Nebraska County
Dixon County, Nebraska
Ponca State Park's Missouri River bluffs and the Standing Bear legacy - from Ponca State Park (one of Nebraska's most dramatically scenic state parks - the park's Missouri River bluffs provide panoramic views of the river valley and the rolling Missouri hills of South Dakota, with hiking trails through the cedar-covered bluffs that represent some of the finest river bluff scenery in the northern Great Plains) to Chief Standing Bear's legacy (Standing Bear - the Ponca chief whose 1879 habeas corpus case established that Native Americans are "persons" under US law - fought for his people's right to return to their Nebraska homeland, and the Standing Bear Trail connects Niobrara to Ponca State Park in his memory).

PARKS & RECREATION
Key Assets: Dixon County is genuinely home to Ponca State Park, one of Nebraska’s premier river-bluff recreation areas, situated on roughly 2,100 acres of high bluffs and forested hills along the Missouri River, adjacent to the federally protected Missouri National Recreational River; the park and the town of Ponca take their name from the Ponca people, whose chief, Standing Bear, is genuinely a towering figure in American civil rights history – in the landmark 1879 federal case Standing Bear v. Crook, he successfully argued in a U.S. District Court in Omaha that Native Americans are “persons” within the meaning of the law, entitled to its protections, a groundbreaking ruling that predated broader federal recognition of Native American civil rights by decades; the park itself was established in 1934 on land donated under the sponsorship of the Ponca American Legion Post, with early development carried out by the Civilian Conservation Corps, and is noted today for its unusual biodiversity. Ponca is also considered one of the oldest settlements in Nebraska, and its historic downtown district, including the 1883-84 Dixon County Courthouse (later expanded in Art Deco style in 1939-40 following a heated county-seat rivalry with the town of Allen), is listed on the National Register of Historic Places
Notes: Dixon County’s Ponca genuinely carries the name and legacy of Chief Standing Bear, whose landmark 1879 court victory helped establish that Native Americans hold personhood under U.S. law, making it one of the more historically and civically significant counties found anywhere in this project.

About Dixon County
Dixon County is northeast Nebraska’s Ponca State Park and Chief Standing Bear legacy county – the 1879 case that established Native Americans as “persons” under US law originated with the Ponca people’s forced removal from this Missouri River homeland, and Ponca State Park’s bluffs preserve the landscape Standing Bear fought to reclaim.
Ponca (the county seat, population ~900) is the gateway to Ponca State Park – the river bluff scenery and the Standing Bear Trail draw visitors to this remote northeast Nebraska Missouri River community.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Dixon County Court, Probate Division 302 3rd Street (mail: P.O. Box 497), Ponca, NE 68770 (402) 755-5605
Dixon County was authorized in 1856 and organized in 1858, in northeastern Nebraska, seated in Ponca (though Wakefield is the county’s largest city). The 1883-84 Dixon County Courthouse, expanded 1939-40 with Art Deco features, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
Nebraska adopted the Uniform Probate Code, codified as the Nebraska Probate Code (Neb. Rev. Stat. Chapter 30). In Nebraska, the COUNTY COURT has exclusive original jurisdiction over probate matters.
Small Estate Affidavit (Neb. Rev. Stat. § 30-24,125 for personal property; § 30-24,129 for real property) – as of a July 2024 statutory amendment, available when personal property does not exceed $100,000 and real property does not exceed $100,000 (both thresholds raised from $50,000). At least 30 days must have passed since death, and no application or petition for a personal representative may be pending. For personal property, the affiant presents a notarized affidavit directly to the institution holding the property along with a certified death certificate. For real property, the affidavit is filed with the register of deeds in the county where the property is located.
Informal Probate – the most common path for uncontested estates, handled by the county court registrar with minimal judicial involvement.
Formal Probate – required when there’s no will, when a will’s validity is contested, or when there’s disagreement over the personal representative or how assets should be distributed. Handled by a county judge.
Step 2: filing for formal or informal probate
File an application (informal) or petition (formal) with the County Court in the county where the decedent resided.
The court appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors and gives direct notice to known creditors, who have a limited window from the date of first publication to file claims.
The personal representative inventories the estate’s assets and completes the required Probate Inventory Worksheet.
The personal representative completes and files any required Nebraska inheritance tax paperwork before the estate can be closed.
After debts, taxes, and expenses are paid, the personal representative distributes the remaining assets and closes the estate.
What it costs
Nebraska does not set statutory percentage-based fees; personal representative and attorney fees are generally based on reasonable compensation for time and services.
UNIQUE TO NEBRASKA: Nebraska is one of only six states with an inheritance tax, collected at the COUNTY level. Transfers to a surviving spouse are exempt; close relatives get reduced rates; more distant relatives and unrelated beneficiaries are taxed at higher rates.
No separate state estate tax.
