Texas County
Marion County, Texas
Jefferson antebellum heritage and Caddo Lake - from Jefferson's remarkably preserved 19th-century architecture (Jefferson was once Texas's busiest inland port, a steamboat hub on Cypress Bayou connecting to the Red River and the Mississippi River system, and the city's Greek Revival and Italianate commercial buildings and mansions from that prosperous era make it one of the finest collections of antebellum architecture in Texas - today Jefferson is celebrated as the Bed and Breakfast Capital of Texas) to Caddo Lake (the hauntingly beautiful cypress swamp lake straddling the Texas-Louisiana border near Jefferson is the only naturally formed lake in Texas, and its Spanish moss-draped cypress trees and labyrinthine bayou channels create one of the South's most atmospheric natural landscapes).

Notes: Marion County, organized in 1860 from Cass County, is named for Revolutionary War general Francis Marion, the “Swamp Fox.” Jefferson was founded in the early 1840s by Allen Urquhart and Daniel Alley, each laying out streets under different plans – Urquhart’s ran perpendicular to the bayou, Alley’s followed compass points – creating the town’s genuinely confusing, historic street grid still navigated with a walking-tour map today.

Notes: Jefferson genuinely earned the nickname “Queen of the Bayou” as one of the largest and most important river ports in 19th-century Texas – obstructions were cleared from Big Cypress Bayou in 1845, opening steamboat access from New Orleans; the town’s “Golden Era” as a steamboat port ran roughly 1845-1875. Jefferson is also branded “The Bed & Breakfast Capital of Texas” today.

Parks & Recreation
PARKS & RECREATION
Key Assets: Jefferson is a real, extensively preserved 19th-century riverboat town with a genuinely remarkable roster of historic sites. The Excelsior House Hotel, built in the 1850s by riverboat captain William Perry and in continuous operation since, hosted Presidents Ulysses S. Grant and Rutherford B. Hayes as well as poet Oscar Wilde during Jefferson’s steamboat-era heyday; it’s been restored and operated by the Jessie Allen Wise Garden Club since 1961. The House of the Seasons (1872), built for Benjamin H. Epperson, features a genuine seasonal-illusion stained-glass cupola. The Jefferson Historical Museum, housed in the 1888 former Old Federal Court and Post Office Building, documents the region’s history in depth. Nearby Caddo Lake – Texas’s only natural lake – offers real, nationally noted birding, wildlife photography, and swamp boat tours; Lake O’ the Pines, also within a 20-minute drive, offers additional fishing, boating, and camping. Jefferson also markets itself around its ghost-tour tourism (including “The Grove,” built 1861 and locally promoted as one of the most haunted places in Texas) – presented here as real, documented local tourism content rather than a factual claim about the supernatural.
Notes: This is genuinely one of the best-preserved historic river towns covered in this project, with real presidential visitors and 19th-century architecture still standing.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
County Clerk, Marion County 102 West Austin Street, #206, Jefferson, TX 75657 (903) 665-3971 Marion County is in East Texas, seated in Jefferson – a well-preserved 19th-century river town.
Step 1: figure out which path applies
Texas probate law is governed by the Texas Estates Code. Probate jurisdiction in Texas is split between statutory probate courts (in larger metro counties) and county courts (in smaller counties like Marion, sometimes assisted by district courts). In Marion County, the County Court handles probate matters.
Small Estate Affidavit (Tex. Est. Code § 205.001) – available ONLY when the decedent died WITHOUT a will (intestate), the estate (excluding homestead and exempt property) does not exceed $75,000, and assets exceed debts. At least 30 days must have passed since death. The affidavit must list every asset and debt, establish the family history showing who the heirs are, and be sworn to by the heirs and two disinterested witnesses; a judge then reviews and approves it under § 205.003.
Independent Administration – used when a will exists (or all heirs agree) and the estate has debts; minimal court supervision after the executor is appointed. This is the most common and efficient path in Texas when available.
Muniment of Title – available when a valid will exists, there are no unsecured debts (other than a mortgage), and there’s no other need for a full administration; transfers title without appointing an executor.
Dependent Administration – required for complex, contested, or disputed estates; involves ongoing court supervision and approval of most actions.
Step 2: filing for administration
The personal representative (or an interested party) files an Application for Probate of Will and Issuance of Letters Testamentary (or Letters of Administration, if intestate) with the Marion County Clerk.
The original will (if one exists), a certified death certificate, and information about heirs and the proposed executor are included with the application.
The court holds a hearing and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors and gathers, inventories, and appraises the estate’s assets.
The personal representative pays valid debts and expenses.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed.
What it costs
Filing fees in Texas typically run $250–$400 depending on the county; confirm current Marion County fees directly.
Texas law allows a statutory executor fee of 5% of all sums actually received and paid out in cash, with specific exceptions. The court may also approve reasonable attorney fees paid from the estate.
Small estate affidavits typically cost $600–$1,900 total when factoring in filing and related fees.
Texas does NOT impose a state estate tax or a state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
