Key Assets: Galax bills itself as “The World Capital of Old-Time Mountain Music,” and the claim is well-documented: in 1924, a group of local musicians organized a string-instrument vocal quartet in a downtown Galax barbershop, took the name “The Hill Billies,” and went on to New York for professional recording – one of the first major commercial successes of what became known as country/”hillbilly” music. The city has hosted the Old Fiddlers’ Convention at Felts Park every August since 1935 (with a brief indoor stint that first year), presented by the Galax Moose Lodge #733 and recognized as the oldest and largest fiddlers’ convention in the world – drawing over 10,000 attendees during its week-long run, including musicians from as far as California, Texas, and abroad. The city is a key stop on The Crooked Road, Virginia’s 330-mile Heritage Music Trail, and the historic Rex Theater (opened 1940, the only movie theater in the Twin Counties at the time) now hosts live bluegrass, folk, and theatrical performances.
Notes: The Old Fiddlers’ Convention is held the first full week of August annually – check oldfiddlersconvention.com for current dates and registration, as camping and vendor details change year to year. The nearby Blue Ridge Music Center (Blue Ridge Parkway milepost 213) offers a free Visitor Center and Museum open May through October.

NOTES
Galax is a small but culturally significant independent city – genuinely earning its self-description as “The World Capital of Old-Time Mountain Music,” with a direct historical link to the birth of commercial country music via “The Hill Billies” in 1924, and home to the Old Fiddlers’ Convention, the oldest and largest event of its kind in the world, running continuously since 1935. The city shares its 911 dispatch and animal shelter regionally with neighboring Grayson and Carroll counties, reflecting close cross-jurisdictional cooperation typical of small Southwest Virginia communities. All contact information above was sourced from official city pages as of this writing; phone numbers and hours should be reconfirmed directly with the relevant office before a visit.

City-level record sources
Records for Galax matters are split between the Carroll County Clerk’s Office (Hillsville) and the Grayson County Clerk’s Office (Independence) – see Probate section above for both addresses. Family history researchers with Galax roots should check BOTH offices, since which side of the city an ancestor lived on determines which county’s records apply.
Prior to Galax’s 1953 incorporation as an independent city, all area records were kept by Carroll and Grayson counties directly – pre-1953 Galax-area ancestors will appear exclusively in those counties’ historical records.
Local societies
No dedicated Galax genealogical society was confirmed in available directories.
Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Galax, Virginia is UNIQUE among all Virginia independent cities: it has NO Circuit Court of its own at all. Instead, jurisdiction is split geographically between two neighboring counties:
Carroll Circuit Court: 605 Pine Street, PO Box 218, Hillsville, VA 24343, (276) 730-3070
Grayson Circuit Court: 129 Davis Street, PO Box 130, Independence, VA 24348, (276) 773-2231
Which court has jurisdiction over a given Galax matter depends on which side of the city the property or residence is located – the Code of Virginia’s chapter establishing this arrangement specifically provides that the power of appointment of any officer or board required to be made by the circuit court (such as appointing a personal representative) is vested in the Grayson Circuit Court. Galax was formed as an independent city in 1953, carved from portions of both Carroll and Grayson counties. Virginia has NO separate probate court anywhere in the state – probate (“qualification”) is handled entirely by the Circuit Court Clerk’s Office.
Step 1: figure out which path applies
Virginia calls the probate process “qualification” rather than “appointment,” and it happens administratively at the Circuit Court Clerk’s Office, not before a judge, unless a dispute arises. This framework applies identically in independent cities as in counties. Because Galax’s probate matters are handled through Grayson County (per the statutory default described above), a Galax resident’s family should generally expect to work with the Grayson Circuit Court Clerk’s Office unless directed otherwise.
Small Estate Affidavit (Va. Code § 64.2-601, the “Virginia Small Estate Act”) – available when the decedent’s entire personal probate estate (excluding real estate) does not exceed $75,000, at least 60 days have passed since death, and no personal representative has been appointed or has a pending application in any jurisdiction. If a will exists, it must first be admitted to probate (recorded with the Clerk) even though no executor is appointed. As of July 1, 2026, the affidavit must be filed on the statewide form (CC-1685).
Single Small Asset Release (Va. Code § 64.2-602) – any person or institution holding a single asset of $35,000 or less may release it directly to a successor once 60 days have passed since death and no personal representative has qualified, without any affidavit required at all.
Real Estate Affidavit (Form CC-1612) – if the decedent owned only real estate, this can be recorded directly in land records without full probate. Real estate generally cannot be transferred through the small estate affidavit process.
Full Qualification / Administration – the standard path for larger or more complex estates. The personal representative appears before the Clerk, takes an oath, files the will and death certificate, and typically posts a surety bond. The estate is then supervised by a Commissioner of Accounts throughout administration.
Step 2: filing for administration
Confirm which of the two courts has jurisdiction – call the Grayson Circuit Court Clerk’s Office first (as the statutory default for appointments), or the Carroll Circuit Court Clerk’s Office if the property/residence is on that side of the city.
Bring the original will (if any) and a certified death certificate to the appropriate Clerk’s Office.
The Clerk reviews the will’s validity and admits it to probate.
The personal representative takes an oath and qualifies, posting a bond if required; the Clerk issues Letters Testamentary or Letters of Administration.
The Commissioner of Accounts oversees the estate going forward.
The personal representative notifies creditors, pays valid debts, and manages estate assets.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed once final accounting is approved.
What it costs
Virginia imposes a PROBATE TAX on most wills admitted to probate and grants of administration: $1 state tax + $0.33 local tax for every $1,000 of estate value. No tax is imposed on estates valued at $15,000 or less.
Filing fees for qualification vary by estate size; confirm current fees with whichever court has jurisdiction.
Virginia does NOT impose a state estate tax or inheritance tax – repealed for deaths on or after July 1, 2007. Only the federal estate tax may apply, and only to very large estates.
