Key Assets: Lincoln County’s seat, Canton, carries a genuinely charming piece of frontier-era folk geography in its own name; when the first Norwegian and American settlers arrived in the late 1860s, they named their new home “Canton” in the sincere belief that this particular spot on the South Dakota prairie sat directly opposite Canton, China (present-day Guangzhou) on the other side of the globe – the actual antipodal point is quite different, but the charming local legend has stuck ever since; by the summer of 1868, a caravan of 180 Norwegian settlers had crossed the Big Sioux River to make their home in the young community, which the City of Canton has since been recognized twice as South Dakota’s “Community of the Year” (2004 and 2011); the county is also genuinely home to Newton Hills State Park, a striking 1,063-acre glacial-formation outlier rising unexpectedly forested and hilly from the surrounding open prairie, six miles south of Canton; the park’s dense oak woodlands, home to more than 200 recorded bird species along with white-tailed deer and wild turkeys, sit atop land where archaeologists have discovered genuine Native American burial mounds and artifacts from the Woodland Indian Culture dated as far back as 300 BC to 900 AD; the park is named for William Newton, one of the area’s first European American settlers, whose wife served for years as the only person in the region with the skills to act as midwife and provide basic health care to the sick

About Lincoln County
Lincoln County’s growth story is simply Sioux Falls pushing south. The communities of Tea, Harrisburg, and Dell Rapids have absorbed enormous residential development as Sioux Falls has expanded beyond its Minnehaha County boundaries, and Lincoln County has experienced the fastest percentage population growth of any South Dakota county for most of the past twenty years. The appeal is straightforward: newer housing at lower prices than Sioux Falls proper, South Dakota’s favorable tax environment (no state income tax, no estate tax), and highway access to the Sioux Falls employment base.
The county seat of Canton is a traditional small South Dakota city with its own character separate from the Sioux Falls suburban fringe – its historic courthouse and Big Sioux River access give it a settled quality that the fast-growing southern communities lack. Lincoln County’s agricultural land – corn, soybeans, cattle – remains productive in its southern and eastern reaches, and the county has worked to manage the tension between agricultural land preservation and residential development pressure with varying success.

Lincoln County was founded December 30, 1867, named for Abraham Lincoln, in southeastern South Dakota, seated in Canton – the state’s third most populous county (largest city Sioux Falls, whose southern portion extends into the county).
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Lincoln County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).

South Dakota has NO state estate tax and NO state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
