Jell-O's LeRoy birthplace and the Holland Land Office - from LeRoy's Jell-O Museum (Jell-O was invented in LeRoy in 1897 by Pearle Wait and his wife May, sold to Orator Woodward for $450, and became one of the most successful consumer food products in American history - the Jell-O Museum in LeRoy tells this improbable story) to Batavia's Holland Land Office Museum (the land office through which millions of acres of western New York were sold to settlers after the American Revolution, making Batavia the commercial hub of the Genesee frontier) and Batavia Downs (one of America's oldest harness racing tracks, operating since 1940).

Key Assets: Batavia, Genesee County’s seat, is genuinely known as the “Birthplace of Western New York” – in 1801, surveyor Joseph Ellicott laid out the town as headquarters for the Holland Land Company, which had purchased 3.5 million acres covering most of present-day western New York from the Seneca Nation under the 1797 Treaty of Big Tree, a transaction known as the Holland Purchase; the surviving 1815 Holland Land Office building, where the company oversaw the survey, sale, and settlement of this enormous tract, is preserved today as the Holland Land Office Museum and is a genuine National Historic Landmark, the first designated in Western New York; the company’s activity from this office directly shaped the founding and growth of Buffalo, Rochester, and the surrounding region; Batavia is also home to the New York State School for the Blind, established by state legislation in 1865 and opening in 1868 on 50 acres donated by local citizens, making it one of the older institutions of its kind in the country; the city’s Batavia Downs, dating to 1940, is genuinely the oldest continuously operating lighted harness racing track in the United States
Notes: Batavia’s genuine status as the historic headquarters of the Holland Land Company – literally the “Birthplace of Western New York” – and home to one of the nation’s oldest schools for the blind, makes Genesee County one of the more foundational counties found anywhere in this project for the region’s development.

About Genesee County
Genesee County is western New York’s agricultural frontier heritage county – a community whose improbable contributions to American food history and land settlement include both the world’s most recognizable gelatin dessert and the land office that opened western New York to settlement.
Batavia (the county seat, population ~15,000) was the commercial center of the Holland Land Purchase – the 3.3 million acres of western New York sold by Dutch investors after the Revolution. The Holland Land Office Museum preserves the building and story of this critical land sale.
LeRoy (population ~7,000) is where Jell-O was invented in 1897 – sold for $450, the recipe eventually generated millions in sales for the Woodward family and later General Foods.
Batavia Downs Gaming – harness racing and video lottery terminals – is one of the county’s significant economic assets.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Genesee County Surrogate’s Court 1 West Main Street, Suite 200, Batavia, NY 14020 (585) 815-7817
Genesee County is in Western New York, seated in Batavia. The Genesee County Courthouse Historic District, including the 1841 Greek Revival courthouse, is listed on the National Register of Historic Places – Batavia is where the historic Holland Purchase’s administration was centered.
Step 1: figure out which path applies
New York probate and estate administration is governed by the Surrogate’s Court Procedure Act (SCPA) and handled by the Surrogate’s Court in the county where the decedent was domiciled. New York has 62 counties, each with its own Surrogate’s Court.
Voluntary Administration / Small Estate Affidavit (SCPA Article 13) – available when the decedent’s PERSONAL property (not real property) has a gross value of $50,000 or less, excluding certain property automatically set aside for a surviving spouse or children under 21 (EPTL 5-3.1). Owning real property does NOT disqualify an estate from this process – only the personal property counts toward the $50,000 cap. The filing fee is just $1.00.
Probate – required when there’s a valid will and the estate exceeds the small-estate threshold or involves real property.
Administration – required when the decedent died intestate (no will); the Surrogate’s Court appoints an administrator following the statutory priority order under SCPA 1001.
Step 2: filing for probate or administration
File the will (if any) with the Surrogate’s Court in the county where the decedent was domiciled, along with a probate or administration petition.
The court issues Letters Testamentary (with a will) or Letters of Administration (without a will) to the appointed fiduciary.
The fiduciary notifies creditors and beneficiaries and inventories the estate’s assets.
Debts, expenses, and any required New York State Estate Tax are paid.
The fiduciary distributes the remaining assets according to the will or New York’s intestacy law and files a final accounting to close the estate.
What it costs
Voluntary Administration filing fee: $1.00.
Full probate/administration filing fees vary and generally scale with estate value.
UNIQUE TO NEW YORK: New York imposes its own separate state ESTATE TAX. For 2026, the New York basic exclusion amount is $7,350,000 – estates at or below that owe no state estate tax. New York has an unusual “cliff”: if the estate’s value exceeds the exclusion by more than 5% (over $7,717,500 in 2026), the ENTIRE estate becomes taxable from the first dollar. No portability between spouses. Rates range from about 3.06% to 16%.
New York has no separate state inheritance tax.
