PARKS & RECREATION
Key Assets: Marshall County’s seat, Madill, sits on the shore of Lake Texoma, an 89,000-acre reservoir straddling the Oklahoma-Texas border on the Red River – one of only a few inland lakes in the United States that sustains a genuinely self-reproducing striped bass population, a fishery phenomenon so productive it triggers a dramatic spring “sand bass run” up the lake’s tributaries each year; Madill has celebrated this natural spectacle every year since 1963 with the National Sand Bass Festival, a free, week-long civic celebration around the town square that now draws more than 15,000 visitors annually to a town of roughly 4,000 permanent residents; the festival’s evening main stage has genuinely hosted touring Nashville recording artists over the decades, including John Michael Montgomery, Blake Shelton, Sawyer Brown, and John Conlee; festival activities include a Sand Bass Run, turtle races, a car show, a 3-on-3 basketball tournament, a talent contest, fishing tournaments, and a carnival; the 1913 Marshall County Courthouse, designed by architect Jewell Hicks – who also contributed to the design of the Oklahoma State Capitol – remains in active use and is listed on the National Register of Historic Places; the county is also home to the Museum of Southern Oklahoma in Madill and offers additional lakeside recreation at nearby Lake Texoma State Park and Raymond Gary State Park
Notes: Madill’s genuine, more than six-decade-old National Sand Bass Festival – built around a real and productive natural fish migration – is one of the most distinctive and long-running community celebrations found anywhere in this project.

About Marshall County
Marshall County is south-central Oklahoma’s Lake Texoma shoreline county – a Chickasaw Nation community whose northern lake access and striped bass fishing draw visitors and vacation property buyers from across the region.
Madill (the county seat, population ~4,000) serves the county’s governmental needs and the agricultural communities inland from the lake. The county’s economy balances traditional cattle and grain farming with the significant lake recreation and vacation home industry along the Texoma shoreline.
Kingston (population ~1,500) on Lake Texoma is the county’s primary lake community – marinas, fishing guides, and vacation rentals serve the enormous recreational demand generated by one of America’s largest and most productive fishing reservoirs.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Marshall County District Court 100 East Main Street, Madill, OK 73446 (580) 795-3220
Marshall County was created at statehood in 1907 from the former Pickens County of the Chickasaw Nation, in south-central Oklahoma, seated in Madill. The 1913 Marshall County Courthouse, designed by Jewell Hicks (who also contributed to the state capitol), is listed on the National Register of Historic Places.
Step 1: figure out which path applies
Oklahoma has NOT adopted the Uniform Probate Code, maintaining its own probate statutes under Title 58 of the Oklahoma Statutes. Probate cases are handled by the District Court in each of Oklahoma’s 77 counties.
Small Estate Affidavit (58 O.S. § 393) – available when the total value of probate personal property (not counting real estate) is $50,000 or less. At least 10 days must have passed since death. This process skips court entirely: the affidavit is signed, notarized, and presented directly to whoever holds the asset (a bank, for example), along with a certified death certificate. Real estate can never be transferred this way – even a small estate with real property still needs some form of court proceeding.
Summary Administration – available when the total probate estate does not exceed $200,000, or when the decedent has been dead more than 5 years, or lived outside Oklahoma. This is an abbreviated form of probate – still court-supervised, but faster and less expensive than full administration.
Regular (Full) Administration – the standard court-supervised process, required for larger or more complex estates, or wherever real property is involved and the shortcuts above don’t apply. A personal representative (executor or administrator) is formally appointed by the court.
Step 2: filing for administration
A Petition for Probate is filed in the District Court of the county where the decedent resided; if there’s a will, the original is filed with the petition.
The court sets a hearing date and requires notice be given to heirs and interested parties.
The court appoints a personal representative (executor if named in a will, administrator if intestate) and issues Letters Testamentary or Letters of Administration.
Creditors are notified; claims against the estate must be presented within the statutory period.
The personal representative inventories assets, pays valid debts and taxes, and distributes what remains according to the will or Oklahoma’s intestacy laws.
The estate is closed once a final accounting is filed and approved by the court.
What it costs
Filing fees vary by county – check with Marshall County directly for current fees.
Oklahoma has a statutory attorney fee schedule for probate, which provides more predictability than states without one.
No state estate tax, no state inheritance tax. Only the federal estate tax could apply, and only to very large estates.
