Key Assets: Monongalia County is home to Morgantown, settled 1772, chartered 1785, and incorporated 1838, founded by and named for Zackquill Morgan – the city carries the genuinely distinctive Latin motto “Regina Monongahelae-Vestigia Nulla Retrorsum” (“There is nothing left for the Queen of the Monongahela to return to”); Morgantown is West Virginia’s third-most populous city and home to the main campus of West Virginia University, whose presence dominates the city’s identity, economy, and culture, including Milan Puskar Stadium; the Downtown Morgantown Historic District, listed 1996, spans roughly 75 acres with 122 contributing buildings reflecting architecture and social history from 1795-1945, anchored by the Monongalia County Courthouse (current structure 1891, Romanesque style, the FOURTH courthouse built on the same site since 1784 – predating the town of Morgantown itself by one year) and the Metropolitan Theatre; the Monongalia Arts Center (MAC), housed in the historic Old Morgantown Post Office (1979 NRHP listing), has served as a nonprofit arts/culture hub since 1978, including the Benedum Gallery (funded by the Claude Worthington Benedum Foundation) and the community-driven Robert M. Davis Gallery (established 2004); the WVU-owned Core Arboretum, a 91-acre free public arboretum established 1948, sits along Monongahela Boulevard
Notes: Morgantown’s distinctive Latin motto and the Monongalia County Courthouse’s status as the fourth building on a site predating the town itself are both genuinely notable, verifiable pieces of local civic history.

NOTES
Monongalia County’s identity is inseparable from West Virginia University and its Morgantown home, a genuinely well-preserved historic downtown alongside a modern, growing university city. The county recently completed a major, multi-year 911 center relocation project, worth knowing for current emergency services context. Building permits here notably split cleanly between county floodplain-only jurisdiction and full municipal enforcement – an important distinction for anyone building in the area. All contact information above was sourced from official county, city, and university pages as of this writing; phone numbers and hours should be reconfirmed directly with the relevant office before a visit.
About Monongalia County
Monongalia County is Morgantown – home of West Virginia University, one of the most comprehensive public research universities in Appalachia and the institution that single-handedly sustains one of the most economically resilient communities in a state that has faced decades of population loss and economic hardship.
West Virginia University (WVU, enrollment ~28,000) is the economic anchor of Monongalia County in a way that few universities match relative to their host community. WVU employs approximately 14,000 people – a number that dwarfs any other Morgantown employer – and supports a vast ecosystem of student-serving businesses, research contractors, and healthcare facilities. The WVU Health System (Ruby Memorial Hospital and affiliated facilities) is a Level I trauma center and the state’s largest healthcare system, drawing patients from across West Virginia and neighboring states.
WVU’s football program – the Mountaineers, competing in the Big 12 Conference – is West Virginia’s most unifying cultural institution. Milan Puskar Stadium (capacity 60,000) draws the entire state’s attention on game days, and the Blue and Gold identity is one of the most fiercely held in college sports.
Morgantown’s Personal Rapid Transit (PRT) system – the world’s only operational automated people mover connecting a downtown with a university campus – has operated since 1975 and remains one of the most unique urban transit systems in America (and the source of frequent affectionate complaints from WVU students about its reliability).
The National Energy Technology Laboratory (NETL) – one of the Department of Energy’s national laboratories, specializing in fossil fuel technology and carbon capture research – is headquartered in Morgantown, providing significant federal research employment and connecting WVU’s engineering programs to federal energy research priorities.
County government is a three-member County Commission. Separately elected: Assessor, Clerk, Prosecuting Attorney, Sheriff, and Surveyor.

WVU faculty and NETL researcher estate planning: WVU faculty participate in WV PERS or TIAA. NETL federal employees participate in FERS/TSP. Both require current beneficiary designations and estate plan coordination. WVU’s Technology Transfer Office manages faculty IP – royalty streams and spinout equity should be addressed in estate plans.
Student rental investment estate planning: Morgantown’s student rental market has attracted significant investor activity from outside the county – distant owners of rental properties should ensure their estate plans address West Virginia real estate specifically, including property management continuity and LLC succession.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Monongalia County Clerk’s Office (Probate/Fiduciary Supervisor) 243 High Street, Room 123, Morgantown, WV 26505 (304) 291-7230
Monongalia County was founded October 9, 1776, home to West Virginia University, West Virginia’s third-most populous county, county seat Morgantown. West Virginia has NO separate probate court and has NOT adopted the Uniform Probate Code. Probate is handled administratively through the COUNTY COMMISSION, via the elected COUNTY CLERK (clerk of the county commission) and that office’s FIDUCIARY SUPERVISOR – not through the Circuit Court, which handles only contested or referred matters.
Step 1: figure out which path applies
West Virginia’s probate framework runs under Chapter 44 of the West Virginia Code, administered locally at the county commission level rather than in a court of record.
West Virginia Small Estate Act (W. Va. Code §44-1A) – available when the decedent’s ENTIRE personal probate estate does not exceed $50,000 in “small assets,” AND the decedent owned no interest in real property at all. As of a July 9, 2025 change in the law, real estate provisions were removed from the Small Estate Act entirely – any estate involving real property, of any value, can no longer use this affidavit process. If the affiant is the nominated personal representative under a will, the affidavit can be filed 30 days after death; otherwise, 60 days must pass. No personal representative may be pending or appointed in any jurisdiction.
Full/Standard Administration – required whenever real property is involved, or the estate exceeds $50,000 in personal property. The executor (with a will) or administrator (without one) qualifies before the County Clerk, receives Letters Testamentary or Letters of Administration, files an appraisement within 90 days of qualification, and settles the estate through the Fiduciary Supervisor or, for complex or contested matters, a court-appointed Fiduciary Commissioner.
Only if a genuine dispute arises – a will contest, or disagreement over appointment – does the matter go before the County Commission for a hearing, or in some cases the Circuit Court.
Step 2: filing for administration
The person seeking to serve as executor or administrator brings the original will (if any) and a certified death certificate to the Monongalia County Clerk’s Office to qualify.
The Clerk issues Letters Testamentary or Letters of Administration; a corporate surety bond is typically required unless waived by the will or by agreement of all beneficiaries (with no debts).
The personal representative files an appraisement of the estate’s assets, generally within 90 days of qualification.
Notice to creditors must be published; once an appraisement is filed, the County Clerk must publish notice within 30 days (or within 120 days of qualification if no appraisement is filed).
The estate is settled through the Fiduciary Supervisor’s review, or referred to a Fiduciary Commissioner if complex or contested, culminating in a final settlement and accounting.
What it costs
Court filing fees to qualify as executor or administrator generally range from about $44 to $56, depending on whether there is a will.
West Virginia sets statutory executor commissions based on estate value: 5% on the first $100,000, 4% on the next $300,000, 3% on the next $400,000, and 2% on amounts above that.
Attorney fees for straightforward estates commonly range from $2,500-$5,000, and $5,000-$10,000+ for complex or contested cases; add bond premiums, newspaper publication fees, and appraisal/recording fees.
West Virginia does NOT impose a state estate tax or inheritance tax. Only the federal estate tax may apply, and only to estates above the federal exemption (roughly $15 million for a 2026 death).
