Key Assets: Cleveland County is genuinely and proudly the birthplace of EARL SCRUGGS, widely hailed as “The Father of Bluegrass Music” and the single most influential banjo player in American musical history; Earl Eugene Scruggs was born January 6, 1924, on a modest 40-acre cotton farm in the small Flint Hill community, located just southwest of Shelby and a stone’s throw from the town of Boiling Springs; the youngest of five children in a deeply musical family, Earl’s father George Elam Scruggs played frailing-style open-back banjo and fiddle but passed away when Earl was only four – young Earl nonetheless began teaching himself his late father’s banjo that very same year, and by age ten had begun developing what would eventually become known worldwide as “Scruggs style,” a groundbreaking three-finger picking technique using the thumb and first two fingers of the right hand, radically different from any banjo style that had come before; Scruggs drew inspiration from watching a family relative, Smith Hammett, and by his early teens was already playing local dances and community gatherings around Flint Hill and nearby Boiling Springs, where he attended high school; his big break came in December 1945, when he joined bluegrass pioneer Bill Monroe’s Blue Grass Boys, quickly becoming a fixture on the Grand Ole Opry and helping crystallize what would become the entire bluegrass genre; in 1948, Scruggs and fellow Blue Grass Boys member Lester Flatt left to form their own hugely influential band, Flatt and Scruggs, later performing the iconic theme songs for both “The Beverly Hillbillies” television show and the 1967 film “Bonnie and Clyde” (“Foggy Mountain Breakdown”); in 1985, Scruggs and Flatt were jointly inducted into the Country Music Hall of Fame; fellow bluegrass legend John Hartford once summed up Scruggs’s outsized influence on the entire genre by saying, “if it wasn’t for Earl Scruggs, you wouldn’t [be] worried about who invented” three-finger banjo picking; today, the historic 1907 Cleveland County Courthouse in downtown Shelby – itself a striking Classical Revival building listed on the National Register of Historic Places – houses the Earl Scruggs Center, “Music & Stories from the American South,” which opened in 2014 and explores both Scruggs’s remarkable life and the broader musical and cultural heritage of the American South, while also hosting live concerts and music lectures
Notes: Earl Scruggs’s genuine, extensively documented roots in Cleveland County’s Flint Hill community – and the Earl Scruggs Center’s home inside the county’s own historic courthouse – represent one of the most musically significant heritage sites found anywhere in this project.

About Cleveland County
Cleveland County’s most nationally significant contribution to American culture is Earl Scruggs – born in Flint Hill in 1924, raised in the foothills where old-time banjo music was part of everyday life, Scruggs developed the three-finger picking technique that transformed the banjo from a folk instrument into the centerpiece of bluegrass music. The Earl Scruggs Center in Shelby commemorates his life and places his musical contribution in the context of the Appalachian foothills culture that produced it.
The county’s textile heritage – Shelby was a significant yarn and fabric manufacturing center through much of the twentieth century – has largely passed, and the county has diversified into healthcare (Cleveland Regional Medical Center), distribution, and some Charlotte metro residential growth along the US-74 corridor. Shelby’s downtown has invested in arts programming and independent business development. Gardner-Webb University in neighboring Boiling Springs provides higher education access.
Heritage | Kings Mountain National Military Park preserves the site of the 1780 Battle of Kings Mountain, a decisive Revolutionary War victory by frontier militia that turned the tide of the war’s Southern campaign; Shelby grew as a textile and cotton-milling center, and the county’s most famous native son, country music legend Earl Scruggs, helped popularize the banjo style that bears his name, celebrated at the Earl Scruggs Center downtown Outdoors | Kings Mountain State Park (South Carolina side) and the North Carolina military park together offer extensive hiking; Broad River access points provide fishing and paddling through the county’s rolling farmland Notable | The Earl Scruggs Center and Shelby’s historic courthouse square anchor a growing downtown arts and music scene; the county’s baseball history ties into a deep regional tradition Library | Cleveland County Memorial Library in Shelby serves a mix of small manufacturing towns and rural farming communities

Probate & Estate
Losing someone and having to deal with courts and paperwork at the same time is hard. This section won’t make that easier, but it should tell you what to expect, what it costs, and where to go – so at least you’re not walking in blind.
Where to go
Cleveland County Clerk of Superior Court – Estates Division 100 Justice Place, Shelby, NC 28150 (704) 484-4859 Cleveland County is in the foothills of western North Carolina, seated in Shelby.
Step 1: figure out which path applies
North Carolina has NOT adopted the Uniform Probate Code. Probate is handled by the Clerk of Superior Court – an elected official who serves as the ex officio judge of probate – in the county where the decedent was domiciled, under Chapter 28A of the North Carolina General Statutes. Unlike most states, North Carolina does not have a separate probate court; the Clerk’s Estates Division handles all wills, estates, and guardianship matters.
Affidavit for Collection of Personal Property of Decedent (“collection by affidavit,” N.C. Gen. Stat. § 28A-25-1 and § 28A-25-1.1) – available when the decedent’s personal property, less liens and encumbrances, does not exceed $20,000, or $30,000 if the surviving spouse is the sole heir and receives all property covered by the statute. Filed at least 30 days after death, using Form AOC-E-203B. Real property CANNOT be transferred through this process. If the decedent left a will, the will must first be admitted to probate and a certified copy attached to the affidavit.
Summary Administration – an abbreviated procedure available only when the surviving spouse is the sole heir.
Full Estate Administration – required for larger or more complex estates; the personal representative (called “executor” if named in a will, “administrator” if intestate) is appointed by the Clerk and receives Letters Testamentary or Letters of Administration.
Step 2: filing for administration
File the will (if any) and a petition with the Clerk of Superior Court, Estates Division, in the county where the decedent was domiciled.
The Clerk appoints the personal representative and issues Letters Testamentary or Letters of Administration.
The personal representative publishes notice to creditors; North Carolina’s creditor claim period is typically at least three months from first publication.
The personal representative inventories the estate’s assets, pays debts and expenses, and distributes the remaining assets according to the will or North Carolina’s intestacy law, reporting back to the Clerk at key stages.
The estate is closed once a final accounting is filed and approved by the Clerk.
What it costs
Filing fees for full estate administration generally follow the statewide statutory schedule, which scales with the estate’s value.
North Carolina repealed its state estate tax in 2013. There is no state estate tax and no state inheritance tax – only the federal estate tax could apply, and only to very large estates.
