About Monmouth County
Monmouth County is one of New Jersey’s most recognizable and storied counties – 53 municipalities stretching from the Raritan Bay (where Monmouth County faces Staten Island, Brooklyn, and Queens across the water) to the Atlantic Ocean, encompassing some of the most valuable and historically significant real estate in the mid-Atlantic region. The county seat is Freehold, the site of the Battle of Monmouth (1778), one of the largest battles of the American Revolution and the one in which Molly Pitcher’s legend was born. The Monmouth Battlefield State Park preserves 1,520 acres of the engagement.
Along the northern Jersey Shore, the Raritan Bayshore communities of Atlantic Highlands, Highlands, and Sea Bright offer dramatic views of Manhattan (the Raritan Bay narrows here to about 5 miles). The central Shore communities of Long Branch (a historic resort city that drew seven US Presidents in the late 19th century), Asbury Park (a cultural renaissance story – an arts and entertainment scene rivaling any mid-sized American city), Belmar, Spring Lake (called “the Irish Riviera”), and Sea Girt (home to the National Guard Training Center) define the classic Jersey Shore experience. New Jersey property tax assessment is done at the municipal level – each of Monmouth County’s 53 municipalities has its own tax assessor. The Monmouth County Board of Taxation at 1 East Main Street, Hall of Records, Freehold (732-431-7404) oversees equalization across municipalities and hears formal assessment appeals.
CRITICAL: Monmouth County uses an EARLIER appeal deadline – January 15. Unlike most New Jersey counties (April 1), Monmouth, Burlington, and Gloucester counties follow an alternative assessment calendar. The appeal deadline is January 15 of the tax year (or 45 days from the bulk mailing date of assessment notifications if the taxing district recently completed a revaluation, whichever is later). Assessment postcards are mailed around November 15 each year – the window between receiving the postcard and the January 15 deadline is very short. Act quickly.
Annual reassessment municipalities: Many Monmouth County municipalities conduct state-approved annual reassessments, maintaining assessments at current market value each year. This affects how the Chapter 123 equalization ratio test works – municipalities that reassess annually use an assumed ratio of 100%, meaning the typical Chapter 123 tolerance range does not apply in the traditional way. In these municipalities, the assessment and market value are treated as equivalent, requiring direct evidence that market value is lower.
The appeal process: File Form A-1 with the Monmouth County Board of Taxation. You must be present at the hearing or represented by a licensed New Jersey attorney. Legal entities (corporations, LLCs, trusts) must be represented by an attorney unless prior year taxes were under $25,000. Only comparable sales – not comparable assessments – establish market value. If unsatisfied with the Board’s decision, appeal to the NJ Tax Court within 45 days of the Board’s judgment mailing date.
Properties over $1 million: May bypass the county board and appeal directly to NJ Tax Court by April 1.
Freeze Act: A successful county board judgment creates a 3-year lock on assessed value (the judgment year and two succeeding years) unless there are significant changes or a municipal revaluation.

New Jersey inheritance tax is particularly important in Monmouth County given the high property values and wealth levels – estates with significant real estate, investment accounts, or business interests that pass to non-exempt beneficiaries face 11–16% inheritance tax. Planning with trusts, beneficiary designations, and gifting strategies is widely practiced in Monmouth County.

Step 1: figure out which path applies
New Jersey probate is governed by Title 3B of the New Jersey Statutes. The elected Surrogate’s Court in each county handles uncontested probate matters; contested matters are referred to the Superior Court, Chancery Division, Probate Part.
Affidavit of Surviving Spouse (N.J.S.A. 3B:10-3) – available only when the decedent died WITHOUT a will (intestate) and the total value of real and personal assets does not exceed $50,000. The surviving spouse, civil union partner, or domestic partner may file this affidavit with the Surrogate’s Court and receive the assets without formal administration. The first $10,000 of the estate is free from the decedent’s debts. There is no affidavit shortcut if a will exists – a will must always be probated regardless of estate size.
Affidavit of Next of Kin (N.J.S.A. 3B:10-4) – available only when the decedent died intestate, there is no surviving spouse/partner, and the estate does not exceed $20,000. One of the next of kin may file this affidavit with the written consent of all other heirs of equal or greater priority.
Regular (Formal) Probate – required whenever there’s a will, or when an intestate estate exceeds the small-estate thresholds above.
Step 2: filing for regular probate
File an Application for Probate with the Surrogate’s Court in the county where the decedent was domiciled (as soon as 10 days after death).
The Surrogate admits the will and issues Letters Testamentary, or – for intestate estates – appoints an administrator and issues Letters of Administration. A surety bond may be required for an administrator.
The Surrogate issues “short certificates,” which the executor/administrator uses as proof of authority – a certificate is typically needed for each asset that must be transferred or sold.
The personal representative notifies creditors and beneficiaries; New Jersey’s creditor claim period is 9 months from death.
The personal representative inventories assets, pays debts and taxes (including any New Jersey Inheritance Tax return, if applicable), and distributes the remaining assets according to the will or New Jersey’s intestacy statute.
The estate is closed with a final accounting filed with the court.
What it costs
Surrogate’s Court filing fees generally range from about $100 to $250 depending on the county and the complexity/value of the estate.
New Jersey does NOT require an attorney for probate, but one is commonly recommended for anything beyond the simplest estates.
UNIQUE TO NEW JERSEY: New Jersey has an INHERITANCE TAX that applies to transfers to “Class C” and “Class D” beneficiaries – nieces, nephews, friends, and other non-immediate relatives – even for relatively small inheritances; there is no minimum exemption threshold. Transfers to a spouse, civil union/domestic partner, parents, children, grandchildren, and stepchildren (“Class A” beneficiaries) are exempt.
New Jersey repealed its separate state ESTATE tax for deaths occurring on or after January 1, 2018 – only the inheritance tax remains at the state level.
