Virginia County
Grayson County, Virginia
Grayson Highlands and Mount Rogers National Recreation Area - from Grayson Highlands State Park (the rugged high-elevation park on the flanks of Mount Rogers features wild ponies grazing on the balds, panoramic views from Virginia's rooftop, and some of the most spectacular Appalachian Trail hiking in the entire eastern United States) to the New River's passage through Grayson County (the New River - one of the world's oldest rivers - cuts through Grayson County's highlands terrain, and the New River Trail State Park follows the river through dramatic scenery from the county into Pulaski County, providing one of Virginia's premier rail-trail experiences).

PARKS & RECREATION
Key Assets: Grayson Highlands State Park, adjacent to Mount Rogers – Virginia’s highest peak at 5,729 feet – genuinely famous for its herd of roughly 100-120 wild ponies that freely roam the high-elevation grassy balds along the Appalachian Trail, most easily spotted around Wilburn Ridge and Massie Gap; the ponies were introduced in the 1970s (some sources say the 1940s) to help graze land cleared before the park’s creation, are owned and managed by the nonprofit Wilburn Ridge Pony Association, and are rounded up annually for veterinary checkups, with some foals sold at auction to manage herd size; feeding the ponies is against park policy, and visitors are reminded they are genuinely wild animals that do bite. The park also hosts the Wayne C. Henderson Music Festival and Guitar Competition every June, honoring the local musician and luthier, featuring old-time and bluegrass music. The historic 1908 Grayson County Courthouse in Independence was saved from demolition by local preservation groups and a private donor, restored, and donated back to the county in 1986.
Notes: Grayson Highlands’ campground was set to reopen in 2026 after a closure – confirm current camping availability directly with the park before planning a stay

Notes: Grayson County Animal Control does NOT pick up stray cats or handle wildlife. All dogs (including indoor, tied, or otherwise confined dogs) must be rabies-vaccinated and licensed through the Treasurer’s Office by 4 months of age; dog tags go on sale November 1 and must be obtained by January 31 each year ($5 per dog, $35 for a kennel tag covering up to 20 dogs). The shelter is not yet a no-kill facility, though it states that as a goal; a separate independent nonprofit, Twin County Humane Society, focuses specifically on spay/neuter and owner-assistance programs (vaccines, microchips, pet food, housing help) and explicitly notes it is NOT affiliated with the Galax-Carroll-Grayson shelter – worth knowing which organization fits your specific need.

NOTES
Grayson County anchors the Virginia Highlands around Mount Rogers, the state’s tallest peak, and is home to one of the most distinctive wildlife attractions in the state – the free-roaming wild ponies of Grayson Highlands State Park, a herd carefully managed by a dedicated nonprofit through annual roundups. The county’s building department stands out for directly serving three incorporated towns (Independence, Fries, Troutdale) alongside the county itself, rather than leaving each town to run its own separate permitting office. All contact information above was sourced from official county and state park pages as of this writing; phone numbers and hours should be reconfirmed directly with the relevant office before a visit.
About Grayson County
Grayson County is Virginia’s highland rooftop county – Grayson Highlands’ wild ponies and alpine balds, Mount Rogers National Recreation Area, and the ancient New River create a natural landscape of extraordinary distinction in Virginia’s far southwest, making the county one of the state’s premier outdoor recreation destinations.
Independence (the county seat, population ~950) serves as Grayson County’s governmental hub in the New River valley while the county’s high mountain communities and recreation areas define its broader character and regional appeal.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Grayson Circuit Court 129 Davis Street, PO Box 130, Independence, VA 24348 (276) 773-2231
Grayson County is in Southwest Virginia along the North Carolina border, home to Mount Rogers (Virginia’s highest peak), county seat Independence. Virginia has NO separate probate court – probate (“qualification”) is handled entirely by the Circuit Court Clerk’s Office.
Step 1: figure out which path applies
Virginia calls the probate process “qualification” rather than “appointment,” and it happens administratively at the Circuit Court Clerk’s Office, not before a judge, unless a dispute arises.
Small Estate Affidavit (Va. Code § 64.2-601, the “Virginia Small Estate Act”) – available when the decedent’s entire personal probate estate (excluding real estate) does not exceed $75,000, at least 60 days have passed since death, and no personal representative has been appointed or has a pending application in any jurisdiction. If a will exists, it must first be admitted to probate (recorded with the Clerk) even though no executor is appointed. As of July 1, 2026, the affidavit must be filed on the statewide form (CC-1685).
Single Small Asset Release (Va. Code § 64.2-602) – any person or institution holding a single asset of $35,000 or less may release it directly to a successor once 60 days have passed since death and no personal representative has qualified, without any affidavit required at all.
Real Estate Affidavit (Form CC-1612) – if the decedent owned only real estate, this can be recorded directly in land records without full probate. Real estate generally cannot be transferred through the small estate affidavit process.
Full Qualification / Administration – the standard path for larger or more complex estates. The personal representative appears before the Clerk, takes an oath, files the will and death certificate, and typically posts a surety bond. The estate is then supervised by a Commissioner of Accounts throughout administration.
Step 2: filing for administration
The person seeking to qualify as executor or administrator brings the original will (if any) and a certified death certificate to the Grayson Circuit Court Clerk’s Office.
The Clerk reviews the will’s validity and admits it to probate.
The personal representative takes an oath and qualifies, posting a bond if required; the Clerk issues Letters Testamentary or Letters of Administration.
The Commissioner of Accounts oversees the estate going forward.
The personal representative notifies creditors, pays valid debts, and manages estate assets.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed once final accounting is approved.
What it costs
Virginia imposes a PROBATE TAX on most wills admitted to probate and grants of administration: $1 state tax + $0.33 local tax for every $1,000 of estate value. No tax is imposed on estates valued at $15,000 or less.
Filing fees for qualification vary by estate size; confirm current Grayson County fees directly.
Virginia does NOT impose a state estate tax or inheritance tax – repealed for deaths on or after July 1, 2007. Only the federal estate tax may apply, and only to very large estates.
