Key Assets: Deuel County is genuinely home to a remarkable and historically significant institution – the original SOUTH DAKOTA SCHOOL FOR THE BLIND, which operated in the small town of Gary from 1900 until 1961; the story began after Gary lost its status as the Deuel County seat to Clear Lake in 1895, prompting local advocate Doane Robinson – who would decades later become the very person credited with first proposing the idea of a mountain sculpture in the Black Hills that eventually became Mount Rushmore – to champion the idea of bringing a state “Blind Asylum” to Gary instead, using the town’s now-vacant former courthouse property; residents of Gary were genuinely instrumental in pursuing this effort, even offering their old courthouse building for the purpose, though the state’s Board of Charities and Corrections ultimately opted to construct an entirely new, purpose-built facility rather than adapt the old courthouse; the South Dakota School for the Blind formally opened its doors on March 1, 1900, becoming the 42nd such school for the blind established anywhere in the United States; over the following 25 years, the campus grew to include eight buildings in the Classical Revival style, including dormitories for boys and girls, an administration building, an auditorium, and several barns – the school was remarkably self-sufficient, keeping a large dairy herd along with hogs and chickens, and cultivating a substantial garden, producing milk, meat, eggs, and vegetables both for its own students and for sale to the surrounding community; by the late 1950s, however, concerns over the facility’s aging infrastructure and Gary’s remote, small-town location – far from the kind of urban travel experiences and nearby college opportunities that could benefit visually impaired students – led the state legislature to authorize relocating the school; the South Dakota School for the Blind and Visually Impaired moved to a new Aberdeen campus and began classes there on September 18, 1961, where it continues to operate today; the historic 11-acre Gary campus was listed on the National Register of Historic Places in 1988, and in 2009 the buildings were given a genuinely delightful second life, transformed by local wind-energy entrepreneur Joe Kolbach into the Buffalo Ridge Resort and Business Center – visitors today can walk the same network of tunnels that once allowed visually impaired students to move safely between buildings, and the resort’s namesake lake is actually a dammed section of Lac Qui Parle Creek, notably the only stream in eastern South Dakota cold and fast enough to naturally support trout

Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.

Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Deuel County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
