Key Assets: Adair County’s seat, Stilwell, genuinely and officially carries the title “Strawberry Capital of the World” – a designation proclaimed by the Oklahoma governor and state legislature in 1949; the honor traces back to the Great Depression era, when strawberries emerged as a major cash crop for the area, with local farmers cultivating over 2,000 acres of the fruit through the 1930s; in 1948, the Stilwell Kiwanis Club organized the first annual Strawberry Festival to celebrate and promote the crop, and it succeeded far beyond anyone’s expectations – the very next year, state officials made the “Strawberry Capital of the World” title official; while the strawberry industry itself has diminished considerably in Stilwell’s local economy since those early decades, the tradition of the festival has only grown stronger, now drawing more than 30,000 visitors annually to downtown Stilwell each May for free strawberries and ice cream, carnival rides, a rodeo, a 5K run, live music, and a parade that in its 75th-anniversary year in 2022 featured a record-breaking 100-plus floats; each spring, the crowned Strawberry Queen and Kiwanis leaders travel to the Oklahoma State Capitol for an official “Strawberry Day” celebration, honoring the more than 70-year-old legislative designation; visitors can also explore Adair Park, a 25-acre county-managed park with RV and primitive campsites, a 15-acre fishing pond, and picnic facilities, along with the 1929 Adair County Courthouse, the fourth building to serve the county in that role and a National Register of Historic Places listing since 1984

Adair County was founded July 16, 1907, named for the Adair family of the Cherokee tribe, in the eastern part of Oklahoma, seated in Stilwell – within the sovereign territory of the Cherokee Nation. The 1929-30 Adair County Courthouse, Art Deco in style, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
Oklahoma has NOT adopted the Uniform Probate Code, maintaining its own probate statutes under Title 58 of the Oklahoma Statutes. Probate cases are handled by the District Court in each of Oklahoma’s 77 counties.
Small Estate Affidavit (58 O.S. § 393) – available when the total value of probate personal property (not counting real estate) is $50,000 or less. At least 10 days must have passed since death. This process skips court entirely: the affidavit is signed, notarized, and presented directly to whoever holds the asset (a bank, for example), along with a certified death certificate. Real estate can never be transferred this way – even a small estate with real property still needs some form of court proceeding.
Summary Administration – available when the total probate estate does not exceed $200,000, or when the decedent has been dead more than 5 years, or lived outside Oklahoma. This is an abbreviated form of probate – still court-supervised, but faster and less expensive than full administration.
Regular (Full) Administration – the standard court-supervised process, required for larger or more complex estates, or wherever real property is involved and the shortcuts above don’t apply. A personal representative (executor or administrator) is formally appointed by the court.
Step 2: filing for administration
A Petition for Probate is filed in the District Court of the county where the decedent resided; if there’s a will, the original is filed with the petition.
The court sets a hearing date and requires notice be given to heirs and interested parties.
The court appoints a personal representative (executor if named in a will, administrator if intestate) and issues Letters Testamentary or Letters of Administration.
Creditors are notified; claims against the estate must be presented within the statutory period.
The personal representative inventories assets, pays valid debts and taxes, and distributes what remains according to the will or Oklahoma’s intestacy laws.
The estate is closed once a final accounting is filed and approved by the court.
