About Monroe County
Monroe County’s transformation is one of the most dramatic demographic stories in Pennsylvania. The Pocono Mountains have attracted resort visitors since the nineteenth century – the mountain lakes, waterfalls, and forested terrain drew honeymooners in the mid-twentieth century (the Pocono region was the “Honeymoon Capital of the World” for decades) and vacationers who built summer cottages and ski chalets throughout the county’s communities. What changed beginning in the 1990s and accelerating through the 2000s was the conversion of seasonal and vacation properties into year-round residences by New York City commuters – primarily from the Bronx, Brooklyn, and New Jersey – who discovered that Monroe County property was affordable, the commute on I-80 to the George Washington Bridge was about 90 minutes in non-rush traffic, and the cost of living was a fraction of metropolitan New York.
The result is a county that now functions primarily as a New York exurb, with one of the most ethnically diverse populations of any rural Pennsylvania county and a housing market that tracks New York City affordability trends more closely than Pennsylvania regional patterns. The infrastructure – roads, schools, utilities – has struggled to keep pace. Route 611, Route 209, and I-80 experience gridlock on holidays and peak travel days. The school district has dealt with rapid enrollment growth. But the county’s natural assets – Delaware Water Gap National Recreation Area, Pocono Mountains ski resorts, the Delaware River corridor – remain genuine and continue to draw visitors and residents in roughly equal measure.

Monroe County was founded April 1, 1836, named for James Monroe, in the Pocono Mountains region of northeastern Pennsylvania, seated in Stroudsburg – about 5 miles from the Delaware Water Gap.
Step 1: figure out which path applies
Pennsylvania has NOT adopted the Uniform Probate Code. Probate runs through its own statute, the Probate, Estates and Fiduciaries (PEF) Code, Title 20 of the Pennsylvania Consolidated Statutes. Probate begins at the Register of Wills – an elected county official – in the county where the decedent lived. Routine, uncontested probate happens entirely at the Register of Wills; only disputes escalate to the Orphans’ Court Division of the Court of Common Pleas.
Small Estate Petition (20 Pa.C.S. § 3102) – available when the estate’s personal property (excluding real estate) totals $50,000 or less. This lets an interested party petition the Orphans’ Court directly for approval of a proposed distribution, skipping the need to formally open a full probate estate. Real property is never covered by this simplified process.
Formal Probate – required for estates exceeding $50,000 in personal property, or for any estate involving real property that needs to pass through probate. The Register of Wills validates the will (if any) and issues Letters Testamentary or Letters of Administration.
Step 2: filing for administration
The personal representative files with the Register of Wills in Monroe County, along with the original will if one exists.

The personal representative gathers assets, notifies heirs and known creditors, and begins settling the estate.
Pennsylvania has a one-year creditor period running from the date of death, not from any published notice.

Once debts, taxes, and expenses are settled, remaining assets are distributed according to the will or Pennsylvania’s intestacy laws, and the estate is closed.

A 5% early-payment discount applies if paid within 3 months of death; the return and payment are otherwise due within 9 months.
