About Essex County
Essex County is among the most economically and demographically polarized counties in the United States – a 126-square-mile county where Newark, one of the poorest large cities in America, shares a county with Millburn, Short Hills, Montclair, Livingston, and North Caldwell, among the wealthiest communities in New Jersey. The county seat is Newark, New Jersey’s largest city and a major port and transportation hub. Essex County contains 22 municipalities and is governed by a seven-member Board of County Commissioners with an elected County Executive, County Clerk, Sheriff, Surrogate, and Prosecutor. Property assessment is at the municipal level – each of the 22 municipalities has its own assessor, and property tax rates, assessment ratios, and service levels vary dramatically from community to community.
Newark’s 2019 revaluation – the city’s first in decades – produced major shifts in assessed values across the city. Between full reassessments, the county applies equalization factors and the Board of Taxation oversees appeal hearings. The extraordinary gap between Newark’s median tax bill ($6,558) and North Caldwell’s ($29,932) illustrates the dramatic income stratification within a single small county.

New Jersey property tax is assessed at the municipal level – Essex County itself does not assess property. Each of the 22 municipalities has its own assessor who determines market value and sets the assessed value. The annual appeal deadline is April 1 (or 45 days from the mailing of assessment notifications, whichever is later). For municipalities recently revalued or reassessed – Cedar Grove, Glen Ridge, and Verona in 2026 – the deadline is May 1, 2026.
Appeal process:
Step 1: File a petition with the Essex County Board of Taxation, 495 Dr. Martin Luther King Jr. Blvd., Room 230, Newark, NJ 07102 (973-395-8525). Filing is by mail or in person only – no online filing. The Board of Taxation’s valuation date for appeals is October 1 of the pre-tax year (for 2025 tax year appeals, value is as of October 1, 2024). You must use 3-5 comparable sales from around that date as evidence; comparisons to other assessed properties are not accepted.
Step 2: If unsatisfied with the Board of Taxation decision, appeal to the New Jersey Tax Court within 45 days of the judgment. Properties assessed above $750,000 may bypass the county Board of Taxation and file directly with the Tax Court by April 1.
New Jersey’s Chapter 123 equalization ratio applies: if your assessment-to-true-value ratio exceeds the municipality’s average ratio by more than 15%, the Board automatically reduces your assessment. However, if your ratio falls below the common level, the Board can raise it – making thorough preparation essential before filing.
NJ property tax relief programs: New Jersey’s ANCHOR program provides direct relief to both homeowners and renters. The Senior Freeze (Property Tax Reimbursement) reimburses qualifying seniors 65 or older for property tax increases above a base year. The new Stay NJ program provides additional benefits for qualifying seniors. Apply through the NJ Division of Taxation (forms PAS-1). The 2025 application deadline is November 2, 2026.

The County Surrogate is an elected constitutional officer. No attorney is required for straightforward probate in New Jersey. The process typically takes under an hour and costs $100-$200. The 10-day waiting period after death is required before Letters Testamentary or Letters of Administration can be issued. Bring the original will, a certified death certificate with raised seal, and next-of-kin information.
New Jersey still has an inheritance tax even though the estate tax was eliminated in 2018. Class A beneficiaries (spouse, children, grandchildren, parents) are exempt. Class C (siblings, sons/daughters-in-law) pay 11-16%. Class D (all others) pay 15-16%. Federal estate tax applies above the current federal threshold. Step 1: figure out which path applies
New Jersey probate is governed by Title 3B of the New Jersey Statutes. The elected Surrogate’s Court in each county handles uncontested probate matters; contested matters are referred to the Superior Court, Chancery Division, Probate Part.
Affidavit of Surviving Spouse (N.J.S.A. 3B:10-3) – available only when the decedent died WITHOUT a will (intestate) and the total value of real and personal assets does not exceed $50,000. The surviving spouse, civil union partner, or domestic partner may file this affidavit with the Surrogate’s Court and receive the assets without formal administration. The first $10,000 of the estate is free from the decedent’s debts. There is no affidavit shortcut if a will exists – a will must always be probated regardless of estate size.
Affidavit of Next of Kin (N.J.S.A. 3B:10-4) – available only when the decedent died intestate, there is no surviving spouse/partner, and the estate does not exceed $20,000. One of the next of kin may file this affidavit with the written consent of all other heirs of equal or greater priority.
Regular (Formal) Probate – required whenever there’s a will, or when an intestate estate exceeds the small-estate thresholds above.
Step 2: filing for regular probate
File an Application for Probate with the Surrogate’s Court in the county where the decedent was domiciled (as soon as 10 days after death).
The Surrogate admits the will and issues Letters Testamentary, or – for intestate estates – appoints an administrator and issues Letters of Administration. A surety bond may be required for an administrator.
The Surrogate issues “short certificates,” which the executor/administrator uses as proof of authority – a certificate is typically needed for each asset that must be transferred or sold.
The personal representative notifies creditors and beneficiaries; New Jersey’s creditor claim period is 9 months from death.
The personal representative inventories assets, pays debts and taxes (including any New Jersey Inheritance Tax return, if applicable), and distributes the remaining assets according to the will or New Jersey’s intestacy statute.
The estate is closed with a final accounting filed with the court.
What it costs
Surrogate’s Court filing fees generally range from about $100 to $250 depending on the county and the complexity/value of the estate.
New Jersey does NOT require an attorney for probate, but one is commonly recommended for anything beyond the simplest estates.
UNIQUE TO NEW JERSEY: New Jersey has an INHERITANCE TAX that applies to transfers to “Class C” and “Class D” beneficiaries – nieces, nephews, friends, and other non-immediate relatives – even for relatively small inheritances; there is no minimum exemption threshold. Transfers to a spouse, civil union/domestic partner, parents, children, grandchildren, and stepchildren (“Class A” beneficiaries) are exempt.
New Jersey repealed its separate state ESTATE tax for deaths occurring on or after January 1, 2018 – only the inheritance tax remains at the state level.
