Key Assets: Hutchinson County is genuinely and deeply significant in the history of Mennonite and Hutterite settlement in the United States, having served as the “Mother Settlement” through which more than 100,000 Lutheran, Reformed, Baptist, German Congregational, Mennonite, and Hutterite immigrants ultimately found their way into the Dakota Territory beginning in the 1870s, fleeing religious persecution and revoked settlement privileges in Russia; the community of Freeman, in eastern Hutchinson County, became home to three genuinely distinct ethnic Mennonite communities – Low German, Swiss (“Schweitzer”), and Hutterite-background groups – each settling in close proximity while maintaining their own traditions; this rich heritage lives on today most visibly through SCHMECKFEST, Freeman’s beloved annual “festival of tasting,” which began almost by accident in March 1959 when the Freeman Junior College Women’s Auxiliary decided to serve traditional ethnic foods for the school’s 10th anniversary celebration; organizers, uncertain whether anyone in a community where “most people rarely ate out” would actually pay to sample foods they typically made at home, modestly planned for roughly 200 attendees – instead, the very first Schmeckfest drew more than 1,000 guests in a single evening, with only 49 workers and 15 waitresses scrambling to keep up with demand, particularly for fleisch kuechle (hamburger-filled dough pockets), the one dish that could be prepared quickly enough to meet the crowd; the event has been held every spring since, growing into a genuine community-wide cultural celebration that now draws more than 5,000 visitors annually and includes traditional food, craft demonstrations, historical presentations, and a full-stage musical theater production, with proceeds continuing to support Freeman Academy, the private Christian school descended from the original Freeman Junior College; a 1974 memorial marker in Freeman commemorates the hardships these early Swiss, Low German, and Hutterian Brethren immigrants endured – including brutal winters, grasshopper plagues, prairie fires, and drought – during their earliest years in Dakota Territory

Hutchinson County is in southeastern South Dakota, seated in Olivet – one of the smallest county seats in the country, established in 1871, with early county courts housed in a Methodist church before a permanent courthouse was built.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Hutchinson County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).
