Key Assets: Allegany County holds a genuinely singular place in American energy history – the Seneca Oil Spring, located in what is now Cuba, New York, is believed to be the site of the very first written record of oil in North America, dating to 1627, when a French Jesuit missionary was led to the spring by local Seneca people, who had long prized the oil for medicinal purposes; more than two centuries later, the county became a genuine center of the American oil industry, and the 1881 discovery well on the Reading Farm near Richburg – which came in at 70 barrels on its first day – sparked a full-scale oil boom, drawing thousands of people into the valley within months and pushing county production above 6 million barrels that year alone; today, the Pioneer Oil Museum of Western New York in Bolivar documents this remarkable early petroleum heritage; Allegany County is also genuinely notable as the boyhood home of the Ingalls family of “Little House on the Prairie” fame, who lived in Cuba, New York, before moving west; the county was formed from three distinct historical land tracts – the Holland Land Company, the Morris Reserve, and the Phelps and Gorham Purchase – a distinction unique among New York counties; Alfred University, founded in 1836, is home to the New York State College of Ceramics and the legacy of Charles F. Binns, known as the “Father of American Ceramics,” whose collection is preserved at the university
Notes: Allegany County’s genuine claim to the first recorded discovery of oil in North America, paired with its later status as a major American oil boomtown region, makes it one of the more historically distinctive counties found anywhere in this project.

About Allegany County
Allegany County is New York’s most rural Southern Tier county – a Genesee River headwaters community whose internationally recognized ceramics university creates an unexpected center of artistic excellence in one of the state’s most economically challenged landscapes.
Alfred (population ~4,000 including students) is defined by Alfred University and its New York State College of Ceramics – a state college within a private university that has produced more ceramic artists than any comparable institution worldwide. Belmont (the county seat, population ~900) is one of New York’s smallest county seats – a modest Southern Tier community.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Allegany County Surrogate’s Court 7 Court Street, Belmont, NY 14813 (585) 449-3416
Allegany County was founded in 1806, named for the Lenape name for the Allegheny River, in western New York, seated in Belmont (though Wellsville is the county’s largest town). The original county seat was Angelica; the 1819 Old Allegany County Courthouse there is listed on the National Register of Historic Places.
Step 1: figure out which path applies
New York probate and estate administration is governed by the Surrogate’s Court Procedure Act (SCPA) and handled by the Surrogate’s Court in the county where the decedent was domiciled. New York has 62 counties, each with its own Surrogate’s Court.
Voluntary Administration / Small Estate Affidavit (SCPA Article 13) – available when the decedent’s PERSONAL property (not real property) has a gross value of $50,000 or less, excluding certain property automatically set aside for a surviving spouse or children under 21 (EPTL 5-3.1). Owning real property does NOT disqualify an estate from this process – only the personal property counts toward the $50,000 cap. The filing fee is just $1.00.
Probate – required when there’s a valid will and the estate exceeds the small-estate threshold or involves real property.
Administration – required when the decedent died intestate (no will); the Surrogate’s Court appoints an administrator following the statutory priority order under SCPA 1001.
Step 2: filing for probate or administration
File the will (if any) with the Surrogate’s Court in the county where the decedent was domiciled, along with a probate or administration petition.
The court issues Letters Testamentary (with a will) or Letters of Administration (without a will) to the appointed fiduciary.
The fiduciary notifies creditors and beneficiaries and inventories the estate’s assets.
Debts, expenses, and any required New York State Estate Tax are paid.
The fiduciary distributes the remaining assets according to the will or New York’s intestacy law and files a final accounting to close the estate.
What it costs
Voluntary Administration filing fee: $1.00.
Full probate/administration filing fees vary and generally scale with estate value.
UNIQUE TO NEW YORK: New York imposes its own separate state ESTATE TAX. For 2026, the New York basic exclusion amount is $7,350,000 – estates at or below that owe no state estate tax. New York has an unusual “cliff”: if the estate’s value exceeds the exclusion by more than 5% (over $7,717,500 in 2026), the ENTIRE estate becomes taxable from the first dollar. No portability between spouses. Rates range from about 3.06% to 16%.
New York has no separate state inheritance tax.
