Notes: Marion County is genuinely, world-famously the boyhood home of Mark Twain (Samuel Langhorne Clemens). Born in nearby Florida, Missouri in 1835, Clemens moved with his family to Hannibal in 1839 and lived there until 1853 – years that directly inspired his best-known works, “The Adventures of Tom Sawyer” and “The Adventures of Huckleberry Finn.” The Mark Twain Boyhood Home & Museum, 206-208 Hill Street, Hannibal, is a National Historic Landmark (designated 1962) opened to the public since 1912, encompassing the Boyhood Home itself, the Becky Thatcher House, the Huckleberry Finn House, an Interpretive Center, and a Museum Gallery holding 15 original Norman Rockwell illustrations and Twain memorabilia. Hannibal is officially nicknamed “America’s Hometown” and hosts National Tom Sawyer Days each Fourth of July, featuring whitewashing and frog-jumping contests. Separately, Palmyra’s historic 1858 Marion County Jail and Jailor’s House (NRHP-listed) is also known as the “Palmyra Massacre Jail,” having held ten men accused of being Confederate partisans who were executed by Union authorities on October 18, 1862 in reprisal for a missing Union supporter – an event now known as the Palmyra Massacre, presented here factually.

About Marion County
Marion County is northeastern Missouri’s Mark Twain literary heritage county – home to Hannibal, where Samuel Clemens grew up and found the characters, landscapes, and river life that became the foundation of American literature.
Hannibal (population ~17,000) is Missouri’s most visited literary destination. The Mark Twain Boyhood Home and Museum complex preserves the houses, fences, and streetscapes that inspired Tom Sawyer, Huck Finn, and the riverboat world Twain immortalized. Mark Twain Cave – where Tom and Becky got lost – is a significant attraction, and the annual Tom Sawyer Days celebration draws tens of thousands.
Palmyra (the county seat, population ~3,400) was the site of the Palmyra Massacre of October 1862 – the execution of ten Confederate prisoners ordered by Union General John McNeil in retaliation for the kidnapping of a Union loyalist, one of the Civil War’s most debated reprisal actions.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Marion County Circuit Court, Probate Division – TWO DISTRICTS
Marion County is unique among most third-class Missouri counties in having two separate county courthouses.
District 1 (Palmyra, official county seat): 100 S. Main Street, Suite 207, Palmyra, MO 63461, (573) 769-2550. Handles Round Grove, Union, Warren, Fabius, Liberty, and South River townships.
District 2 (Hannibal, largest city): 906 Broadway, Room 105, Hannibal, MO 63401, (573) 221-0198. Handles Miller and Mason townships.
Marion County was founded December 23, 1826, named for Francis Marion, in northeastern Missouri.
Step 1: figure out which path applies
Missouri probate is governed by Title XXXI of the Missouri Revised Statutes (Chapters 470-475), the Probate Code.
Small Estate Affidavit (RSMo § 473.097) – available when the entire estate, less liens and encumbrances, does not exceed $40,000. A 30-day waiting period after death applies, and only if no application for letters is pending. If the property listed is worth more than $15,000, the clerk must publish a notice to creditors in a newspaper of general circulation in the county. A bond may be required. Once the court issues a certified small estate certificate, the affiant presents it directly to whoever holds the property to collect and distribute assets – avoiding full probate. Typical timeline: about two months to close, versus six months to a year or more for full probate.
Formal Administration – required for larger or more complex estates. A petition for Letters Testamentary (with a will) or Letters of Administration (without one) is filed with the probate division. After review, the court appoints the personal representative and issues the letters. Missouri offers both supervised and independent administration. Missouri requires an attorney to represent the personal representative in both types of administration.
Step 2: filing for formal probate
File a petition with the Probate Division of the Circuit Court district covering the township where the decedent was domiciled.
The court appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes a notice to creditors in a newspaper of general circulation in the county, and gives direct notice to known creditors. Creditors have 6 months from the date of first publication to file claims.
Within 30 days of appointment (unless the court extends the deadline), the personal representative files an inventory and appraisement of all estate assets.
After debts are paid and the creditor claim period expires, the personal representative distributes the remaining assets and files a final settlement with the court to close the estate.
What it costs
Missouri sets statutory minimum fees for attorneys and personal representatives based on a percentage of the estate’s value, though additional fees may be allowed for extraordinary services.
Missouri has no state estate tax and no state inheritance tax. Only the federal estate tax could apply, and only to very large estates.
