About Orleans County
Orleans County is the heart of Vermont’s Northeast Kingdom’s lake and mountain country – home to Jay Peak Resort, Lake Memphremagog, and the Newport city-on-a-lake that feels distinctly different from southern Vermont’s more developed resort communities.
Jay Peak Resort – in the town of Jay, on Vermont’s northern border – has the highest average snowfall of any ski resort in the eastern United States, receiving an average of 359 inches annually, driven by “Lake Effect” snow from Lake Champlain and the Canadian storm track. Jay Peak’s snow record has made it a pilgrimage destination for powder-hungry eastern skiers. The resort’s indoor waterpark (Pump House Indoor Waterpark, one of the largest in the Northeast, enclosed within the resort complex) makes it a year-round family destination unusual among Vermont ski areas.
Lake Memphremagog – a 31-mile-long lake straddling the Vermont-Quebec border, with Newport on its southern shore and Magog, QC on its northern – is one of the most beautiful lakes in the Northeast and one of the few lakes in the United States where you can boat from one country to another. The lake is also home to Memphre – a lake monster in the tradition of Nessie, with sightings reported since the 18th century.
Newport (the county seat, population ~4,500) is a genuine border city, with significant French-Canadian cultural influence from the Quebec communities just across the line. Newport’s character – a working city on a beautiful lake – is distinct from Vermont’s more tourist-oriented communities.

Cross-border estate planning: Orleans County’s proximity to Quebec creates specific cross-border estate planning needs – Vermont real property in estates of Quebec residents or US property of Canadian citizens requires coordination between Vermont estate law and Quebec’s civil law succession system. US estate tax applies to US-situated real property regardless of the owner’s citizenship.
Jay Peak EB-5 legacy: Jay Peak Resort was the center of a major federal securities fraud case – the EB-5 fraud scandal (2016) in which developers illegally diverted EB-5 investor funds from immigrant investors. The resort has since been sold and operates legitimately, but the case has ongoing implications for investor estates and was the largest EB-5 fraud case in the program’s history.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Vermont Superior Court, Orleans Probate Division 217 Main Street, Newport, VT 05855 (802) 334-3325
Orleans County is in Vermont’s Northeast Kingdom near the Canadian border, shire town Newport. Vermont has ONE probate court per county, operating as the Probate Division of the Superior Court. Note: the Orleans County Courthouse at 247 Main Street has at times been temporarily closed to the public, with court assistance and forms available at the Orleans Criminal Courthouse next door at 217 Main Street – confirm current location before visiting.
Step 1: figure out which path applies
Vermont has NOT adopted the Uniform Probate Code – it maintains its own probate framework under Title 14 of the Vermont Statutes Annotated, administered through the Probate Division in each county.
Small Estate Procedure (14 V.S.A. § 1901) – available when the estate’s fair market value is $45,000 or less AND consists entirely of personal property (a timeshare interest is the sole real-property exception, per 32 V.S.A. § 3619(a)). Unlike many states, this is NOT a self-executing affidavit presented directly to a bank – it opens an actual probate case, filed with the Probate Division. The petitioner must be the sole beneficiary under a will or sole heir if intestate, and must also be the sole fiduciary. Filing requires: a petition to open, a list of interested persons, the filing fee, an original death certificate, an inventory, an affidavit of paid/outstanding debts and funeral expenses, a bond without surety in the amount of the estate’s value, and the will if one exists. Non-consenting interested parties get notice and 14 days to object. If the estate later proves worth more than $45,000, the fiduciary must petition to convert it to full administration.
Waiver of Administration (14 V.S.A. § 1852) – a separate, newer mechanism available when the personal representative is the SOLE heir or beneficiary; if granted, it waives the inventory requirement and the bond, and the estate can close with just a single affidavit of administration filed 6 months to 1 year after appointment. No dollar threshold applies to this specific mechanism.
Full/Standard Administration – the default path for estates that don’t qualify for the above, involving formal appointment of an executor or administrator, creditor notice, inventory, and court-supervised distribution.
Step 2: filing for administration
The personal representative (or an interested party) files a Petition to Open an Estate with the Orleans Probate Division – within 30 days of death if a will exists.
Required documents include the original will (if any) and codicils, a list of estate property and its approximate value, deed book/page numbers for any real estate, a certified death certificate, and a list of interested persons.
The court reviews the petition, holds a hearing if needed, and appoints the executor or administrator, issuing letters.
The personal representative provides notice to creditors – Vermont’s creditor claim period is 4 months.
The personal representative inventories assets, pays valid debts and taxes, and manages the estate.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed with final accounting.
What it costs
Filing fees vary by estate value; small estate/summary probate filings run roughly $50–$110 per 32 V.S.A. § 1434(a)(30). Confirm current Orleans County fees directly, or ask about a fee waiver if needed.
Vermont does not publish a fixed statutory fee schedule for attorneys or personal representatives; reasonable compensation is standard practice.
Vermont has an active STATE ESTATE TAX: a $5,000,000 exemption, with a flat 16% rate applied to the portion of the estate above that threshold. This is separate from and in addition to the federal estate tax (roughly $15 million exemption for 2026) – an estate can owe Vermont tax even when it owes no federal tax.
Vermont does NOT have a separate inheritance tax.
