Key Assets: Roger Mills County is genuinely home to Washita Battlefield National Historic Site, a nationally significant and deeply solemn site preserving the location of the November 27, 1868 dawn attack by Lt. Col. George Armstrong Custer’s 7th U.S. Cavalry on a Southern Cheyenne village led by Peace Chief Black Kettle; Black Kettle, who had survived the earlier 1864 Sand Creek Massacre and had signed peace treaties in both 1865 and 1867, was among the roughly 103 Cheyenne men, women, and children killed in the attack, along with his wife; the site, designated a National Historic Landmark in 1965 and formally established as a National Historic Site in 1996, spans a 315.2-acre memorial completely surrounded by the Black Kettle National Grassland, with a visitor center offering exhibits, a film, and a 1.5-mile interpretive walking trail along the Washita River; a related Black Kettle Museum is located nearby in the town of Cheyenne; the county seat, also named Cheyenne, sits roughly one mile east of the battlefield and was itself founded in a single day on April 19, 1892, when the former Cheyenne and Arapaho Reservation opened to non-Indian settlement – three city blocks of businesses sprang up overnight in tents, shacks, and dugouts; the town genuinely commemorates its own land-run heritage with an Old Settlers Reunion held every five years; the county lies above the petroleum-rich Panhandle-Hugoton Field and part of the Ogallala Aquifer, and takes its name from Roger Q. Mills, a Confederate Army officer who later served as a U.S. Senator from Texas
Notes: Washita Battlefield National Historic Site’s genuine, carefully preserved history of the 1868 attack on Black Kettle’s village is one of the most historically weighty and educationally important sites found anywhere in this project, and deserves visitors’ particular respect and mindfulness.

About Roger Mills County County
Roger Mills County is western Oklahoma’s remote high plains county – one of the state’s least populated, centered on Cheyenne near the Texas border where the Washita River cuts through rolling red-dirt rangeland and shortgrass prairie. The county encompasses Black Kettle National Grassland and the Washita Battlefield National Historic Site, commemorating the 1868 Battle of the Washita where Lt. Col. Custer’s troops attacked a Cheyenne encampment. Ranching and wheat farming sustain the county’s economy.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Roger Mills County District Court 500 East Broadway, Cheyenne, OK 73628 (580) 303-6053
Roger Mills County was created in 1891, named for Roger Q. Mills, in western Oklahoma, seated in Cheyenne – Oklahoma’s fourth-least populous county, and home to the Washita Battlefield National Historic Site.
Step 1: figure out which path applies
Oklahoma has NOT adopted the Uniform Probate Code, maintaining its own probate statutes under Title 58 of the Oklahoma Statutes. Probate cases are handled by the District Court in each of Oklahoma’s 77 counties.
Small Estate Affidavit (58 O.S. § 393) – available when the total value of probate personal property (not counting real estate) is $50,000 or less. At least 10 days must have passed since death. This process skips court entirely: the affidavit is signed, notarized, and presented directly to whoever holds the asset (a bank, for example), along with a certified death certificate. Real estate can never be transferred this way – even a small estate with real property still needs some form of court proceeding.
Summary Administration – available when the total probate estate does not exceed $200,000, or when the decedent has been dead more than 5 years, or lived outside Oklahoma. This is an abbreviated form of probate – still court-supervised, but faster and less expensive than full administration.
Regular (Full) Administration – the standard court-supervised process, required for larger or more complex estates, or wherever real property is involved and the shortcuts above don’t apply. A personal representative (executor or administrator) is formally appointed by the court.
Step 2: filing for administration
A Petition for Probate is filed in the District Court of the county where the decedent resided; if there’s a will, the original is filed with the petition.
The court sets a hearing date and requires notice be given to heirs and interested parties.
The court appoints a personal representative (executor if named in a will, administrator if intestate) and issues Letters Testamentary or Letters of Administration.
Creditors are notified; claims against the estate must be presented within the statutory period.
The personal representative inventories assets, pays valid debts and taxes, and distributes what remains according to the will or Oklahoma’s intestacy laws.
The estate is closed once a final accounting is filed and approved by the court.
What it costs
Filing fees vary by county – check with Roger Mills County directly for current fees.
Oklahoma has a statutory attorney fee schedule for probate, which provides more predictability than states without one.
No state estate tax, no state inheritance tax. Only the federal estate tax could apply, and only to very large estates.
