About Rockingham County
Rockingham County is New Hampshire’s most populous county and its economic and geographic gateway – it borders Massachusetts to the south along one of the most economically significant state boundary lines in the United States, where New Hampshire’s no-income-tax environment meets Massachusetts’s 5% income tax and various other levies. The result is a border zone of extraordinary economic activity: large retail developments just across the Massachusetts line in Salem, Nashua corridor, and Seabrook draw Massachusetts shoppers seeking New Hampshire’s no-sales-tax advantage, while Massachusetts residents increasingly move to Rockingham County communities for lower tax burdens and more affordable housing (by Massachusetts standards).
Portsmouth (population ~22,000) is New Hampshire’s only port city and one of the most historically significant and culturally vibrant small cities in New England. Founded in 1623 as one of the first English settlements in America, Portsmouth has a remarkably intact colonial and Federal-era architectural heritage – Strawbery Banke Museum (a living history museum of restored 18th and 19th century buildings) and the Prescott Park waterfront anchor a downtown of galleries, restaurants, and independent shops that consistently ranks among the best in the Northeast. The Piscataqua River – one of the fastest-flowing navigable rivers in the country, forming the Maine border – is spanned by the Memorial Bridge and the Sarah Long Bridge connecting Portsmouth to Kittery, Maine. Portsmouth Naval Shipyard (technically in Kittery, Maine, on the New Hampshire bank) is a major Navy submarine repair facility and one of the region’s largest employers.
Salem – on the Massachusetts border along Route 28 and I-93 – is Rockingham County’s largest town and home to Rockingham Park (the former horse racing track whose site has been redeveloped as a major retail and commercial corridor) and America’s Stonehenge, a mysterious prehistoric stone structure of uncertain origin that draws archaeological tourists.
Hampton Beach is New Hampshire’s primary ocean resort – a classic New England beach resort with a casino ballroom (entertainment venue), boardwalk, and summer crowds from across New England. The New Hampshire seacoast is notably short (18 miles) but intensely utilized.
County government is relatively limited – municipalities handle most services. The county provides courts, corrections, and some social services through elected Commissioners and the county delegation of state representatives.

As in all New Hampshire counties, property taxes in Rockingham County are assessed and administered entirely at the municipal level. Each of the county’s 37 cities and towns has its own assessors. New Hampshire law requires assessment at 100% of full and true market value.
Highest property tax rates in the nation: Rockingham County municipalities rank among the highest property tax rate communities in the United States – towns like Derry, Londonderry, and Raymond carry rates of $20-$28 per $1,000 of assessed value. Portsmouth and some seacoast communities have somewhat lower rates due to a broader commercial tax base, but rates remain high by national standards. The reason is structural: with no income tax and no sales tax, local governments fund schools entirely through property taxes.
The abatement process:
File an abatement application with your local board of assessors or selectmen by March 1 of the tax year. The assessors must respond by July 1. If denied or not acted upon, appeal within 8 months of the tax due date to either:
New Hampshire Board of Tax and Land Appeals (BTLA): A state administrative body in Concord that provides independent review. Filing fee applies.
Rockingham County Superior Court at 4 The Parade, Kingston (603-642-5256): A more formal proceeding, typically requiring an attorney for commercial properties.
Current Use: New Hampshire’s Current Use program taxes qualifying open space land at its agricultural or forestry use value rather than market value – dramatically reducing taxes on undeveloped parcels. A land use change tax is triggered when the property is developed.
No New Hampshire estate tax. No New Hampshire inheritance tax. No gift tax.
OWNWELL CTA: Rockingham County’s March 1 abatement deadline is firm – miss it and wait another year. Massachusetts border communities see strong appreciation from MA buyers; verify your assessment hasn’t overshot market. Current Use available for qualifying open land. No NH estate or inheritance tax. Ownwell manages the abatement appeal with no upfront cost.

Massachusetts border estate planning: A large share of Rockingham County residents are former Massachusetts residents who moved north for tax advantages. If they retain Massachusetts real property, Massachusetts business interests, or Massachusetts employment income, Massachusetts estate tax may still apply to those assets – requiring careful coordination between NH domicile and MA source income/asset planning.
Portsmouth maritime and defense estate planning: The Portsmouth Naval Shipyard’s large civilian and contractor workforce participates in federal civilian benefits (FERS, TSP) with specific beneficiary designation requirements. Portsmouth’s maritime economy – boat builders, marine contractors, and fisheries – involves vessel ownership that requires specific estate planning around Coast Guard documentation, USCG numbering, and commercial fishing permit transferability.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Rockingham County is in southeastern New Hampshire along the seacoast, New Hampshire’s second most populous county, seated in Brentwood.
Step 1: figure out which path applies
New Hampshire has NOT adopted the Uniform Probate Code. Probate is handled by the Probate Division of the Circuit Court in the county where the decedent resided – each of New Hampshire’s 10 counties has its own Probate Division. New Hampshire does not use a fixed-dollar “small estate affidavit” the way most states do; instead it offers two main shortcuts based on circumstances rather than estate value alone.
Voluntary Administration – available for estates consisting entirely of personal property valued at $10,000 or less.
Waiver of Full Administration (RSA 553:32) – available based on WHO inherits and administers, not a dollar threshold. It can apply when a sole beneficiary or sole heir serves as administrator, when all beneficiaries or heirs serve together, when all beneficiaries or heirs assent to the administrator, or when the court finds a waiver appropriate. A waiver eliminates the requirement to file an inventory, obtain a bond, or file a formal accounting – the administration is completed by filing an affidavit of administration, due six months to one year after appointment.
Summary Administration (RSA 553:33) – available by court order for an estate with a gross value (after deducting encumbrances) of $300,000 or less, if the court finds it advisable given the nature, character, and obligations of the estate.
Full (Formal) Administration – required for larger, more complex, or contested estates.
Step 2: filing for administration
File a Petition for Estate Administration (Form NHJB-2145-P) with the Probate Division in the county where the decedent resided, to admit the will (if any) and appoint a personal representative.
The court issues Letters Testamentary (if there’s a will) or Letters of Administration (if intestate).
The personal representative publishes notice to creditors. Creditors have 6 months from the date of first published notice to file claims – no final distribution is permitted before this period ends.
Unless a waiver of full administration applies, the personal representative files an inventory of the estate’s assets and, later, an accounting.
After debts, taxes, and expenses are paid and the creditor period expires, the personal representative distributes the remaining assets and closes the estate.
What it costs
The filing fee for a standard Petition for Estate Administration is generally around $150, plus an additional $55 publication fee if notice must be published.
Executor/administrator compensation is “reasonable” and determined by the court rather than set by a fixed statutory percentage schedule.
New Hampshire has no state estate tax and no state inheritance tax. Only the federal estate tax could apply, and only to very large estates.
