Key Assets: Kearney County’s Minden is genuinely home to one of the most extraordinary private museums in America – Harold Warp Pioneer Village, founded in 1953 by Chicago plastics manufacturer Harold Warp, who was born in a sod house near Minden as the youngest of twelve children of Norwegian immigrants. After returning home to find his childhood one-room schoolhouse being auctioned off, Warp bought it and began assembling what has grown into a sprawling 20-acre, 26-to-28-building complex housing over 50,000 historically significant items spanning 1830 to the present – everything from a genuine Pony Express station and frontier fort to trolley cars, a recently restored 1879 carousel (America’s oldest operating merry-go-round), and even a sugar bowl once belonging to President Lincoln; it has been called “the Smithsonian of the Plains.” The county seat of Minden itself has a genuinely colorful founding story: when Kearney County voters chose to move the county seat from the remote town of Lowell in 1878, county records were reportedly seized directly from the Lowell courthouse and used to establish Minden as the new seat. Kearney County is named for Fort Kearny, itself named for Brigadier General Stephen W. Kearny; the 1906-07 Kearney County Courthouse, designed by noted Nebraska architect George A. Berlinghof in the Classical Revival style, is listed on the National Register of Historic Places

Kearney County was founded in 1860, named for Fort Kearny, in south-central Nebraska, seated in Minden. The 1906-07 Kearney County Courthouse, Classical Revival in style, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
Nebraska adopted the Uniform Probate Code, codified as the Nebraska Probate Code (Neb. Rev. Stat. Chapter 30). In Nebraska, the COUNTY COURT has exclusive original jurisdiction over probate matters.
Small Estate Affidavit (Neb. Rev. Stat. § 30-24,125 for personal property; § 30-24,129 for real property) – as of a July 2024 statutory amendment, available when personal property does not exceed $100,000 and real property does not exceed $100,000 (both thresholds raised from $50,000). At least 30 days must have passed since death, and no application or petition for a personal representative may be pending. For personal property, the affiant presents a notarized affidavit directly to the institution holding the property along with a certified death certificate. For real property, the affidavit is filed with the register of deeds in the county where the property is located.
Informal Probate – the most common path for uncontested estates, handled by the county court registrar with minimal judicial involvement.
Formal Probate – required when there’s no will, when a will’s validity is contested, or when there’s disagreement over the personal representative or how assets should be distributed. Handled by a county judge.
Step 2: filing for formal or informal probate
File an application (informal) or petition (formal) with the County Court in the county where the decedent resided.
The court appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors and gives direct notice to known creditors, who have a limited window from the date of first publication to file claims.
The personal representative inventories the estate’s assets and completes the required Probate Inventory Worksheet.
The personal representative completes and files any required Nebraska inheritance tax paperwork before the estate can be closed.
After debts, taxes, and expenses are paid, the personal representative distributes the remaining assets and closes the estate.
