Key Assets: Roberts County is genuinely home to the JOSEPH N. NICOLLET TOWER AND INTERPRETIVE CENTER, a striking 75-foot observation tower rising from the high point of the Coteau des Prairies plateau west of Sisseton, from which visitors can see all the way into South Dakota, North Dakota, and Minnesota, along with eleven communities and the Continental Divide on a clear day; the tower honors French cartographer Joseph N. Nicollet, who was contracted by the U.S. Topographical Corps in the 1830s to produce the first accurate map of the region between the Mississippi and Missouri rivers; in August 1839, Nicollet’s expedition ascended the roughly 800-foot rise to the summit of the Coteau des Prairies – a name Nicollet himself coined, French for “slope or hill of the prairie” – and he later wrote admiringly of the “imposing mass” of the landscape, calling it “the Alps of this area”; genuinely committed to accuracy and cultural respect, Nicollet spent weeks studying the Coteau and building relationships with the local Sisseton people, deliberately incorporating their own place names into his maps rather than imposing new ones – work that became the foundation many original Native place names in the region are still traced back to today; sadly, Nicollet fell ill and died in Washington, D.C. in 1843, less than four years after leaving the Dakota prairie for the last time, shortly before his final report was published; today’s tower and its Interpretive Center, which displays artwork depicting Nicollet’s expedition and a replica of his original “mother map,” were built entirely through private funding – genuinely, the roughly $335,000 project used no federal, state, or county money whatsoever, funded instead entirely by donations from seven local community members, all of whom were over the age of 70 at the time; the tower and its free Interpretive Center remain open to the public today, with the tower itself climbable year-round from sunrise to sunset
Notes: The Nicollet Tower’s genuine, community-funded origin story – honoring a mapmaker who took unusual care to preserve Native place names – makes it one of the most thoughtfully constructed landmarks found anywhere in this project.

Roberts County is in the northeastern corner of South Dakota, seated in Sisseton. The county overlaps portions of the Lake Traverse Indian Reservation, home of the Sisseton-Wahpeton Oyate.
Step 1: figure out which path applies
South Dakota HAS adopted the Uniform Probate Code (Articles I, II, III, IV, and VIII, effective July 1, 1995). Probate proceedings are handled by the Circuit Court in the county where the decedent lived, generally administered under the supervision of the Clerk of Courts.
Small Estate Affidavit – Collection of Personal Property (SDCL § 29A-3-1201) – available when the total gross value of the entire estate, wherever located, less liens and encumbrances, does not exceed $50,000. At least 30 days must have passed since death, no petition for appointment of a personal representative is pending or has been granted anywhere, and the decedent had no outstanding debts to the Department of Social Services for medical assistance or institutional/nursing home care. A separate affidavit exists for South Dakota real estate under $50,000, which must also be filed with the Register of Deeds where the property sits.
Informal Probate – the most common track in South Dakota, used when heirs and beneficiaries are getting along and no disputes are expected.
Unsupervised Formal Probate and Supervised Formal Probate – for more complex or contested situations.
Step 2: filing for administration
The personal representative (or an interested party) files an application or petition with the Clerk of Courts in Roberts County, along with the original will if one exists.
For informal probate, the clerk reviews the application administratively and issues Letters Testamentary or Letters of Administration without a hearing in most cases.
Formal proceedings require notice to interested parties and, if contested, a hearing before the circuit judge.
The personal representative gathers and inventories assets, notifies creditors, and pays valid debts and expenses.
After debts and taxes are satisfied, remaining assets are distributed according to the will or South Dakota’s intestacy statutes (SDCL Chapter 29A-2).
The estate is formally closed by filing a sworn closing statement or a petition for formal order of discharge (SDCL § 29A-3-1003).
