Notes: Rusk County holds a genuinely historic place in American energy history. On October 3, 1930, wildcatter Columbus Marion “Dad” Joiner – defying expert opinion that the area held little or no oil – struck oil at his Daisy Bradford No. 3 well after two earlier failed attempts, discovering the East Texas Oil Field, at the time the largest oil field in the world. Within a week, local bank deposits rose nearly $150,000, and Rusk County residents received an estimated $500,000 combined in the first seven days alone. By 1933, the field had produced over 200 million barrels of oil, transforming Henderson from a population of 3,000 in 1930 to 10,000 by 1933. The 1928 Rusk County Courthouse stands on the same town square as the original 1849 courthouse (destroyed in an 1860 fire, rebuilt 1878), with a 1936 commemorative statue of Thomas J. Rusk out front.

PARKS & RECREATION
Key Assets: The Depot Museum and Children’s Discovery Center, housed in a beautifully restored 1901 Missouri Pacific railway depot in Henderson, celebrates the county’s railroad heritage and hosts the real annual Heritage Syrup Festival each November. The Gaston Museum in nearby Joinerville, just two miles from Dad Joiner’s original well, commemorates the East Texas oil field discovery. Martin Creek Lake State Park offers regional recreation. This project notes, factually and with care: the New London School explosion occurred in Rusk County on March 18, 1937, near Overton – a natural gas leak ignited beneath the school, killing approximately 294 students and teachers, one of the deadliest non-combat disasters in U.S. history; this tragedy directly led to the state requirement that natural gas be given a distinctive odor (mercaptan) so leaks can be detected, a safety standard still followed nationwide today.
Notes: Rusk County’s oil-boom heritage is real and extensively documented; the New London tragedy is included here factually, as a significant piece of regional and national safety history.

NOTES: Rusk County is the sixth county in this batch (Refugio, Roberts, Robertson, Rockwall, Runnels, Rusk, Sabine). The 1930 East Texas Oil Field discovery is genuinely one of the most significant energy-history events covered in this entire project, and the county’s Second Chance dog-training initiative is a distinctive, InmateAid-relevant program worth flagging for readers. All contact information above was sourced via web search as of early August 2026 and should be reconfirmed directly with the relevant office before a visit, deadline-sensitive filing, or emergency-adjacent decision.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
County Clerk, Rusk County PO Box 758, Henderson, TX 75653 (903) 657-0330 Rusk County is in East Texas, seated in Henderson.
Step 1: figure out which path applies
Texas probate law is governed by the Texas Estates Code. Probate jurisdiction in Texas is split between statutory probate courts (in larger metro counties) and county courts (in smaller counties like Rusk, sometimes assisted by district courts). In Rusk County, the County Court handles probate matters.
Small Estate Affidavit (Tex. Est. Code § 205.001) – available ONLY when the decedent died WITHOUT a will (intestate), the estate (excluding homestead and exempt property) does not exceed $75,000, and assets exceed debts. At least 30 days must have passed since death. The affidavit must list every asset and debt, establish the family history showing who the heirs are, and be sworn to by the heirs and two disinterested witnesses; a judge then reviews and approves it under § 205.003.
Independent Administration – used when a will exists (or all heirs agree) and the estate has debts; minimal court supervision after the executor is appointed. This is the most common and efficient path in Texas when available.
Muniment of Title – available when a valid will exists, there are no unsecured debts (other than a mortgage), and there’s no other need for a full administration; transfers title without appointing an executor.
Dependent Administration – required for complex, contested, or disputed estates; involves ongoing court supervision and approval of most actions.
Step 2: filing for administration
The personal representative (or an interested party) files an Application for Probate of Will and Issuance of Letters Testamentary (or Letters of Administration, if intestate) with the Rusk County Clerk.
The original will (if one exists), a certified death certificate, and information about heirs and the proposed executor are included with the application.
The court holds a hearing and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors and gathers, inventories, and appraises the estate’s assets.
The personal representative pays valid debts and expenses.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed.
What it costs
Filing fees in Texas typically run $250–$400 depending on the county; confirm current Rusk County fees directly.
Texas law allows a statutory executor fee of 5% of all sums actually received and paid out in cash, with specific exceptions. The court may also approve reasonable attorney fees paid from the estate.
Small estate affidavits typically cost $600–$1,900 total when factoring in filing and related fees.
Texas does NOT impose a state estate tax or a state inheritance tax. Only the federal estate tax may apply, and only to very large estates.
