Key Assets: Davie County is genuinely and proudly the boyhood home of DANIEL BOONE, the legendary American frontiersman whose exploits opening the Appalachian frontier to westward settlement helped shape the young nation’s expansion; though Boone is most commonly associated with Kentucky, where he achieved his greatest fame leading settlers through the Cumberland Gap, historian Robert Morgan and generations of local records make clear that “North Carolina was the making of him” – the Boone family relocated from Pennsylvania to the “Forks of the Yadkin” region (present-day Davie County) in 1751, when Daniel was still a teenager, and he spent roughly 13 formative years of his young life here before eventually moving west; it was here, hunting and exploring the wilderness along the Yadkin River, that Boone developed the frontier skills, endurance, and knowledge that would later make him the most consequential explorer in opening the trans-Appalachian West to English-speaking settlement; local records from the era – preserved by the Davie County Historical and Genealogical Society – document the mundane details of Boone’s daily life here, including jury duty, land sales, and even a lawsuit over unpaid debts, offering a refreshingly human counterpoint to his later legendary status; while Daniel and his wife Rebecca eventually moved on and are buried together in Kentucky, his parents, Squire and Sarah Boone, remained in Davie County for the rest of their lives and are buried together in the historic Joppa Cemetery in Mocksville, marked today by a state historical marker along Highway 601; the county’s small village of “Mocks Old Field” – predecessor to today’s Mocksville – is documented to have served as a secret meeting place for Colonial forces and planners during the Revolutionary era, some of whom were members of the extended Boone family; visitors interested in this heritage can also explore the county’s other genuine historic landmarks, including Cooleemee Plantation, an 1849 Anglo-Grecian villa built in the shape of a Greek cross and designated a National Historic Landmark in 1978 for its unique Piedmont architecture, and the Textile Heritage Museum in the historic mill town of Cooleemee, which preserves the story of the once-thriving Erwin cotton mill that anchored the local economy until its 1969 closure
Notes: Davie County’s genuine, well-documented status as Daniel Boone’s boyhood home – where his parents remain buried today – represents a significant and often-overlooked piece of early American frontier history.

About Davie County
Davie County is west-central North Carolina’s Daniel Boone heritage and Yadkin Valley wine county – the frontiersman’s Yadkin River boyhood and the valley’s emerging wine appellation give this Piedmont county a distinctive identity.
Mocksville (the county seat, population ~5,500) is where the Boone family lived in the Yadkin River valley before Daniel Boone’s famous Kentucky expeditions beginning in 1769. The surrounding countryside preserves the Piedmont landscape that shaped one of America’s most celebrated frontiersmen.
The Yadkin Valley American Viticultural Area – covering parts of Davie and surrounding counties – has emerged as one of North Carolina’s most productive wine regions, with vineyards benefiting from the valley’s favorable climate and well-drained soils.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Davie County Clerk of Superior Court – Estates Division 123 South Main Street, Mocksville, NC 27028 (336) 753-6100
Davie County is in the Piedmont Triad region of central North Carolina, seated in Mocksville. The 1909 Davie County Courthouse, Classical Revival in style, is listed on the National Register of Historic Places, as is the 1839 Davie County Jail.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
What it costs
Filing fees for full estate administration generally follow the statewide statutory schedule, which scales with the estate’s value.
North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
