Key Assets: Gates County is genuinely home to MERCHANTS MILLPOND STATE PARK, a place so visually striking that visitors routinely describe it as an “enchanted forest,” centered on a 760-acre, 200-year-old millpond and its adjoining Lassiter Swamp; the millpond’s origin dates to 1811, when it was constructed – by enslaved laborers, historical accounts confirm – to power a working gristmill along Bennetts Creek; the site quickly grew into the genuine commercial heart of Gates County, hosting not only the original gristmill but eventually a sawmill and a farm supply store, all clustered around the pond, which became known as “Merchants Millpond” for the community of traders and merchants who did business there; the mill operations continued for well over a century, finally ceasing shortly before World War II, after which the land passed into private hands and sat largely undisturbed; in the 1960s, a local landowner named A.B. Coleman purchased the property, and in an extraordinary act of conservation generosity, later donated 919 acres – including the millpond itself – to the State of North Carolina; that gift, combined with an additional 925 acres of adjoining woodland donated the same year by The Nature Conservancy, led directly to the official creation of Merchants Millpond State Park in 1973; today the park spans more than 3,500 acres and centers on one of the most ecologically unique landscapes in the entire state – towering old-growth bald cypress and tupelo gum trees, their trunks and branches genuinely twisted into fantastical shapes by decades of mistletoe growth, rise directly out of the pond’s dark, tannin-stained waters, draped in Spanish moss and resurrection ferns; paddlers exploring the millpond by canoe or kayak can spot American alligators living at the very northernmost edge of their entire range, along with river otters, mink, bobcats, beavers, and a rich variety of migratory swamp warblers and waterfowl; more than 9 miles of hiking trails wind through the park’s diverse wetland, swamp, and forest habitats, and the historic restored gristmill – one of the oldest surviving in North Carolina – remains open for visitors to explore

Gates County was founded in 1779, named for General Horatio Gates, on the Virginia border in northeastern North Carolina, seated in Gatesville. The 1836 Gates County Courthouse, Federal in style, is listed on the National Register of Historic Places.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.

North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
