Key Assets: York County is genuinely the site of one of the Revolutionary War’s most pivotal turning-point battles, the BATTLE OF HUCK’S DEFEAT (also known as the Battle of Williamson’s Plantation), fought on July 12, 1780, at what is now Historic Brattonsville; Scots-Irish settlers William and Martha Bratton purchased 200 acres along Fishing Creek in 1766, and by 1780, William Bratton had become a Patriot militia colonel; British Captain Christian Huck, a Loyalist officer notorious for his brutal treatment of the region’s Scots-Irish Presbyterian residents, led a detachment of the British Legion toward the Bratton home searching for Colonel Bratton; genuinely and remarkably, an enslaved man named Watt warned the Patriots of Huck’s approach, giving them crucial time to organize; the following morning, Patriot militia launched a coordinated three-pronged assault on Huck’s camp at nearby Williamson’s Plantation, killing Huck within minutes and routing his forces in under an hour; the victory, following a string of demoralizing Patriot defeats across the South, is widely credited by historians as the spark that restored Patriot morale and confidence in the Carolina backcountry, directly paving the way for the larger Patriot victories at Kings Mountain (October 1780) and Cowpens (January 1781) that together turned the tide of the Revolutionary War’s Southern Campaign; for over a century the precise battlefield location remained unknown until archaeological research led by Culture & Heritage Museums beginning in 2006 finally mapped the site with precision, uncovering rifle balls, uniform buttons, horse gear, and domestic artifacts; the battlefield and interpretive trail opened to the public in 2014 and won a 2015 Achievement of Excellence award from the Confederation of South Carolina Local Historical Societies; today, Historic Brattonsville preserves the battlefield alongside more than 30 historic structures across 778-800 acres, including award-winning African American history programming, and the site has appeared as a filming location in the movie “The Patriot”

York County’s growth has been substantially tax-motivated – South Carolina’s income tax structure, combined with lower property taxes than Mecklenburg County, has made Fort Mill, Indian Land, and Tega Cay attractive to Charlotte earners who can accept a 20-minute I-77 commute in exchange for meaningful annual tax savings. Fort Mill’s development boom has been among the most sustained in the Southeast, and the school system has had to build schools at a pace that challenges infrastructure planning.

York County is in the upstate/Piedmont region of South Carolina along the North Carolina border, seated in York – one of the state’s most populous counties, part of the Charlotte metro area. Due to high filing volume, all estate and guardianship/conservatorship administrations, and marriage license applications, require an appointment.
Step 1: figure out which path applies
South Carolina HAS adopted a version of the Uniform Probate Code, giving it more standardized and generally more streamlined procedures than states with older, common-law-based systems. Probate is handled by a dedicated Probate Court in each of South Carolina’s 46 counties – a separate court of limited jurisdiction, led by an elected Probate Judge (four-year term). The case is filed in the county where the decedent lived.
Small Estate Affidavit / Collection by Affidavit (S.C. Code Ann. § 62-3-1201) – available when the gross value of the entire probate estate, less liens and encumbrances, does not exceed $45,000 (raised from $25,000 for deaths after May 2025). At least 30 days must have passed since death, and no petition for appointment of a personal representative can be pending anywhere. The successor files a Form 420PC “Affidavit for Collection of Personal Property,” which the probate judge approves and countersigns.
Summary Administration (§ 62-3-1203) – a simplified probate procedure available when the value of the estate passing by will (less liens and encumbrances) is under the statutory threshold, or when the surviving spouse is the sole heir or beneficiary.
Informal Probate – the standard path for the majority of estates. No notices or hearings are required unless demanded by an interested party.
Formal Proceedings – reserved for contested matters: objections to a personal representative’s appointment, will contests, a lost or destroyed will, or declaratory judgments on intestacy.
Step 2: filing for administration
The personal representative (or an interested party) files a petition with the York County Probate Court where the decedent resided (appointment required due to high filing volume); if there’s a will, the original is filed with it.
For informal probate, the Probate Judge (or a designated staff member) reviews the application administratively; formal proceedings require notice and a hearing.
The court issues Letters Testamentary or Letters of Administration, giving the personal representative authority to act.
The personal representative files an inventory and appraisement within 90 days of qualification, and provides periodic accountings as the court requires.
Creditors are notified; claims not timely presented are barred.
The estate closes with a final settlement – a verified report and proposed distribution served on interested parties and approved by the Probate Court.
