Notes: Sangamon County holds genuinely paramount significance in American history: Springfield has served as the third and current capital of Illinois since 1839 (following Kaskaskia and Vandalia), and was Abraham Lincoln’s home from 1837 until he left for the presidency in 1861. Lincoln, along with eight fellow Sangamon County legislators known as the “Long Nine” (all reportedly over six feet tall), was instrumental in securing Springfield’s designation as state capital. Springfield was originally named “Calhoun” in 1821 after Senator John C. Calhoun, before being renamed in 1832 after nearby Spring Creek once Calhoun fell out of public favor. Numerous major Lincoln historic sites are located throughout the county, including the Abraham Lincoln Presidential Library and Museum, the Lincoln Home, the Old State Capitol, and the Lincoln Tomb. Extensive records of Lincoln’s own law practice – primarily tied to Sangamon County cases – survive and are digitized as “The Law Practice of Abraham Lincoln.”

About Sangamon County
Sangamon County is Illinois’s seventh most populous county outside the Chicago metro and the 330th most populous in the United States, covering 868 square miles of the central Illinois prairie.
Springfield (population ~114,000, the county seat and state capital) is one of America’s most historically significant state capitals – the Lincoln City, where Abraham Lincoln lived from 1837 to 1861. The concentration of Lincoln heritage sites in Springfield is unmatched anywhere: the Abraham Lincoln Presidential Library and Museum (the most visited presidential library in the United States), the Lincoln Home National Historic Site (the only home Lincoln ever owned, preserved by the National Park Service), Lincoln’s Tomb State Historic Site (where Lincoln, his wife Mary Todd, and three of his sons are interred), Lincoln-Herndon Law Offices State Historic Site, and dozens of other sites where Lincoln’s story played out.
The Illinois State Capitol (completed 1888) anchors Springfield’s governmental identity – state government is the city’s dominant economic driver, employing tens of thousands in the capital complex and surrounding agencies.
The Illinois State Fair – held annually in August at the Illinois State Fairgrounds in Springfield – is one of the largest state fairs in the United States, drawing over 400,000 visitors and serving as an important agricultural and cultural event for all of Illinois.
Chatham (population ~13,000) and Sherman (population ~4,500) are Springfield’s fastest-growing suburban communities – residential development continues northward and eastward as Springfield professionals seek newer construction and top school districts.
Memorial Medical Center and HSHS St. John’s Hospital provide the county’s two major healthcare systems, anchoring a significant medical employment sector alongside state government.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Sangamon County Circuit Clerk – Sangamon County Courts Complex 200 South 9th Street, Room 405, Springfield, IL 62701 (217) 753-6674
Sangamon County is home to Springfield, the Illinois state capital, and one of Illinois’ most populous counties. The 340,000-square-foot Courts Complex houses 27 separate county departments and offices.
Step 1: figure out which path applies
Illinois has NOT adopted the Uniform Probate Code and is not a community property state – it follows common law property principles. Illinois probate is governed by the Probate Act of 1975 (755 ILCS 5/). Two main paths:
Small Estate Affidavit – for estates where personal property (excluding real estate) is valued at $150,000 or less (raised from $100,000 effective August 15, 2025), with no unresolved debts or claims and no real estate involved. No formal court probate is required.
Formal Probate (Independent or Supervised Administration) – required when the estate doesn’t qualify for the small estate affidavit. Most Illinois probate cases proceed under Independent Administration, letting the estate representative act without prior court approval for most routine actions.
Step 2: filing for formal probate
File the decedent’s original will (if one exists) with the Sangamon County Circuit Clerk, where the decedent resided at death.
Petition the court to open the estate and appoint an executor (if there’s a will) or an administrator (if intestate).
The court issues Letters of Office (Letters Testamentary or Letters of Administration) appointing the representative.
Publish notice to creditors and unknown heirs as required by Illinois law.
Under Independent Administration, the representative marshals assets, pays valid debts and taxes, and distributes the remaining estate without needing court approval for each step.
File a final accounting or closing documents to formally close the estate.
What it costs
Illinois imposes its own state estate tax on estates valued above $4 million, with rates up to 16%. There is no Illinois inheritance tax.
Filing fees vary by county – confirm current amounts with the Sangamon County Circuit Clerk.
Most uncontested probate proceedings in Illinois can be completed within about a year.
