About Hamilton County
Chattanooga’s transformation from a struggling post-industrial city to one of the South’s most celebrated mid-sized success stories is one of the most studied urban revival narratives in American planning and economic development. The city that had the distinction of being named the most polluted city in America by the federal government in 1969 – when its steel mills, foundries, and chemical plants produced air so toxic that headlights were needed at noon – has become a model for urban reinvention through environmental cleanup, strategic infrastructure investment, and placemaking.
The Tennessee River gorge that defines Chattanooga’s geography – where the river bends through the Moccasin Bend and the mountains close in from both sides – is both the city’s greatest natural asset and the feature that historically constrained its growth. Lookout Mountain rises 1,700 feet above the city’s southern edge, home to Rock City (the iconic roadside attraction with the “See Rock City” barn roof signs), Ruby Falls (the underground waterfall), and the Incline Railway (the world’s steepest passenger railway). Signal Mountain on the north and Missionary Ridge to the east complete the scenic enclosure.
The Civil War Battle of Chattanooga (November 1863) – culminating in the dramatic Battle Above the Clouds on Lookout Mountain and the charge up Missionary Ridge – was one of the war’s pivotal Union victories. The Chickamauga and Chattanooga National Military Park (the nation’s oldest and largest military park) preserves the battlefield landscape on both sides of the Tennessee-Georgia border.
Volkswagen’s Chattanooga Assembly Plant (opened 2011, expanded 2022) produces the Atlas and Atlas Cross Sport and employs thousands of direct workers and many more in the supply chain – part of a wave of German and international automotive investment in the South. The Tennessee Aquarium on the riverfront is one of the most visited freshwater aquariums in the world. Gig City – Chattanooga’s municipal gigabit fiber network, one of the first in the US – has seeded a technology and remote-work economy.
County government is a nine-member County Commission with a County Mayor. Separately elected: Assessor of Property, Circuit Court Clerk, County Clerk, Register of Deeds, Sheriff, and Trustee (Treasurer).

Tennessee assesses residential property at 25% of appraised value. Hamilton County’s most recent countywide reappraisal was 2024 – all property values were reset to market value as of January 1, 2024. These 2024 values govern taxes for approximately 4-5 years until the next mandated reappraisal.
The Hamilton County Assessor of Property (625 Georgia Avenue, Room 203, Chattanooga, 423-209-7300) is responsible for maintaining property values between reappraisals based on new construction or significant changes.
The appeal process:
First, contact the Hamilton County Assessor’s office for an informal review – many errors in property description, square footage, or condition can be corrected without a formal appeal.
For a formal appeal, file with the Hamilton County Board of Equalization (BOE) – the deadline is approximately May 31 (confirm the exact date with the Assessor, as it may shift slightly year to year). The Board reviews comparable sales and assessor evidence.
If unsatisfied with the BOE’s determination, appeal to the Tennessee State Board of Equalization in Nashville, then to the Tennessee Assessment Appeals Commission, and ultimately to the courts.
Reappraisal year opportunity: The 2024 reappraisal reset all values. The most important time to appeal is now – a successful appeal in a reappraisal year locks in the lower value for the full 4-5 year cycle.
Tennessee has no state estate tax (phased out and eliminated 2016) and no state inheritance tax. No Tennessee income tax on wages. Vehicle property taxes paid separately.
OWNWELL CTA: Hamilton County’s 2024 reappraisal reset all values – appeal before the May 31 BOE deadline to potentially lock in savings for 4-5 years. Comparable sales from your immediate neighborhood carry the most weight. Tennessee’s full tax advantage package – no income tax, no estate tax, no inheritance tax, low property taxes – is exceptional. Ownwell manages the appeal with no upfront cost.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Clerk and Master, Hamilton County 625 Georgia Avenue, Chattanooga, TN 37402 (423) 209-6600 Hamilton County is in southeastern Tennessee, seated in Chattanooga.
Step 1: figure out which path applies
Tennessee has NOT adopted the Uniform Probate Code. Instead, Tennessee uses its own common form and solemn form probate framework, governed by Title 30 of the Tennessee Code Annotated. In Hamilton County, the Chancery Court (Probate Division), served by the Clerk and Master, administers probate.
Small Estate Affidavit (T.C.A. §§ 30-4-101 through 30-4-103) – available when the value of the probate estate does not exceed $50,000 (personal property; real property is generally excluded). The affidavit can be filed no sooner than 45 days after death. A bond payable to the state is commonly required to protect creditors and other heirs, though it is often waived when the person filing is the estate’s sole heir/beneficiary, or when all heirs consent in writing.
Common Form Probate – the standard, uncontested path: the will (if any) is admitted to probate without formal notice to all interested parties, and the personal representative is appointed and issued Letters Testamentary (with a will) or Letters of Administration (without a will).
Solemn Form Probate – used when formal proof of the will’s validity is needed, typically because of an anticipated will contest; requires notice to all interested parties and a hearing.
Muniment of Title – used to transfer real estate when there is a valid will but no other assets requiring administration.
Step 2: filing for administration
The personal representative (or an interested party) files the original will (if one exists) and a Petition to Probate Will or Petition for Letters of Administration with the Hamilton County Chancery Court (Probate Division).
The court issues Letters Testamentary (testate) or Letters of Administration (intestate), giving the personal representative authority to act.
The personal representative publishes notice to creditors in a local newspaper; creditors generally have a limited window (commonly around 4 months from the notice) to file claims.
The personal representative inventories and appraises the estate’s assets (may be waived by the will or by all beneficiaries).
The personal representative pays valid debts, expenses, and taxes.
The estate is closed with a final accounting (unless waived) and distribution to beneficiaries or heirs.
What it costs
Filing fees in Hamilton County are approximately $231.00 for opening an estate; confirm current fees directly.
Tennessee has no statutory fee schedule for attorneys or executors – fees must be “reasonable” and are subject to court approval if contested.
Tennessee does NOT impose a state estate tax or a state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
Typical timeline for a simple, uncontested estate: roughly 6-9 months.
