The town is also home to the Old York Gaol, built beginning in 1719 (incorporating timbers from an even earlier 1656 jail) – a National Historic Landmark and one of the oldest surviving public buildings, and one of the oldest prison structures, in the United States, operating continuously as a jail until 1879.

About York County
York County is one of the oldest counties in America – organized in 1636 as Yorkshire, one of the original counties of the Massachusetts Bay Colony – and its Atlantic coastline has been drawing summer visitors from southern New England and beyond for well over a century.
The county’s shoreline communities each have distinct characters. Kennebunkport – perhaps the most famous address in Maine – is the home of the Bush family compound at Walker’s Point, where Presidents George H.W. Bush and George W. Bush vacationed. Kennebunkport’s historic downtown, the Dock Square shopping district, and its working lobster harbor give it a classic Maine coastal village character that attracts high-end visitors and second homeowners. Ogunquit is celebrated for its Perkins Cove (a working fishing village accessible by footbridge), the Marginal Way cliff walk, and a nationally recognized arts community with the Ogunquit Museum of American Art. York Beach and York Village have the classic Maine beach resort character – the Nubble Lighthouse (Cape Neddick Light, 1879) on its rocky island is one of the most photographed lighthouses in America. Old Orchard Beach is Maine’s most overtly commercial beach resort – a seven-mile sandy beach with a pier, amusement rides, and a large Québécois tourist community that has been coming since the late 19th century.
Inland, Biddeford and Saco are York County’s largest cities – post-industrial mill cities on the Saco River that are undergoing significant revitalization. Biddeford’s transformation from a declining mill city to a creative economy hub – anchored by the conversion of the massive Pepperell Mill Campus into housing, offices, and the University of New England’s dental school – has attracted national attention. Sanford and Springvale anchor the county’s inland communities.
The University of New England (UNE, health sciences focused, enrollment ~7,000) has campuses in both Biddeford and Portland, and its health professions programs are major employers in southern Maine.
County government in Maine is relatively limited – municipalities provide most services. The county provides courts, corrections, and the Registry of Deeds. A seven-member Board of County Commissioners governs.

Maine requires municipalities to assess property at 100% of just value (market value). Assessment is conducted at the municipal level – each of York County’s 27 municipalities has its own assessor. The York County Registry of Deeds and the county do not directly assess property.
Seasonal property valuation challenges: York County’s coastal real estate market – dominated by seasonal cottages, summer homes, and vacation rentals – creates specific assessment challenges. Market values for coastal seasonal properties can be volatile and are often based on limited comparable sales. Long-term owners of cottages that have appreciated dramatically since original purchase may be paying taxes well below current market value (favorable to the owner), while recently purchased coastal properties are assessed at their full purchase price.
The abatement process:
If you believe your assessed value exceeds market value, file an abatement application with your local board of assessors by March 1 of the tax year. The assessors must respond within 60 days. If denied, appeal to the Maine Board of Assessment Review (state administrative body) or to the York County Superior Court within 60 days of the denial.
Veterans and exempt property: Maine offers a property tax exemption for qualifying veterans – $6,000 reduction in assessed value for veterans who served during wartime periods and meet residency requirements. Paraplegic veterans receive a larger exemption. Apply through your local assessor.
Maine estate tax: Maine imposes a state estate tax on estates above $6.41 million (2025 – adjusted annually for inflation) at rates up to 12%. No Maine inheritance tax. Federal estate tax applies above approximately $13.9 million (2025).
OWNWELL CTA: York County’s March 1 abatement deadline is firm across all municipalities. Coastal seasonal property values are volatile – verify your assessed value reflects comparable sales. Veterans exemption available. Maine estate tax at $6.41M – significantly below federal threshold. Ownwell manages the abatement with no upfront cost.

Maine probate: governed by the Maine Probate Code. Maine allows small estate affidavit procedures for qualifying smaller estates. Maine recognizes Transfer on Death deeds for real property.
Coastal cottage succession: York County’s large stock of multi-generational coastal cottages – many held by extended families in tenancy in common – is the dominant estate planning challenge in the region. When multiple siblings or cousins inherit a cottage in tenancy in common, any one owner can force a partition sale. LLC or trust ownership structures established during the senior generation’s lifetime can preserve family ownership across generations. The Maine Cottage Trust model (a specific LLC-trust hybrid used in Maine cottage succession planning) is commonly recommended by Maine estate attorneys.
Bush compound and high-net-worth Kennebunkport: Kennebunkport’s concentration of high-net-worth second homeowners requires sophisticated federal estate tax planning, Maine estate tax planning (above $6.41M), and trust structures appropriate for multi-property families with assets in multiple states.
Senior Services: The York County Community Action Corporation (YCCA) (207-324-5762) at 6 Spruce Street, Sanford and the Southern Maine Agency on Aging (207-396-6500) at 136 U.S. Route 1, Scarborough coordinate senior centers, home-delivered meals, transportation, Maine SHIP Medicare counseling, caregiver support, Adult Protective Services, and connections to Maine Medicaid long-term care programs.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
York County Probate Court (Registry of Probate) 45 Kennebunk Road, Alfred, ME 04002 (207) 324-1577
York County is Maine’s southernmost county and its oldest, established in 1636 – “First County in Maine.” It is also Maine’s most populous county, seated in Alfred.
Step 1: figure out which path applies
Maine adopted the Uniform Probate Code effective July 1, 2019 (Title 18-C), replacing the prior Title 18-A. Maine is one of fewer than 20 UPC states, so its informal/formal probate tracks and terminology follow the uniform model used elsewhere.
Collection of Personal Property by Affidavit (Small Estate Affidavit) – under 18-C §3-1201, available when the estate’s personal property value is below a threshold that’s adjusted annually for inflation. No probate case or personal representative appointment is required; a successor can present a sworn affidavit directly to banks or others holding the decedent’s property. Each county’s Probate Court publishes the current year’s threshold on its website.
Informal Probate – the path most Maine estates use. Available when the will (if any) is uncontested, the estate is straightforward, and no interested party objects. A Probate Registrar (not a judge) reviews and approves the application without a hearing.
Formal Probate – required when a will is contested, the personal representative appointment is disputed, or supervised administration is requested. These matters go before the elected Judge of Probate at a hearing.
Step 2: filing for probate
For informal probate with a will, file Form DE-201(I) (Application for Informal Probate of Will or Appointment of Personal Representative); for informal intestate proceedings (no will), file Form DE-101(I) – both with the Probate Court in the county where the decedent was domiciled. Applications cannot be filed earlier than 5 days after death.
In informal probate, the Register reviews the application and, if in order, issues a Statement of Informal Probate and Letters appointing the personal representative – no hearing required.
The personal representative must file an inventory of estate assets with the court within 3 months of appointment.
Notice to creditors must be published once a week for 2 successive weeks in a newspaper of general circulation in the county, and the personal representative must mail written notice to known creditors within 4 months of appointment (18-C §3-801).
The personal representative pays valid debts and taxes in priority order, then distributes remaining assets and files a final accounting to close the estate.
What it costs
Filing fees are based on estate value, set by each county’s fee schedule.
Publication costs for the creditor notice typically run in the low hundreds of dollars.
Maine does not set a statutory percentage fee for attorneys or personal representatives; fees must be “reasonable” based on the time and complexity of the work involved.
While not legally required, hiring an attorney is commonly recommended, especially for formal probate or if the estate is at all complex.
