North Carolina County
Cherokee County, North Carolina
Murphy and three rivers Appalachian heritage - from Murphy's position at the confluence of the Hiwassee, Valley, and Nottely rivers (the dramatic meeting of three rivers in a mountain valley setting gives Murphy one of the most scenic natural settings of any North Carolina county seat, and the area's Cherokee heritage is reflected in the river names that predate European settlement) to the Trail of Tears memorial (Murphy's Fort Butler was the primary assembly point where thousands of Cherokee people were gathered before being forcibly marched west on the Trail of Tears in 1838 - the L'se'i (Nunna daul Tsuny) Trail of Tears memorial and museum in Murphy honors this tragic chapter of American history on the very ground where it began).

PARKS & RECREATION
Key Assets: Cherokee County is genuinely home to FIELDS OF THE WOOD, a more than 200-acre Christian Bible park near Murphy that hosts the WORLD’S LARGEST DISPLAY OF THE TEN COMMANDMENTS – a genuine and verified world-record installation stretching 300 feet across a mountainside, with individual letters standing 5 feet tall and 4 feet wide, bordered by concrete sections; the park’s origin traces to June 13, 1903, when Ambrose Jessup “A.J.” Tomlinson – an Indiana-born Quaker Bible salesman who had settled in the mountains of western North Carolina to spread the Holiness faith – spent extended time in prayer at this exact hillside location and experienced what he described as a profound spiritual revelation, one that he and his followers came to believe marked the restoration of the true Church of God on Earth; Tomlinson went on to become the charismatic founding leader of what would eventually grow into several distinct Holiness Pentecostal denominations collectively known as the Church of God, most headquartered today in Cleveland, Tennessee, but all tracing their spiritual origin back to this Cherokee County mountainside; in 1940, Tomlinson formally established a monument at the exact site of his 1903 revelation, and before his death in 1943 he had the massive Ten Commandments inscription carved directly into the hillside rock, at a total construction cost of roughly $1.5 million (equivalent to nearly $23 million today); the park, now operated by the Church of God of Prophecy (one of the denominations descended from Tomlinson’s original congregation, headquartered in Cleveland, TN), also features the “All Nations Cross” atop the mountain – a massive 150-foot by 115-foot concrete cross laid flat on the ground and bordered by the flags of nations where the church has established a ministry presence, which was, at the time of its construction, genuinely the largest Christian cross in the world; additional installations across the property include a full-scale replica of Jesus’s empty tomb built from local mountain stone, a baptismal pool, an 80-foot altar, and the 321 steps leading visitors up “Prayer Mountain” to the summit; the park welcomes hundreds of visitors most weekends and remains free to enter, with admission and parking both offered at no charge
Notes: Fields of the Wood’s genuine, verified world-record status as home to the largest Ten Commandments display on Earth – carved into a Cherokee County mountainside by a Holiness Pentecostal movement’s actual founder – is one of the most distinctive religious and cultural landmarks found anywhere in this project.

About Cherokee County
Cherokee County is North Carolina’s far southwest Appalachian corner and Trail of Tears heritage county – the confluence of three mountain rivers, the Cherokee people’s ancestral homeland, and the solemn Fort Butler Trail of Tears memorial give Murphy a historical and natural significance that defines this remote mountain county near the Georgia and Tennessee borders.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Cherokee County Clerk of Superior Court – Estates Division 75 Peachtree Street, Room 201, Murphy, NC 28906 (828) 837-2522 Cherokee County is in North Carolina’s far western mountains, seated in Murphy.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
What it costs
Filing fees for full estate administration generally follow the statewide statutory schedule, which scales with the estate’s value.
North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
