Key Assets: Erie County is genuinely the birthplace of one of the most celebrated American victories of the War of 1812: the BATTLE OF LAKE ERIE, fought September 10, 1813; following American setbacks including the loss of Detroit, the U.S. Navy dispatched 27-year-old Master Commandant Oliver Hazard Perry to the remote, largely undeveloped harbor at Presque Isle (present-day Erie) with orders to build an American fleet capable of contesting British naval dominance on Lake Erie; working with master shipbuilder Noah Brown and facing severe shortages of skilled labor, iron, and even basic supplies – with much of the town itself deserted out of fear of British and allied Native raids – Perry and his crews nonetheless constructed nine vessels from scratch over a matter of months, including his flagship, the brig USS Lawrence (named for Captain James Lawrence, whose dying words “Don’t give up the ship” became Perry’s rallying cry) and its sister ship, the USS Niagara; Presque Isle Bay’s shallow, sandbar-guarded entrance made it a naturally defensible shipbuilding site, protecting the fleet from a superior British force based at Amherstburg, Ontario, which lacked the resources to match Perry’s rapid construction; on September 10, 1813, Perry’s nine-ship squadron engaged and decisively defeated a six-ship British squadron near Put-in-Bay – the first time in U.S. naval history that an entire enemy fleet was captured; when his flagship Lawrence was battered into uselessness during the fighting, Perry famously transferred his command by rowboat under fire to the still-intact Niagara and led a renewed attack that broke the British line, delivering total victory; his after-battle dispatch to General William Henry Harrison – “We have met the enemy and they are ours” – became one of the most famous lines in American military history; the victory secured American control of Lake Erie for the remainder of the war and enabled the recapture of Detroit; today, visitors can see Perry’s actual sword, sword belt, and telescope from the battle at the Hagen History Center in Erie, and the reconstructed USS Niagara is berthed at the Erie Maritime Museum
Notes: Erie’s genuine, extensively documented role as the birthplace and construction site of Perry’s fleet – culminating in one of the most celebrated naval victories in American history – is a landmark piece of War of 1812 heritage.

About Erie County
Erie County is Pennsylvania’s window on the Great Lakes – its only port on Lake Erie, the fourth-largest of the Great Lakes, and a city whose history as a manufacturing and maritime center has given way to a healthcare and education economy anchored by UPMC Hamot and Saint Vincent Hospital.
Presque Isle State Park – the crown jewel of Erie County’s landscape – is a curved sand peninsula jutting into Lake Erie, protecting the city’s harbor on one side and offering miles of Lake Erie beaches on the other. Presque Isle is the most visited state park in Pennsylvania, drawing 4+ million visitors annually for swimming, boating, birding (the peninsula is a critical migratory bird stopover on the Atlantic and Mississippi flyways), and beach recreation. The Presque Isle Lighthouse (1872) is one of Lake Erie’s historic lights.
The Battle of Lake Erie (September 10, 1813) – in which Commodore Oliver Hazard Perry defeated the British fleet in one of the most significant naval battles in American history, securing American control of the Great Lakes – was fought within sight of Erie. Perry’s famous dispatch to General William Henry Harrison – “We have met the enemy and they are ours” – is one of the most celebrated communiqués in American military history. The Erie Maritime Museum and the US Brig Niagara (a reconstruction of Perry’s flagship) honor this history.
Erie (the county seat, population ~95,000) is a post-industrial city whose manufacturing base – plastics, metal fabrication, GE Transportation (now Wabtec Corporation) locomotive production – has been significantly reduced from its peak. Wabtec’s Erie facility remains one of the largest locomotive manufacturing sites in the world. The city’s revitalization has centered on healthcare, Mercyhurst University, Gannon University, and Penn State Behrend.
County government is a three-member Board of County Commissioners with separately elected offices for the Controller, Clerk of Courts, Coroner, District Attorney, Prothonotary, Recorder of Deeds, Register of Wills, Sheriff, and Treasurer.

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Register of Wills, Erie County Erie County Courthouse, 140 West Sixth Street, Room 103/104, Erie, PA 16501 (814) 451-6080 Erie County is in the far northwestern corner of Pennsylvania along Lake Erie, seated in Erie.
Step 1: figure out which path applies
Pennsylvania has NOT adopted the Uniform Probate Code. Probate runs through its own statute, the Probate, Estates and Fiduciaries (PEF) Code, Title 20 of the Pennsylvania Consolidated Statutes. Probate begins at the Register of Wills – an elected county official – in the county where the decedent lived. Routine, uncontested probate happens entirely at the Register of Wills; only disputes escalate to the Orphans’ Court Division of the Court of Common Pleas.
Small Estate Petition (20 Pa.C.S. § 3102) – available when the estate’s personal property (excluding real estate) totals $50,000 or less. This lets an interested party petition the Orphans’ Court directly for approval of a proposed distribution, skipping the need to formally open a full probate estate. Real property is never covered by this simplified process.
Formal Probate – required for estates exceeding $50,000 in personal property, or for any estate involving real property that needs to pass through probate. The Register of Wills validates the will (if any) and issues Letters Testamentary or Letters of Administration.
Step 2: filing for administration
The personal representative files with the Register of Wills in Erie County, along with the original will if one exists.
The Register of Wills reviews and, if in order, issues Letters Testamentary or Letters of Administration.
The personal representative gathers assets, notifies heirs and known creditors, and begins settling the estate.
Pennsylvania has a one-year creditor period running from the date of death, not from any published notice.
A Pennsylvania Inheritance Tax Return (REV-1500) must be filed with the Register of Wills, regardless of estate size.
Once debts, taxes, and expenses are settled, remaining assets are distributed according to the will or Pennsylvania’s intestacy laws, and the estate is closed.
What it costs
Filing fees vary; check with Erie County directly for current fees.
Pennsylvania has NO separate state estate tax, but its INHERITANCE TAX applies to virtually every estate: 0% to a surviving spouse (and to a parent inheriting from a child 21 or younger), 4.5% to children and other lineal descendants, 12% to siblings, and 15% to everyone else. No dollar exemption.
A 5% early-payment discount applies if paid within 3 months of death; the return and payment are otherwise due within 9 months.
