North Carolina County
Madison County, North Carolina
Hot Springs and French Broad River old-time music - from Hot Springs (the small mountain resort town in Madison County sits along the French Broad River and Appalachian Trail - natural hot springs have drawn visitors since the 19th century and the town remains a beloved trail town and soaking destination for AT thru-hikers and weekend visitors) to Madison County's old-time music heritage (the county is considered one of the most authentic living repositories of Appalachian old-time music in America - traditional ballads, fiddle tunes, and banjo styles that trace directly to the Scots-Irish settlers of the 1700s are still played at community gatherings and have made Madison County a destination for folk music scholars and enthusiasts).

Key Assets: Madison County is genuinely and proudly home to HOT SPRINGS, the ONLY natural mineral hot spring town in the entire state of North Carolina and one of very few in the whole southeastern United States; the therapeutic 100+ degree mineral waters, which emerge from ancient rock at the confluence of the French Broad River and Spring Creek, were known and used for centuries by Cherokee people before European settlers formally “discovered” them in 1778 – pictographic evidence at nearby Paint Rock, roughly five miles down the French Broad River, is considered one of North Carolina’s best-known examples of authentic American Indian pictograph art, and local tradition holds that Cherokee people held spiritual ceremonies there tied to the springs’ believed healing properties; the springs quickly became a magnet for the “lame and the sick,” who traveled over the mountains seeking relief in the waters, and on March 19, 1791, William Nelson formally purchased the springs property for “two hundred pounds in Virginia currency,” beginning a long succession of hotel development; the resort’s fortunes soared further after completion of the Buncombe Turnpike in 1828, connecting Tennessee and South Carolina and channeling a steady stream of travelers directly through town; in 1837, Asheville businessman James Patton purchased the springs and built the opulent, 350-room Warm Springs Hotel, a grand property with towering pillars that employed, among others, a young clerk named Zebulon B. Vance – who would later go on to become North Carolina’s governor; subsequent owner James H. Rumbough further expanded the resort after the railroad finally reached town in 1882, cementing Hot Springs’ international reputation for its “magical healing waters”; despite repeated hotel fires and periods of abandonment over the decades – the original resort was destroyed and rebuilt multiple times – a Madison County local eventually rediscovered and restored the springs from the ground up, and today’s Hot Springs Resort and Spa offers visitors private outdoor mineral baths lining the riverbank, with unobstructed views of the French Broad River and surrounding Blue Ridge Mountains, alongside hiking access to the Appalachian Trail, which runs directly down the town’s main street (Bridge Street); Madison County is also nationally recognized for its deep traditional Appalachian ballad-singing heritage, carried forward by artists and scholars connected to families like the Hicks and Ritchie lines
Notes: Hot Springs’ genuine, extensively documented status as North Carolina’s only natural mineral hot spring – used by the Cherokee for centuries before becoming a nationally famous 19th-century resort town – is one of the most distinctive natural and cultural heritage sites found anywhere in this project.

About Madison County
Madison County is western North Carolina’s French Broad River old-time music and Hot Springs county – the authentic Appalachian musical traditions preserved in Madison County’s mountain communities, the Appalachian Trail’s passage through Hot Springs, and the French Broad River’s white water make this one of North Carolina’s most culturally and naturally distinctive mountain counties.
Marshall (the county seat, population ~900) is Madison County’s tiny governmental hub along the French Broad River, with Hot Springs serving as the county’s primary destination community and Mars Hill hosting Mars Hill University.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Madison County Clerk of Superior Court – Estates Division
Currently at temporary location: Madison County Extension Office, 258 Carolina Lane, Marshall, NC 28753 (mail: P.O. Box 217) (828) 649-2531 Madison County was founded in 1851, named for James Madison, in the mountains of western North Carolina, seated in Marshall (though Mars Hill is the county’s largest municipality). The 1907 Madison County Courthouse, Classical Revival in style, is listed on the National Register of Historic Places, part of the Marshall Main Street Historic District.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
What it costs
Filing fees for full estate administration generally follow the statewide statutory schedule, which scales with the estate’s value.
North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
