will and court order are then recorded in the land records.
Formal Administration – required for most estates with real property beyond the muniment-of-title threshold or significant liquid assets. The Chancery Judge reviews the petition, the will (if any), and supporting documents before issuing Letters Testamentary or Letters of Administration appointing the personal representative.
Step 2: filing for probate
File a petition with the Chancery Court in the county where the decedent was domiciled.
The personal representative inventories assets and notifies creditors; Mississippi’s creditor claim period runs 90 days (Miss. Code Ann. § 91-7-145).
Claims and disputes are adjudicated by the Chancery Court if contested.
Once debts are settled and the creditor period closes, the estate can be distributed and closed.
What it costs
Costs are the Chancery Clerk’s per-county filing fee (built on the statewide base under Miss. Code § 25-7-9), plus recording fees and publication costs.
Mississippi has no state estate tax or inheritance tax. Only the federal estate tax could separately apply, and only to very large estates.
