Virginia County
Powhatan County, Virginia
Powhatan and James River western Richmond countryside - from Powhatan County's distinction as one of the Richmond metro's most rural and horse-friendly western suburbs (the county's rolling Piedmont landscape of farms, horse properties, and wooded estates has made it a sought-after destination for equestrian enthusiasts and rural lifestyle seekers who want proximity to Richmond while maintaining genuine countryside character) to the county's Native American heritage namesake (Powhatan County takes its name from the paramount chief of the Powhatan Confederacy who was the father of Pocahontas, honoring the Indigenous peoples whose civilization flourished in this region centuries before European settlement).

Notes: CodeRED, the emergency notification platform previously used by Powhatan and many other Virginia localities, was disabled county-wide due to a cybersecurity incident affecting the platform itself (managed outside the county, not a breach of Powhatan’s own systems) – residents who reused their CodeRED password elsewhere were advised to change it. In an active emergency, check the county website and official social media for updates rather than assuming CodeRED alerts will arrive – confirm current alert system status directly, as this appears to be an evolving situation.

Parks & Recreation
PARKS & RECREATION
Key Assets: Powhatan County, created by the Virginia General Assembly in 1777, is genuinely named for Chief Powhatan (Wahunsenacawh), the paramount chief of the Powhatan Confederacy and father of Pocahontas – a real and direct historical namesake, not a generic tribute; the county was originally settled by French Huguenot refugees around 1700 at a former Monacan village site; Powhatan State Park, opened 2013 after a 10-year transfer process from the Virginia Department of Juvenile Justice, offers 1,565 acres with roughly 2.5 miles of James River waterfront, a canoe slide launch, a canoe-in primitive campground, and a popular 5-mile float downriver to the Maidens boat launch; Fighting Creek Park (220 acres) anchors community recreation with athletic fields, playgrounds, walking trails, and the disc golf course; Powhatan Wildlife Management Area, 4,462 acres of former farmland, supports hunting, fishing, hiking, boating, and horseback riding
Notes: The James River itself carries Powhatan’s name in its own right – Native Americans called it “Powhatan’s River” before English colonists renamed it for King James I in 1607, a detail directly tied to the county’s own naming.

NOTES
Powhatan County carries a genuine, direct historical connection to its namesake – Chief Powhatan, father of Pocahontas and paramount chief of the Powhatan Confederacy – a naming tie shared with the James River itself, which Native Americans called “Powhatan’s River” before English colonization. Note that the county’s emergency alert system (CodeRED) has faced a documented platform-wide cybersecurity disruption – residents should confirm current alert system status directly with the county rather than assuming standard CodeRED notifications will reach them. All contact information above was sourced from official county pages as of this writing; phone numbers and hours should be reconfirmed directly with the relevant office before a visit.
About Powhatan County
Powhatan County is Richmond’s rural western corridor county – the rolling Piedmont countryside of horse farms, wooded estates, and agricultural land provides a distinctly rural alternative within commuting distance of Richmond, attracting residents who value space, privacy, and the equestrian lifestyle along the James River’s upper reaches.
Powhatan (the county seat, population ~6,000) anchors the county’s governmental functions in a traditional Virginia courthouse town setting along Route 60 west of Richmond.

Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Powhatan Circuit Court 3880-C Old Buckingham Road, Powhatan, VA 23139 (804) 598-5660
Powhatan County is in Central Virginia west of Richmond, county seat Powhatan. Virginia has NO separate probate court – probate (“qualification”) is handled entirely by the Circuit Court Clerk’s Office.
Step 1: figure out which path applies
Virginia calls the probate process “qualification” rather than “appointment,” and it happens administratively at the Circuit Court Clerk’s Office, not before a judge, unless a dispute arises.
Small Estate Affidavit (Va. Code § 64.2-601, the “Virginia Small Estate Act”) – available when the decedent’s entire personal probate estate (excluding real estate) does not exceed $75,000, at least 60 days have passed since death, and no personal representative has been appointed or has a pending application in any jurisdiction. If a will exists, it must first be admitted to probate (recorded with the Clerk) even though no executor is appointed. As of July 1, 2026, the affidavit must be filed on the statewide form (CC-1685).
Single Small Asset Release (Va. Code § 64.2-602) – any person or institution holding a single asset of $35,000 or less may release it directly to a successor once 60 days have passed since death and no personal representative has qualified, without any affidavit required at all.
Real Estate Affidavit (Form CC-1612) – if the decedent owned only real estate, this can be recorded directly in land records without full probate. Real estate generally cannot be transferred through the small estate affidavit process.
Full Qualification / Administration – the standard path for larger or more complex estates. The personal representative appears before the Clerk, takes an oath, files the will and death certificate, and typically posts a surety bond. The estate is then supervised by a Commissioner of Accounts throughout administration.
Step 2: filing for administration
The person seeking to qualify as executor or administrator brings the original will (if any) and a certified death certificate to the Powhatan Circuit Court Clerk’s Office.
The Clerk reviews the will’s validity and admits it to probate.
The personal representative takes an oath and qualifies, posting a bond if required; the Clerk issues Letters Testamentary or Letters of Administration.
The Commissioner of Accounts oversees the estate going forward.
The personal representative notifies creditors, pays valid debts, and manages estate assets.
Remaining assets are distributed to beneficiaries or heirs, and the estate is closed once final accounting is approved.
What it costs
Virginia imposes a PROBATE TAX on most wills admitted to probate and grants of administration: $1 state tax + $0.33 local tax for every $1,000 of estate value. No tax is imposed on estates valued at $15,000 or less.
Filing fees for qualification vary by estate size; confirm current Powhatan County fees directly.
Virginia does NOT impose a state estate tax or inheritance tax – repealed for deaths on or after July 1, 2007. Only the federal estate tax may apply, and only to very large estates.
