Ashe County, North Carolina
New River and Frescoes of Ashe County - from the New River National Scenic River (one of the oldest rivers on earth, the New River flows through Ashe County in an unusual north-flowing pattern through the Blue Ridge mountains - the river's ancient geology and scenic beauty earned it National Scenic River designation, and New River State Park provides canoeing, fishing, and camping along one of Appalachia's most scientifically significant waterways) to the Frescoes of Ashe County (artist Ben Long painted remarkable Renaissance-style frescoes in two tiny Ashe County Episcopal churches in the 1970s and 1980s - the life-size biblical frescoes in St. Mary's Church and Holy Trinity Church draw art pilgrims from around the world to these remote mountain chapels, creating one of Appalachia's most unexpected cultural destinations).

Key Assets: Ashe County is genuinely and officially “America’s Christmas Tree Capital” – the number-one Christmas tree-producing county in the entire United States; more than 12,000 acres across the county are devoted to Christmas tree farming, and its cool temperatures, high elevations, and fertile mountain soil provide an ideal natural environment for growing the FRASER FIR, the tree of choice for over 90% of North Carolina’s Christmas tree production and widely nicknamed “the Cadillac of Christmas trees” for its excellent needle retention, pleasant aroma, and sturdy branches; commercial Christmas tree farming in the region traces back to 1906, when a visionary Ashe County farmer named Martin Luther Church began selling wild-harvested trees from the county’s rugged hills – a modest start that has since grown into a major regional industry, with North Carolina today ranked the second-largest Christmas tree-producing state in the nation; a Fraser fir takes a patient 7 to 10 years of careful shaping and tending to reach market size; Ashe County’s crowning achievement in the industry is its remarkable track record supplying the OFFICIAL WHITE HOUSE CHRISTMAS TREE – North Carolina Fraser firs have been selected for the White House a record 16 times, more than any other state or tree species in the country, and 9 of those 16 selections have come from Ashe County alone; the honor works like a tournament: each year the North Carolina Christmas Tree Association holds a statewide contest, and the state’s Grand Champion Tree goes on to compete nationally against winners from other states for the ultimate prize of adorning the White House’s Blue Room; Ashe County’s Peak Farms, owned by father-son team Rusty and Beau Estes, has won this national honor multiple times, including presenting trees to the Bush White House in 2008 and more recently in 2021; the Upper Mountain Research Station, located in Ashe County and operated by NC State University, is home to the world’s most advanced Fraser fir seed orchard – an ongoing genetics research project developing “elite” Fraser fir strains with superior appearance, growth rate, and needle retention for the benefit of growers across the state
Notes: Ashe County’s genuine, officially recognized status as “America’s Christmas Tree Capital” – backed by a remarkable, documented record of 9 White House Christmas tree selections – is one of the most distinctive and nationally celebrated agricultural identities found anywhere in this project.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Ashe County Clerk of Superior Court – Estates Division 150 Government Circle, Suite 3100, Jefferson, NC 28640 (336) 219-1400
Ashe County was founded in 1799, named for Samuel Ashe, in the mountains of northwestern North Carolina, seated in Jefferson. The 1904 Historic Ashe County Courthouse, Beaux Arts in style, is listed on the National Register of Historic Places and now houses the Museum of Ashe County History.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
What it costs
Filing fees for full estate administration generally follow the statewide statutory schedule, which scales with the estate’s value.
North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
