About Jefferson County
Jefferson County sits at the northeastern corner of New York State, where the St. Lawrence River – one of North America’s great waterways – forms the international boundary with Canada, and the Thousand Islands archipelago (actually 1,864 islands, by the traditional definition requiring at least one square foot of land above water and one tree) spans both sides of the border. The county’s position on Lake Ontario’s eastern shore gives it one of the most severe snowfall patterns in the eastern United States – the Great Lakes effect dumps extraordinary amounts of lake-effect snow on the Tug Hill Plateau to the county’s southeast, making Jefferson County one of the snowiest inhabited places in America.
Fort Drum – the largest military installation in the northeastern United States – is Jefferson County’s defining economic institution. Home of the 10th Mountain Division (the Army’s most deployed division since the end of the Cold War), Fort Drum employs tens of thousands of active-duty soldiers, civilian employees, and contractors, and its economic impact touches virtually every business in Watertown and the surrounding communities. The 10th Mountain Division has seen sustained combat deployments to Afghanistan, Iraq, and other theaters – Fort Drum families experience the full cycle of deployment and homecoming that shapes military community life.
Watertown (the county seat, population ~25,000) has a history disproportionate to its size. The five-and-ten-cent store was invented here – Frank Woolworth opened his first successful five-cent store in Watertown in 1878. The city also claims invention of the paper bag. Watertown’s Public Square has been the commercial center of the North Country for two centuries.
The Thousand Islands region on the county’s northern edge is a summer resort destination – Clayton, Alexandria Bay, and Cape Vincent draw boaters, anglers, and tourists to the St. Lawrence River. Grievance Day – May 25 deadline:
New York State’s annual assessment complaint process culminates on Grievance Day – the fourth Tuesday in May – which is the deadline to file a formal assessment complaint (Form RP-524) with your local Board of Assessment Review. STAR Exemptions: New York’s School Tax Relief (STAR) program provides a reduction in school property taxes for primary residence owners:
– Basic STAR: available to all primary residence homeowners with income under $500,000. Now administered as a rebate check (new applicants register with New York State, not the local assessor).
– Enhanced STAR: for homeowners age 65+ with income at or below $98,700 (2025 – adjusted annually). Apply through your local assessor by March 1.

Canadian citizens owning US real property are subject to US estate tax on the property’s value, and a Canadian probate proceeding does not automatically transfer title to US real property.

Step 1: figure out which path applies
New York probate and estate administration is governed by the Surrogate’s Court Procedure Act (SCPA) and handled by the Surrogate’s Court in the county where the decedent was domiciled. New York has 62 counties, each with its own Surrogate’s Court.
Voluntary Administration / Small Estate Affidavit (SCPA Article 13) – available when the decedent’s PERSONAL property (not real property) has a gross value of $50,000 or less, excluding certain property automatically set aside for a surviving spouse or children under 21 (EPTL 5-3.1). Owning real property does NOT disqualify an estate from this process – only the personal property counts toward the $50,000 cap. The filing fee is just $1.00.
Probate – required when there’s a valid will and the estate exceeds the small-estate threshold or involves real property.
Administration – required when the decedent died intestate (no will); the Surrogate’s Court appoints an administrator following the statutory priority order under SCPA 1001.
Step 2: filing for probate or administration
File the will (if any) with the Surrogate’s Court in the county where the decedent was domiciled, along with a probate or administration petition.
The court issues Letters Testamentary (with a will) or Letters of Administration (without a will) to the appointed fiduciary.
The fiduciary notifies creditors and beneficiaries and inventories the estate’s assets.
Debts, expenses, and any required New York State Estate Tax are paid.
The fiduciary distributes the remaining assets according to the will or New York’s intestacy law and files a final accounting to close the estate.

No portability between spouses. Rates range from about 3.06% to 16%.
