Roads & Utilities
ROADS & TRANSPORTATION
Roads: NE-92 and NE-58 serve Loup City, the county seat and largest city, in central Nebraska along the Middle Loup River Valley.
Notes: Sherman County was created in 1870 and organized in 1872-73, named for Civil War General William Tecumseh Sherman, who once commanded cavalry troops in Nebraska. Roughly 2,920-2,960 residents across 572 square miles of rolling hills sloping southeast. The county originated with a group of Grand Island men who organized a settlement plan for the Middle Loup River Valley, securing authority from Governor Robert Furnas in early 1873; the first official election, held April 1, 1873, drew just 13 votes. The county’s first courthouse (built for $5,000) burned down the very day commissioners accepted a bid to furnish it. Villages include Rockville, Ashton, Hazard, and Litchfield.

BUILDING & PERMITS
Office: Sherman County Courthouse – 630 O Street, Loup City, NE 68853; built 1920 in Beaux Arts style by Henningson Engineering Co., NRHP-listed 1990.
Notes: The Sherman County Courthouse lawn was genuinely the site of the historically documented “Loup City Riot” (also called the “Flag Day Riot”) on June 14, 1934 – a clash rooted in Depression-era farm distress and the Farm Holiday Movement, during which nationally prominent labor organizer Ella Reeve “Mother” Bloor and several associates were arrested and later tried and convicted of inciting a riot; the case drew national press coverage and marked the effective end of far-left farm-organizing efforts in Nebraska. The Sherman County Historical Society preserves period photographs, newspaper clippings, and artifacts related to the event, and a state historical marker on the courthouse lawn commemorates it today. The Sherman Dam and Reservoir, developed beginning in 1959 following the 1932 creation of the Middle Loup Power and Irrigation Company, remains an important local resource.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Sherman County Court, Probate Division 630 O Street (mail: P.O. Box 55), Loup City, NE 68853 (308) 745-1513
Sherman County was founded in 1870 and organized in 1872, named for Union general William Tecumseh Sherman, in central Nebraska, seated in Loup City – nicknamed the “Polish Capital of Nebraska.” The 1920 Sherman County Courthouse, Beaux Arts in style, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
Nebraska adopted the Uniform Probate Code, codified as the Nebraska Probate Code (Neb. Rev. Stat. Chapter 30). In Nebraska, the COUNTY COURT has exclusive original jurisdiction over probate matters.
Small Estate Affidavit (Neb. Rev. Stat. § 30-24,125 for personal property; § 30-24,129 for real property) – as of a July 2024 statutory amendment, available when personal property does not exceed $100,000 and real property does not exceed $100,000 (both thresholds raised from $50,000). At least 30 days must have passed since death, and no application or petition for a personal representative may be pending. For personal property, the affiant presents a notarized affidavit directly to the institution holding the property along with a certified death certificate. For real property, the affidavit is filed with the register of deeds in the county where the property is located.
Informal Probate – the most common path for uncontested estates, handled by the county court registrar with minimal judicial involvement.
Formal Probate – required when there’s no will, when a will’s validity is contested, or when there’s disagreement over the personal representative or how assets should be distributed. Handled by a county judge.
Step 2: filing for formal or informal probate
File an application (informal) or petition (formal) with the County Court in the county where the decedent resided.
The court appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors and gives direct notice to known creditors, who have a limited window from the date of first publication to file claims.
The personal representative inventories the estate’s assets and completes the required Probate Inventory Worksheet.
The personal representative completes and files any required Nebraska inheritance tax paperwork before the estate can be closed.
After debts, taxes, and expenses are paid, the personal representative distributes the remaining assets and closes the estate.
What it costs
Nebraska does not set statutory percentage-based fees; personal representative and attorney fees are generally based on reasonable compensation for time and services.
UNIQUE TO NEBRASKA: Nebraska is one of only six states with an inheritance tax, collected at the COUNTY level. Transfers to a surviving spouse are exempt; close relatives get reduced rates; more distant relatives and unrelated beneficiaries are taxed at higher rates.
No separate state estate tax.
