About Ocean County
Ocean County is New Jersey’s fastest-growing county – adding more residents between 2020 and 2025 (5.58% growth) than any other county in the state. Stretching along 45 miles of Atlantic coastline from Mantoloking to Little Egg Inlet, Ocean County contains the Jersey Shore communities of Point Pleasant Beach, Bay Head, Seaside Heights, Island Beach State Park, Long Beach Island (LBI), and the southern Barnegat Bay communities. Inland, the county includes Toms River (the county seat and largest municipality), Lakewood, Jackson Township, Manchester Township, and large swaths of the New Jersey Pinelands – the Pine Barrens – a federally protected 1.1-million-acre coastal plain ecosystem unique to the mid-Atlantic region.
Ocean County has two distinct demographic identities that shape its character. First, it is New Jersey’s premier retirement destination – Manchester Township and the Toms River area have attracted enormous numbers of retirees from northern New Jersey and New York, and the county skews significantly older than the state average. Second, Lakewood Township has become home to one of the largest Orthodox Jewish communities in the world outside of Israel and New York’s Borough Park – a community that has grown dramatically since the 1940s, anchored by Beth Medrash Govoha (one of the largest yeshivas in the Diaspora), and now numbering over 100,000 people within Lakewood alone.

New Jersey property tax assessment is done at the municipal level – each of Ocean County’s 33 municipalities has its own tax assessor who determines property values. The Ocean County Board of Taxation at the Ocean County Courthouse, Toms River (732-929-2008) oversees equalization across municipalities and hears formal assessment appeals.
Assessment notices (postcards showing your property’s tax block, lot, and assessed value) are mailed by each municipality around February 1. Review the assessed value and compare it to what your property would sell for in the current market.
Appeal deadline: April 1 (or 45 days from the date the bulk mailing of assessment notices is completed in municipalities that recently completed a revaluation or reassessment – whichever is later). File Form A-1 (Petition of Appeal) with the Ocean County Board of Taxation – available at the courthouse or online. You cannot appeal your tax amount, your ability to pay, or the fact that a neighbor pays less. You can only appeal that your property’s assessed value exceeds its fair market value.
Comparable sales only: Comparable assessments of other properties are not acceptable evidence of value at the Ocean County Board of Taxation. Only comparable sales can establish market value.
The NJ Freeze Act (3-year lock): A successful appeal to the county board whose judgment is not further appealed creates a 3-year “freeze” – the assessed value is locked and binding on the assessor for the appeal year and the next two years. This makes a successful appeal substantially more valuable than a one-year adjustment.
Properties over $1 million: May be appealed directly to NJ Tax Court instead of the county board. Appeal to Tax Court within 45 days of the board’s judgment if unsatisfied.
NJ Senior Freeze (Property Tax Reimbursement): Seniors 65+ who have lived in NJ for 10+ years and in the same residence for 3+ years, meeting income requirements, can freeze their property tax at the base year level. Ocean County’s large senior population makes this one of the most-used programs in the state.
ANCHOR Program: Homeowners with income under $150,000 can receive up to $1,500; income $150,000–$250,000 receive up to $1,000. Annual filing required between May 1 and February 28.
Stay NJ Program: Homeowners 65+ can receive a credit of 50% of their property tax, up to $6,500 annually (2024 cap).
New Jersey still has an inheritance tax (no estate tax since 2018). Class A beneficiaries (spouse, children, grandchildren, parents) are exempt. Others pay 11–16%.

New Jersey inheritance tax is the defining estate planning consideration in Ocean County – the county’s large senior population and significant intergenerational wealth transfers make inheritance tax planning a routine need. Unmarried partners, friends, nieces/nephews (Class D) pay 15–16%. Class C (siblings, in-laws) pay 11–16%.

Step 1: figure out which path applies
New Jersey probate is governed by Title 3B of the New Jersey Statutes. The elected Surrogate’s Court in each county handles uncontested probate matters; contested matters are referred to the Superior Court, Chancery Division, Probate Part.
Affidavit of Surviving Spouse (N.J.S.A. 3B:10-3) – available only when the decedent died WITHOUT a will (intestate) and the total value of real and personal assets does not exceed $50,000. The surviving spouse, civil union partner, or domestic partner may file this affidavit with the Surrogate’s Court and receive the assets without formal administration. The first $10,000 of the estate is free from the decedent’s debts. There is no affidavit shortcut if a will exists – a will must always be probated regardless of estate size.
Affidavit of Next of Kin (N.J.S.A. 3B:10-4) – available only when the decedent died intestate, there is no surviving spouse/partner, and the estate does not exceed $20,000. One of the next of kin may file this affidavit with the written consent of all other heirs of equal or greater priority.
Regular (Formal) Probate – required whenever there’s a will, or when an intestate estate exceeds the small-estate thresholds above.
Step 2: filing for regular probate
File an Application for Probate with the Surrogate’s Court in the county where the decedent was domiciled (as soon as 10 days after death).
The Surrogate admits the will and issues Letters Testamentary, or – for intestate estates – appoints an administrator and issues Letters of Administration. A surety bond may be required for an administrator.
The Surrogate issues “short certificates,” which the executor/administrator uses as proof of authority – a certificate is typically needed for each asset that must be transferred or sold.
The personal representative notifies creditors and beneficiaries; New Jersey’s creditor claim period is 9 months from death.
The personal representative inventories assets, pays debts and taxes (including any New Jersey Inheritance Tax return, if applicable), and distributes the remaining assets according to the will or New Jersey’s intestacy statute.
The estate is closed with a final accounting filed with the court.
What it costs
Surrogate’s Court filing fees generally range from about $100 to $250 depending on the county and the complexity/value of the estate. Ocean County’s Order to Show Cause filing fee is $175.
New Jersey does NOT require an attorney for probate, but one is commonly recommended for anything beyond the simplest estates.
UNIQUE TO NEW JERSEY: New Jersey has an INHERITANCE TAX that applies to transfers to “Class C” and “Class D” beneficiaries – nieces, nephews, friends, and other non-immediate relatives – even for relatively small inheritances; there is no minimum exemption threshold. Transfers to a spouse, civil union/domestic partner, parents, children, grandchildren, and stepchildren (“Class A” beneficiaries) are exempt.
New Jersey repealed its separate state ESTATE tax for deaths occurring on or after January 1, 2018 – only the inheritance tax remains at the state level.
